RESOLUTION 1991.38
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE EAST VALLEY
WATER DISTRICT ESTABLISHING WATER RATES, RULES AND
REGULATIONS FOR WATER SERVICE BY THE EAST VALLEY WATER
DISTRICT, RESCINDING RESOLUTIONS 1990.24 AND 1990.250
BE IT HEREBY RESOLVED by the Board of Directors of the
East Valley Water District as follows:
WHEREAS, the Board of Directors of the East Valley
Water District desires to establish rates, rules and
regulations for water service by the East Valley Water
District; and
WHEREAS, the District has conducted a study on the
public facilities operated by the District and the
anticipated need for additional facilities in the future;
and,
WHEREAS, this study, entitled East Valley Water
District Impact Fee Study, AB 1600 Compliance was prepared
by the engineering firm of URS Corporation dated May 1989;
WHEREAS, this study indicates that existing public
facilities operated by the District will need to be modified
and additional facilities will be needed for the District to
provide adequate water service to the people within the
District; and
WHEREAS, this study indicates that fees need to be
established by the District to raise sufficient revenue to
finance the public facilities necessary to provide adequate
water service; and
WHEREAS, the revenue raised by these fees will be used
to modify or construct additional public facilities to
provide adequate water services, and do not exceed the total
cost of these facilities; and
WHEREAS, the study was available for review and
inspection as provided in the notice of this hearing; and
WHEREAS, this action is necessary for obtaining funds
for the construction of capital public facilities necessary
to maintain water service within the boundaries of the
District and therefore exempt from the requirements of the
California Environmental Quality Action as provided by
Public Resources Code Section 21080 (b) (8) .
NOW, THEREFORE, BE IT RESOLVED that the Board of
Directors of the East Valley Water District does hereby
resolve, determine and adopt the following:

SECTION 1. SYSTEM CHARGE
The system charge is the monthly availability charge
applicable to all metered water services and are hereby
established as follows:

SECTION 2 . CONSUMPTION CHARGE
The consumption charge is the charge per hundred cubic
feet (HCF) for all water registered by the customer's water
service meter and is hereby established as follows:
EAST VALLEY WATER DISTRICT
Consumption Charge = $0.80 per hundred cubic feet
HIGHLAND WATER SYSTEM
Consumption Charge = $0.844 per hundred cubic feet

SECTION 3 . DELINQUENCY CHARGES
The delinquency charge is the charge which is added to
each delinquent account at the time any amount becomes
delinquent, provided that no delinquent charge shall be made
on any account which at that time has no delinquencies of
record. The delinquency charge is hereby established as one
and one-half percent (1-1/2%) of the total amount
delinquent.
SECTION 4. FIRE SERVICE STANDBY CHARGE
The fire service standby charge is the monthly charge
per inch diameter of the District fire service meter. Water
use through this service is limited to emergency fire
requirements only.
"Fire Service Standby Charge = $4.50 per month per inch
diameter.
SECTION 5. WATER SERVICE CONNECTION CHARGES
The water service connection charge is the charge for
the type and size of water service connection desired. Such
regular charge shall be paid in advance by the applicant.
Where there is no regular charge, the District reserves the
right to require the applicant to deposit an amount equal to
the estimated cost of such service connection.

SECTION 5.1 RESIDENTIAL FIRE SERVICE CONNECTION CHARGES
Where a fire service connection is required for
residential buildings, the water service connection from the
water main shall be divided and two meters shall be set, one
for domestic service and one for fire service to the
building. The residential fire service charge is the charge
for that service required for the sprinkler system according
to the type and size of the water service connection
desired. Such charge shall be paid in advance by the
applicant. Where there is no regular charge, the District
reserves the right to require the applicant to deposit an

amount equal to the estimated cost of such service
connection.

Only duly authorized employees or agents of the
District shall be authorized to install service connections.
SECTION 6. FIRE SERVICE CONNECTION CHARGES
The fire service charge is the charge for the type and
size of fire service connection desired. Such regular
charge shall be paid in advance by the applicant. Where
there is no regular charge, the District reserves the right
to require the applicant to deposit an amount equal to the
estimated cost of such service connection.

SECTION 7. WATER MAIN EXTENSION CHARGE
The charge for water main extension is the charge for
the replacement or construction of the water main fronting
on the property to be served.
The charge for water main extension is hereby
established at the rate of $30. 00 per linear foot ($15. 00
per front foot for service from existing water main) .
SECTION 8. FIRE HYDRANT INSTALLATION CHARGE
The charge for installation of fire hydrants is hereby
established at the rate of $2,225.00 each.
SECTION 9. SPECIAL FACILITY CHARGE
A special facility charge shall be required for
development of limited service areas whenever special
facilities, including pressure regulators are required. The
charge to be made to a developer or owner of land that is
considered by the District to be within a limited service
area shall be based upon the developer's or landowner's
proportionate share of the cost for the installation of such
Special Facility. Such proportionate share to be borne by

the developer , landowner,.sha1J be basedrLi the percentage
of such develd nt to the entire limited, rvice area to be
served by the special Facilities; and the difference between
the cost of facilities to serve the same number of acres or
area under normal conditions and the cost of facilities to
serve the acreage of area under special conditions at a
higher cost.

SECTION 10. INSPECTION CHARGES
Where a customer service connection or facility
requires inspection by District personnel, the customer
shall be charged for such inspection at the rate of $270.00
per day.
SECTION 11. WATER SYSTEM DESIGN CHARGE
A non-refundable water system design charge shall be
required for all main extensions, service connections and/or
special facilities requiring the preparation of engineering
plans and drawings. The water system design charge is
hereby established as follows:
1. Water main extensions for pipelines to be
installed where a field topographic survey
is necessary to design a proper alignment
and profile grade shall be charged $1,230.00
plus $2.20 per lineal foot.
2. Water main installations for pipelines within
new subdivisions where recent 40 scale street
improvement plans and profiles are available
and no field survey work is necessary shall
be charged $615.00 plus $0.80 per lineal foot.
SECTION 12. DISCONNECT/RECONNECT CHARGE
The disconnect/reconnect charge is the charge which
covers the reasonable District disconnect/reconnect costs
for disconnection and reconnection of service connections
which are in violation of District ordinances, resolutions
and rules. The disconnect/reconnect charge is hereby
established at the rate of $30.00 per occurrence.
SECTION 13. METER TEST CHARGE
The meter test charge is the charge which covers the
District costs for removing, testing and reinstalling the
water meter to be tested as provided for in the ordinances
of the District. The meter test charge is hereby
established at the rate of $20.00 per test.
SECTION 14. SECURITY DEPOSIT CHARGE
The Security deposit is the charge which insures
payment of minimum District charges during the first year of
service and which may be refunded after a specified period.
The security deposit is hereby established as follows:
1. Owner/Resident $50. 00
2 . Tenant with owner signature 50.00
3 . Tenant without owner signature 75. 00

SECTION 15. UNAUTHORIZED USE OF WATER CHARGE
The unauthorized use of water charge shall be charged
to any person, organization or agency for each unauthorized
use of District water or for tampering in any manner with
any meter belonging to the District which this tampering
shall affect the accuracy of such meter. The unauthorized
use of water charge is hereby established at the rate of
$500. 00 per occurrence.
SECTION 16. CONSTRUCTION WATER CHARGE
The construction water charge is the flat rate charge
for use of water during the construction phase of a new
building. It is only available for services 1" in diameter
or smaller. The charge is hereby established at the rate of
$29.00 per month per service requested.
SECTION 17. SERVICE INITIATION CHARGE
The service initiation charge is the charge which
covers the reasonable District costs for initiating water
service. The service initiation charge is hereby
established at $25. 00 per service address.
Any person disputing these fees may file a protest with
the General Manager of the District as provided for in
District Ordinance No. 345 or as provided for by law. The
decision of the Board of Directors regarding any protest
shall be final.
This Resolution shall take effect April 1, 1991, except
the fees for residential development shall take effect under
this Resolution 60 days from the date of adoption.
