EASTWOOD, being first duly sworn, deposes and says: That she is and at all times herein mentioned was the duly quali- fied Secretary of the East San Bernardino County Water District, San Bernardino County, California; and that she caused to be posted on or near the door of the meeting place of the Board of Directors of said District a copy of the Notice of a scheduled Special Board Meeting of the Board of Directors of the East San Bernardino County Water District. Said posting was commenced on January 26, 1976 and remained posted to the time of the meeting, said meeting being January 29, 1976, 3:30 p.m. Bonnie R. ROLL CALL: Present: President Pkilip A. Disck, Norman W. Forrest, Dennis Johnson, Gerald Stoops, O.A. Wall Absent: None STAFF PRESENT: Howard H. Hendricks, Auditor-Treasurer; Bonnie Eastwood, Secretary PROFESSIONAL STAFF: Robert Farrell, Legal Counsel; Dick Rieker, Consulting Engineer OTHERS PRESENT: Arnold Stubblefield, John Stubblefield, Jim Fiscalini REQUEST FOR WATER AND SEWER SERVICE TO TRACT 9058 STUBBLEFIELD The President requested Auditor Hendricks to review the matter of sewer and water availability for Tract 9058. Auditor Hendricks in- dicated meetings had been held by the Water Committee, as well as Attorney Farrell, Consulting Engineer Rowe, Duncan Parkes and himself to prepare an estimate of costs for water service to Tract 9058. The estimate of costs for water service to Tract 9058 given to Mr. Stubblefield amounted to $44,821.00. Mr. Stubblefield contended that his contract with the District did not provide for his having to pay for off-site costs, which the estimate included. Auditor Hendricks indicated the District has a Special Facility charge which was initiated in 1971 for cases such as this. However, the Borad did not feel it applied in tkis instance. As a savings to the District, it was suggested the reservoir serving Mountain Shadows Mobile Home Park be used for serving Tract 9058. There was a discussion on the reservoir and an agreement as to its use if it met all District specifications. An easement road along with its maintenance was dis- cussed. Mr. Stubblefield contended it would be more economical if the District maintained it. After a long and detailed discussion on whether Mr. Stubblefield should pay for both off and on-site costs, it was M/S/C (Stoops - Forrest) that the contractor, Stubblefield, would pay for the installation of water lines within Tract 9058 and the District would pay the cost of all off-site water lines installed to serve said Tract 9058, including the water line from the tract bound- ary to the reservoir site. After discussion on the use of the reservoir presently serving Mount- ain Shadows Mobile Homr Park to serve Tract 9058 with water, it was M/S/C (Stoops - Forrest) that assuming the tank is usable, an agreement be drawn up by legal counsel between the District and Mr. Stubblefield regarding its use. After a discussion on moving the meter connection from its present location, it was M/S/C (Stoops - Forrest) that the cost of the new service would be assumed by the District. REQUEST TO RAISE SEWER COVERAGE FROM SEVEN FOOT TO SIX FOOT Mr. Fiscalini was requested by President Disch to make his 1/29/76 -1- 0 535 presentation to the Board regarding sewer depth coverage in Tract 9077. Mr. Fiscalini stated because of the rocky soil composition in Tract 9077, he was requesting a six foot coverage rather than seven foot, which the District ordinance requires. Following a dis- cussion and legal interpretation of the sewer ordinance by legal counsel, it was M/S/C (Stoops - Forrest) that the District abide by the Ordinance regarding sewer depth coverage in this instance, however, the engin- eers and staff are directed to review the Ordinance and also check with other cities regarding their sewer depth coverage requirements and bring the information back to the Board.
