PRESENT: Directors: Carrillo, Coats, Goodrich, Morales, Smith ABSENT: None STAFF: John Mura, General Manager/CEO; Brian Tompkins, Chief Financial Officer; Jeff Noelte, Director of Engineering and Operations; Kelly Malloy, Director of Strategic Services; Justine Hendricksen, District Clerk; Shayla Antrim, Sr. Administrative Assistant LEGAL COUNSEL: Jean Cihigoyenetche GUEST(s): Members of the public PUBLIC COMMENTS Chairman Smith declared the public participation section of the meeting open at 5:32 p.m. There being no written or verbal comments, the public participation section was closed. APPROVAL OF AGENDA M/S/C (Carrillo-Goodrich) by unanimous roll call vote that the May 27, 2020 agenda be approved as submitted. APPROVE THE FINANCIAL STATEMENTS FOR APRIL 2020 M/S/C (Morales-Goodrich) by unanimous roll call vote that the Board approve the financial statements for April 2020 as submitted. DISBURSEMENTS M/S/C (Morales-Goodrich) by unanimous roll call vote that the General Fund Disbursements #255991 through #256138 which were distributed during the period of April 1, 2020 through April 30, 2020, bank drafts, and ACH Payments in the amount of 2 Minutes 5/27/2020 sma $6,794,115.65 and $346,335.80 for payroll and benefit contributions, totaling $7,140,451.45 be approved. EXTENSION OF THE MEMORANDUM OF UNDERSTANDING BETWEEN THE EAST VALLEY WATER DISTRICT AND THE EAST VALLEY WATER DISTRICT EMPLOYEE PARTNERSHIP M/S/C (Morales-Goodrich) by unanimous roll call vote that the Board approve to extend the Memorandum of Understanding and accept the Side Letter of Agreement between the East Valley Water District and the East Valley Water District Employee Partnership as submitted. ADOPT RESOLUTION 2020.16 PLANT 39-1 WATER RESERVOIR REHABILITATION NOTICE OF COMPLETION The Director of Engineering and Operations provided a presentation of work performed at Plant 39, Reservoir number 1. He stated that the work was completed May 8, 2020 and a dive inspection will be performed in 11 months to identify any warranty issues with the work. He also provided information regarding the District’s Reservoir Rehabilitation Program. M/S/C (Coats-Goodrich) by unanimous roll call vote that the Board adopt Resolution 2020.16 as submitted. BOARD OF DIRECTORS’ REPORTS Director Carrillo reported on the following: May 21 he attended the North Fork Water Company Annual meeting; and May 27 he participated in an Inland Action Group meeting where Assemblymember Ramos was in attendance and provided an update on legislation and COVID-19. Director Morales reported on the following: May 14 he participated in an Association of California Water Agencies Region 9 meeting where they discussed water legislation; and May 26 he participated in the San Bernardino Board of Water Commissioners meeting where they presented their budget. Director Coats reported on the following: May 19 he participated in the San Bernardino Valley Municipal Water District Board meeting; May 21 he participated in a conference call with the General Manager/CEO where he received District updates; and May 21 he attended the North Fork Water Company Annual meeting. Vice Chairman Goodrich reported on the following: May 21 he attended the North Fork Water Company Annual meeting; May 21 he met with the General Manager/CEO to review the agenda; and May 22 he attended the Legislative and Public Outreach Committee meeting. Chairman Smith reported on the following: May 21 he attended the North Fork Water Company Annual meeting; May 21 he met with the General Manager/CEO to review the agenda; May 22 he attended the Legislative and Public Outreach Committee meeting; 3 Minutes 5/27/2020 sma and May 27 he participated in the San Bernardino Valley Water Conservation District Board meeting. GENERAL MANAGER/CEO REPORT The General Manager/CEO reported on the following: • May 28th he will be participating in the Inland Empire Economic Partnership State of the Region “Road to Recovery” teleconference meeting. • As construction progresses on the Sterling Natural Resource Center, sewer pipeline installation work on Del Rosa Drive has started. During this work, crews will install 6,000 linear feet of new sewer line that will directly tie into the Sterling Natural Resource Center. Construction will require the closure of Del Rosa Drive from 5th Street to Baseline starting May through October 2020. • He provided an update on the progress on the Administration building at the SNRC construction site. He stated that the foundation for the Administration center has been laid and that there will be a great deal of activity over the next few months. Upcoming Teleconference Meetings: • Tuesday, June 9 @ 3:30pm – Finance & Human Resource Committee meeting • Thursday, June 11 @ 2:00pm – Legislative & Public Outreach Committee meeting. LEGAL COUNSEL REPORT No report at this time. BOARD OF DIRECTORS’ COMMENTS Director Morales stated that he appreciates the Sterling Natural Resource Center updates on the District’s social media campaign. Director Coats stated that he is pleased that District employees voted unanimously to extend the current Memorandum of Understanding during the temporary emergency; and that it shows their commitment to ratepayers. Vice Chairman Goodrich stated that he looks forward to the rehabilitation of Plant 108 next year. Information only. ATTAC H M E NTS: Description Type Resolution 202 0.19 Cover M emo List of Delinquent Wate r and Wastewater Accounts 20 20- 21 Cover M emo East Valley Water District Resolution 2020.19 Page 1 of 2 RESOLUTION 2020.19 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE EAST VALLEY WATER DISTRICT, SAN BERNARDINO COUNTY, STATE OF CALIFORNIA, ADDING DELINQUENT NON-PAID CHARGES TO ANNUAL TAXES LEVIED UPON THE PROPERTY FOR WHICH THE CHARGES ARE DELINQUENT AND UNPAID WHEREAS, the Board of Directors of the East Valley Water District (the “District”) has prepared a report and statement of those delinquent non-paid charges for water and other services within the District which were delinquent and unpaid for sixty days or more on July 1, 2020; and WHEREAS, the Board of Directors of the District has decided that said delinquent and unpaid charges are to be included in the property tax levied on said property pursuant to California Water Code Sections 31701 (e) and 31701.5 et seq.; and THEREFORE, the Board of Directors of the District does hereby resolve, determine and order as follows: Section 1. That the report of the District’s delinquent and unpaid charges for water and other services within the District which remain unpaid and delinquent for sixty days or more on July 1, 2020 is hereby adopted and approved by said Board. Section 2. That the unpaid and delinquent charges listed in said report for each parcel of property are fixed at the amount listed in said report. Section 3. That the Secretary shall file with the County Auditor of the County of San Bernardino and the Board of Supervisors of the County of San Bernardino, in the time and manner specified by the County Auditor and Board of Supervisors, a copy of such written report with a statement endorsed hereon over the signature of the Secretary, that such a report has been finally adopted and approved by the Board of Directors, and that the County Auditor shall enter the amount of such charges against the respective lots of parcels of land as they appear on the current assessment roll. Section 4. That the County Tax Collector shall include the amount of charges on bills for taxes levied against their respective lots and parcels of land and, therefore, the amount of such unpaid and delinquent charges shall be collected at the same time and in the same manner by the same person as, together with and not separately from, the general taxes, if any, for the District or the County of San Bernardino and shall be delinquent at the same time, and thereafter be subject to the same delinquency penalties. Ensuring healthy and safe working conditions and the health and safety of employees is a business necessity for the District. Compliance The East Valley Water District intends to fully and faithfully comply with any and all applicable federal, state, and local regulations and guidance regarding cleaning and disinfecting worksites in the administration of this Policy and associated protocol. Scope This policy will apply with equal force to all properties and facilities over which the East Valley Water District has custody and control, including both indoor and outdoor areas. Effective Date: This Policy shall be effective immediately upon adoption and shall remain in effect until the Board of Directors advises employees that the Policy is no longer operative due to the end of the present public health emergency. Policy Cleaning Practices for Outdoor Areas: The virus that causes COVID-19 naturally dies within hours to days in typical indoor and outdoor environments. Warmer temperatures and exposure to sunlight reduces the time the virus survives on surfaces and objects. Outdoor areas generally require normal routine cleaning and do not require disinfection. (a) East Valley Water District’s Responsibilities: The East Valley Water District will maintain existing cleaning and hygiene practices of outdoor areas. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Cleaning and Disinfecting the Workplace Original Approval Date: Last Revised: Policy No: Page 2 of 6      (b) Employee Responsibilities: In addition to the efforts undertaken by East Valley Water District, employees are expected to comply will directives issued in the East Valley Water District’s Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace, to the extent applicable to outdoor spaces, as well as the provisions in this Policy regarding collective efforts to routinely disinfect frequently used surfaces and objects. Cleaning and Disinfecting Practices for Indoor Areas that have been occupied within the last Seven Days: (a) East Valley Water District’s Responsibilities: The East Valley Water District will evaluate each building or facility to determine what kinds of surfaces make up each area. Most surfaces and objects will require only routine cleaning consistent with the East Valley Water District’s current practices. Such routine cleaning involves cleaning the surface or object with soap and water. Additionally, each workday, the East Valley Water District will clean and disinfect frequently touched surfaces and objects, including but not limited to light switches and doorknobs, to further reduce the risk of germs on those surfaces and objects. Disinfecting will be conducted using an EPA-approved disinfectant, when available. If an EPA-approved disinfectant is unavailable, alternative disinfectants will be used consistent with CDC guidelines. The East Valley Water District prohibits the mixing of bleach and other cleaning and disinfection products together, as this can cause fumes that may be dangerous when inhaled. The East Valley Water District requires that the use of any cleaning and disinfectant products adhere to the instructions from each product’s manufacturer related to concentration, application method, contact time, etc. (b) Employee Responsibilities: In addition to the efforts undertaken by East Valley Water District, employees are expected to comply with directives issued in the East Valley Water District’s Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace, as well as the provisions in this Policy regarding collective efforts to routinely disinfect frequently used surfaces and objects. Collective Effort to Routinely Disinfect Frequently Used Surfaces and Objects: The CDC has called upon every American to implement behavior to slow the spread of the virus that causes COVID-19. Everyone has a role in making sure our communities are as safe as possible to reopen and remain open. The East Valley Water District takes this responsibility extremely seriously. (a) East Valley Water District’s Responsibilities: The East Valley Water District will ensure that surfaces and objects within its buildings and facilities are cleaned and disinfected each workday to maintain safe and healthy working conditions for all workers and members of the public. (b) Employee Responsibilities: In addition to the efforts undertaken by East Valley Water District, every East Valley Water District employee across all departments has an individual responsibility to contribute to this effort by routinely disinfecting surfaces and objects with which that employee interacts. This includes mandatory compliance with the East Valley Water District Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace. The East Valley Water District will provide effective disinfectants, such as disposable wipes, throughout its buildings and facilities to be used to disinfect these items to assist employees in meeting their individual responsibilities. Employees are expected to utilize these disinfectants to regularly wipe down commonly used surfaces and objects. A list of examples of such commonly used surfaces and objects is provided below. Cleaning and Disinfecting Frequently Used Hard and Non-Porous Items: (a) East Valley Water District’s Responsibilities: Each workday, the East Valley Water District will have all frequently used hard and non-porous surfaces or objects, such as glass, metal, or plastic, cleaned and then EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Cleaning and Disinfecting the Workplace Original Approval Date: Last Revised: Policy No: Page 4 of 6      disinfected with an appropriate disinfectant. Examples of frequently used surfaces or objects that shall receive routine disinfection include, but are not limited to:  Tables  Doorknobs  Light switches  Countertops  Handles  Desks  Phones  Keyboards  Toilets  Faucets and sinks  Touch screens  Customer kiosks  Copiers  Printers  Books/binders  Refrigerators  Microwaves  Coffee makers  File cabinets and shelves  Shared computers  Shared tools/equipment  Handrails (b) Employee Responsibilities: In addition to the efforts undertaken by East Valley Water District, employees are expected to routinely disinfect surfaces and objects that they interact with. Employees should utilize effective disinfectants, such as disposable wipes, provided by the East Valley Water District to disinfect the surfaces and objects they come in contact with that may be touched by other employees or members of the public. These surfaces and objects include, but are not limited to, the list of examples provided above. Cleaning and Disinfecting Practices Related to East Valley Water District Vehicles: (a) East Valley Water Districts Responsibilities: The East Valley Water District will provide hand sanitizer and effective disinfectant, such as disposable wipes, in each East Valley Water District vehicle. The East Valley Water District will maintain its practice of routinely cleaning East Valley Water District vehicles. (b) Employee Responsibilities: In addition to the efforts undertaken by East Valley Water District employees must disinfect frequently touched surfaces and objects within an East Valley Water District vehicle before and after use of a East Valley Water District vehicle, if that vehicle is shared, or at the beginning and end EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Cleaning and Disinfecting the Workplace Original Approval Date: Last Revised: Policy No: Page 5 of 6      of each shift, if no one else uses the vehicle during the employee’s shift. These surfaces and objects include, but are not limited to, door handles, seatbelts, seats, steering wheels, and window buttons. Air Filter and HVAC Cleaning: The District will ensure that air filters and HVAC systems are properly maintained. Providing of Personal Protective Equipment (“PPE”) for Workers Assigned to Clean or Disinfect the Workplace: (a) East Valley Water District Requirements Applicable to East Valley Water District Employees Assigned Whose Job Duties Require Them to Clean or Disinfect East Valley Water District Buildings or Facilities: East Valley Water District employees must wear appropriate PPE throughout the cleaning/disinfecting process, including the handling of trash. The East Valley Water District will provide the necessary and appropriate PPE at no cost to any East Valley Water District employee whose job duties require them to clean or disinfect its buildings or facilities, as set forth in Occupational Safety and Health Administration (“OSHA”) regulations. (See 29 C.F.R. § 1910.132 (h).) This provision does not apply to East Valley Water District employees that contribute to cleaning and disinfecting efforts in an isolated fashion, such as wiping down a doorknob or desk after its use. Appropriate PPE includes disposable gloves and gowns that are compatible with the disinfectant products being used. The East Valley Water District may require that employees whose job duties require them to clean and disinfect its buildings or facilities wear additional PPE, such as goggles or face shields, based on the cleaning/disinfectant products being used and whether a risk of splashing reasonably exists. If disposable gowns are unavailable, employees whose job duties require them to clean and disinfect its buildings or facilities must wear a similar type of covering, such as coveralls, aprons, or work uniforms. Any reusable (washable) clothing worn during the cleaning/disinfecting process must be laundered afterwards. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Cleaning and Disinfecting the Workplace Original Approval Date: Last Revised: Policy No: Page 6 of 6      Proper Use of PPE and Training Related to PPE East Valley Water District employees utilizing PPE must carefully remove gloves and gowns at the end of the cleaning/disinfecting process to avoid contamination of the wearer and surrounding area. After the removal of gloves, employees must wash their hands thoroughly with soap and water. The East Valley Water District will ensure that any employees utilizing PPE as described in this section are trained on when to use PPE, what PPE is necessary, how to properly don (put on), use, and doff (take off) PPE, how to maintain and dispose of PPE, and the limitations of PPE. The East Valley Water District will also ensure that any employees utilizing PPE as described in this section are trained on proper eye and face protection, hand protection, and respiratory protection. (b) East Valley Water District Requirements Applicable to Employees of Third-Party Companies Assigned to Clean or Disinfect East Valley Water District Buildings or Facilities: The foregoing provisions in subsection (a) regarding PPE apply with equal force to employees of third party companies who are responsible for cleaning East Valley Water District facilities and worksites, except that the East Valley Water District will not provide PPE to employees or third party companies or provide training to such employees. The East Valley Water District will communicate to the third-party company its expectations regarding the use of PPE by their employees when cleaning East Valley Water District facilities and worksites. Non-Compliance Violations of this policy may result in disciplinary action up to and including termination. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace Original Approval Date: Last Revised: Policy No: Page 1 of 6      Purpose The purpose of this policy is to ensure the health and safety of working conditions for all East Valley Water District employees through adherence to social distancing and cleaning and disinfecting principles and best practices. Ensuring healthy and safe working conditions and the health and safety of employees is a business necessity for the East Valley Water District. Compliance The East Valley Water District will fully and faithfully comply with any and all applicable laws, including, but not limited to, the Americans with Disabilities Act (“ADA”), the Rehabilitation Act of 1973, the Fair Employment and Housing Act (“FEHA”), and the California Confidentiality of Medical Information Act (“CMIA”) in the administration of this policy and associated protocol. Scope This policy will apply with equal force to all East Valley Water District employees as preventing the transmission of the virus that causes COVID-19 in the workplace and is reasonably related to all East Valley Water District jobs. Effective Date: This policy shall be effective immediately upon adoption and shall remain in effect until the Board of Directors advises employees that the policy is no longer operative due to the end of the present public health emergency. Policy Reduction of In-Person Employee Headcount at Any Given Time: To reduce the spread of the virus that causes COVID-19, the General Manager/CEO is authorized to allow, encourage, or require remote work as appropriate for any given employee or class of employees at any given time. Employees may be required, for example, to work remotely one day and report to the workplace the next. The General Manager/CEO is further authorized to implement flexible, or staggered work hours, including staggered breaks, as needed. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace Original Approval Date: Last Revised: Policy No: Page 2 of 6      Minimum Spacing of Six Feet: Employees and members of the public entering and using East Valley Water District facilities must maintain a minimum physical distance of six feet between themselves and any other person at all times. While on duty at any East Valley Water District facility, employees must also minimize exposure to and contact with others. To the extent that existing arrangements of workstations or furniture do not provide for adequate spacing, they must be rearranged to provide for such spacing. If furniture cannot be rearranged to allow for adequate spacing, seats or desks that would encroach on the six-foot distance must be clearly marked as prohibited for use. Entry to any East Valley Water District facility must be limited to a number of people that can easily maintain, at all times, a minimum six-foot physical distance from others, except as necessary to complete the business for which the person is at the facility. Where employees and members of the public form lines for products or services, such as at the customer service counter, appropriate markings must be placed at 6-foot intervals to indicate where employees and/or members of the public should stand while waiting in order to provide adequate spacing. Persons who are family members or household contacts, may stand or move together, but must be separated from others by a physical distance of at least six feet. Break Room The Break Room will be restricted to no more than 5 people at any given time and those 5 must maintain social distancing, i.e., no gathering around the island, sitting across from each other, etc. Adjustment of tables and chairs will be made in compliance with this policy. Signs will be posted with the 5-person restriction and will include reminders to wipe down all areas touched. Wellness Center (Gym) The District understands that physical activity promotes mental health and well- being as well as boosts the immune system to help keep you healthy. With that in mind, the Wellness Center will be available to staff, however, it will be restricted to no more than 2 people utilizing at a time. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace Original Approval Date: Last Revised: Policy No: Page 3 of 6      Those utilizing must sign in on the sign-in sheet and be sure to sanitize all equipment and surfaces they have come in contact with. Signs will be posted with the 2-person restriction and will include reminders to sanitize before exiting. Physically Distanced Meetings Only When Necessary: Where feasible, in-person meetings must be replaced with other means of communication, including but not limited to telephone calls, e-mails, or videoconferences. Non-essential meetings should be canceled or postponed. Staff meetings normally held in meeting rooms or shop settings should take place outside when physical distancing is not practicable in the usual space. If an in-person meeting is held, it must take place in a conference room or other space that allows the participants sufficient space to maintain the minimum spacing of six feet. After a conference room is used for a meeting, the conference room must be cleaned and disinfected in accordance with the East Valley Water District ’s Cleaning and Disinfecting Policy before it can be used again. This includes, but it is not limited to, requiring that all employees who attended the in-person meeting clean and disinfect the space they occupied during the meeting (e.g., their chair, area of the conference table at which they sat) using East Valley Water District provided sanitizing supplies. Social Visits to be Avoided: Employees should refrain from congregating in confined spaces, such as lunch or break rooms. If socializing cannot be avoided, employees must observe the requirement that they maintain a minimum physical distance of six feet between themselves and any other person at all times. Employees are prohibited from permitting social visitors (visitors who are not on official business) into any non-public areas of any East Valley Water District facility. When and where such social visits do occur, employees must maintain the minimum spacing of six feet at all times. Employees may socialize with visitors who are not on official business outside the workplace (e.g., an employee may go to lunch with their spouse off-site.) EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace Original Approval Date: Last Revised: Policy No: Page 4 of 6      Wearing of Facial Coverings: Members of the public who enter an East Valley Water District facility must wear a face covering during their time in the facility. Employees working at an East Valley Water District worksite must use cloth face coverings when working in open or shared workspaces. A “cloth face covering” is a material that covers the nose and mouth. It may be secured to the head with ties or straps or simply wrapped around the lower face. It may be made of a variety of materials, such as cotton, silk, or linen. Acceptable cloth face covering options include, but are not limited to: • Bandana • Neck gaiter • Homemade face covering • Scarf • Tightly woven fabric, such as cotton t-shirts and some types of towels. A cloth face covering that no longer covers the nose or mouth; has stretched out or damaged ties or straps; cannot remain securely attached to a person’s face; has holes or tears in the fabric; and/or obstructs an employee’s vision do not comply with this policy. An employee or member of the public must immediately replace their face covering under these circumstances or leave the facility. Hand Washing: Employees are expected to wash their hands (for a minimum of 20 seconds), or use hand sanitizer when a sink is not available, every 60 minutes, and after any of the following activities: using the restroom, sneezing, touching the face, blowing the nose, cleaning, sweeping, mopping, smoking, eating, drinking, entering or leaving the facility, going on break, and before and after their work shift. Provision and Use of Sanitizing Supplies: Hand sanitizer (at least 60% ethanol or 70% isopropanol), soap and water, or effective disinfectant must be made available near the entrance of any East Valley Water District facility and in other appropriate areas for use by the public and employees, and in locations where there is high-frequency employee interaction with members of the public (e.g., cashiers.) Effective disinfectants, such as disposable wipes, should be provided so that commonly used surfaces (e.g., doorknobs, keyboards, remote EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Social Distancing and Individual Responsibility in the Workplace Original Approval Date: Last Revised: Policy No: Page 5 of 6      controls, desks, staplers, copiers, other work tools and equipment) can be wiped down by employees before each use. It is each employee’s responsibility to use these wipes and other supplies to sanitize every surface they touch after each use, except those in an employee’s own private office space, including but not limited to doorknobs, tables, desk and counter tops, chairs, copiers, printers, books/binders, refrigerators, microwaves, file cabinets and shelves, shared computers, phones, tools, and other equipment. It is further each employee’s responsibility to similarly sanitize their own office at the end of their work day or before that space is shared or used by any other person (e.g., an employee must wipe down all surfaces in his or her office before allowing another person to enter for a meeting). East Valley Water District Vehicles: Wherever feasible, East Valley Water District vehicles should be occupied by only one person. If two employees are required for a task in the field, they should ride in separate vehicles. If sharing a vehicle cannot be avoided, employees should wear their face coverings while in the vehicle. East Valley Water District vehicle door handles, seatbelts, seats, and steering wheels must be sanitized before each use of the vehicle. A bottle of sanitizer and cleaning supplies must be placed in each East Valley Water District vehicle and replaced or refilled when empty. Remote Public Access to Meetings Members of the public wishing to attend open session meetings of the Board of Directors may do so remotely. Information regarding how to attend remotely will be posted on the East Valley Water District website. Required Posting and Distribution: Signs must be placed at conspicuous places at all public entrances that instruct members of the public not to enter if they are experiencing symptoms associated with COVID-19 (e.g., cough, shortness of breath or difficulty breathing, and/or more of the following: fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell, or any other symptom associated with COVID-19 identified by the CDC), The signs must also instruct persons who are not experiencing these symptoms and who can enter the facility that they are to wear face coverings and maintain six feet of distance between themselves and others while inside. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Testing District Employees for COVID-19 Original Approval Date: Last Revised: Policy No: Page 1 of 3      Purpose The purpose of this policy is to ensure the health and safety of working conditions for all East Valley Water District employees through the administration of COVID-19 testing. Ensuring healthy and safe working conditions and the health and safety of employees is a business necessity for the District. Authority Pursuant to Labor Code section 6300, et seq. and any applicable state or local public health orders, and consistent with the Equal Employment and Opportunity Commission’s April 23, 2020 Guidance and any guidance that the Department of Fair Employment and Housing may provide and any applicable state or local public health orders], the East Valley Water District is authorized to adopt this COVID-19 testing policy. Compliance The East Valley Water District will fully and faithfully comply with any and all applicable laws, including, but not limited to, the ADA and Rehabilitation Act, the Fair Employment and Housing Act (FEHA”) and the California Medical Information Act (“CMIA”) in the administration of this policy and associated protocol. Scope This policy will apply with equal force to all East Valley Water District employees as testing for the virus that causes COVID-19 and preventing the transmission of the virus that causes COVID-19 in the workplace is reasonably related to all East Valley Water District jobs. On a case-by-case basis, the General Manager/CEO is authorized to determine that this policy will not apply to an employee if it is determined that testing such employee is not job related or consistent with business necessity. Testing may not be job related or consistent with business necessity for a particular employee if his or her job responsibilities do not result in contact with or proximity to other people, including other employees or members of the public. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Testing District Employees for COVID-19 Original Approval Date: Last Revised: Policy No: Page 2 of 3      Effective Dates: This Policy shall be effective immediately upon adoption and shall remain in effect until the Board of Directors advises employees that the Policy is no longer operative due to the end of the present public health emergency. Policy Acknowledgement of Agreement to Submit to Testing: The East Valley Water District may require that employees acknowledge receipt of the notice and execute an agreement submitting to testing for the virus that causes COVID-19. Such agreement will include a CMIA authorization for release of the test results to the District. Refusal to Submit to Testing: The East Valley Water District will place any employee who refuses to submit to testing in accordance with the testing protocol associated with this policy on unpaid leave. The employee may then elect to use any earned or accrued leave to which they are entitled in order to provide compensation during the time away from work. Notification of Test Results: The East Valley Water District or Occupational Clinic will notify the employee of test results in a confidential manner. In the event of a positive COVID-19 test result, the East Valley Water District or Occupational Clinic will also inform the employee by phone call so that the employee may consult with their health care provider and take precautionary measures to prevent transmission of the virus. Test Results and Any Other Health or Medical Records: The East Valley Water District will store test results (if received) and any other health or medical records, in a manner consistent with applicable law and in accordance with the East Valley Water District’s practice for storing medical information in a file separate from the employee’s personnel file. Effect of Positive COVID-19 Diagnosis: In the event that an East Valley Water District employee tests positive for the virus that causes COVID-19, and the testing site informs East Valley Water District, the EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Testing District Employees for COVID-19 Original Approval Date: Last Revised: Policy No: Page 3 of 3 District will, as provided above, notify the employee of the test results. If the employee receives the positives results directly, the employee must immediately notify Human Resources. After notification of the positive result, the East Valley Water District will instruct the employee not to return to work until such time as Both of the following occur: (1) The employee’s health care provider advises the employee that it is safe for them to return to work and has provided the employee with a note certifying this, which the employee provides to the District; AND (2) The employee must re-test to determine they are no longer contagious. This will be done by completing one test and the results must be negative and presented to Human Resources along with the health care provider certification note. Leave Status of Employee with Positive COVID-19 Diagnosis: The East Valley Water District will place any employee who tests positive for the virus that causes COVID-19 on paid COVID-19 leave status for up to four weeks. If the employee remains unable to return to work after four weeks, the employee may elect paid sick leave if they have a balance of such leave, may elect to use another form of other earned or accrued leave, or may take such leave on an unpaid basis. Reservation of Right to Require Additional or Subsequent Testing: The East Valley Water District expressly reserves the right to require that employees submit to additional or subsequent tests in order to ensure healthy and safe working conditions for all employees. Non-Compliance Violations of this policy may result in disciplinary action up to and including termination. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Screening for Symptoms Associated with COVID-19 Original Approval Date: Last Revised: Policy No: Page 1 of 3      Purpose The purpose of this policy is to prevent any individual who certifies that they have presented a symptom associated with COVID-19 from entering a District facility or worksite in order to ensure the safety and health of District workplaces. Authority Pursuant to Labor Code section 6300, et seq., and consistent with guidance provided by the Equal Employment and Opportunity Commission (“EEOC”) and the Department of Fair Employment and Housing (“DFEH”), the District is authorized to adopt this COVID-19 screening policy in order to ensure that individuals who present symptoms associated with COVID-19 do not enter District facilities or worksites and to provide a healthy and safe workplace for District employees who use such facilities and worksites. Compliance The District intends to fully and faithfully comply with any and all applicable laws, including, but not limited to, the Americans with Disabilities Act (“ADA”) and the Rehabilitation Act of 1973, and the Fair Employment and Housing Act (“FEHA”) in the administration of this policy and associated protocol. Scope This policy and its requirements apply with equal force and effect to all District employees in order to enter a District facility or worksite. No employee will be exempted from the requirements set forth in this policy. Effective Dates: This Policy shall be effective immediately upon adoption and shall remain in effect until the Board of Directors advises employees that the Policy is no longer operative due to the end of the present public health emergency. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Screening for Symptoms Associated with COVID-19 Original Approval Date: Last Revised: Policy No: Page 2 of 3      Notice to Employees: The District will provide notice of this mandatory policy and its protocols to all District employees. The District will provide employees a copy of this policy for employees to read and review. Employees who do not receive or review such notice and the attached policy will not be excused from the policy’s requirements. The District will make a reasonable effort to notify every District employee who regularly works at a District facility or worksite of the designated location(s) where symptom screenings will be administered. Expectations of District Employees with Respect to the Presentation of Symptoms Associated with COVID-19: The District expects and requires that all employees who present a symptom associated with COVID-19 to immediately inform either their supervisor or Human Resources. No employee who presents a symptom associated with COVID-19 prior to the start of the workday may report to work. Employees who develop symptoms after beginning their workday and after informing their supervisor or Human Resources will be directed to leave work. Any employee who fails to inform their supervisor or Human Resources that they present a symptom associated with COVID-19 or who attempts to or does report to work despite the presentation of such a symptom or symptoms may face disciplinary action by the District, up to and including termination. Procedure for Symptom Screening: In accordance with the above referenced federal and state public health guidance, and in order to help prevent or reduce the transmission of the virus that causes COVID-19 between and among employees, District will implement the following protocols. Submission to Symptom Screening as a Precondition to Entrance to any District Facility or Worksite: Prior to being allowed to enter and as a precondition to such entrance to any District facility or worksite, District employees shall be required to attest to the absence of any presentation of symptoms associated with COVID-19. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for Screening for Symptoms Associated with COVID-19 Original Approval Date: Last Revised: Policy No: Page 3 of 3      At the time of policy adoption, East Valley Water District will not require temperature testing of employees. The District does, however, at any given time, have the authority to implement as a safety precaution or to comply with state and local mandates. The District will treat an employee refusing to submit to symptom screening prior to or during their scheduled workday as an unexcused absence. Protocol for Symptom Screening: The District will require each employee to certify to the fact that they do not currently present any symptom associated with COVID-19. The District will provide each employee with a Daily Wellness Questionnaire by text, email, or other acceptable means of communication. The Questionnaire will ask a series of questions to determine if employees are experiencing symptoms associated with COVID-19 or have an increased risk of exposure to COVID-19. Employees that indicate that they are experiencing any of the indicated risk factors will be directed to contact Human Resources and refrain from reporting to work. In the event that an employee indicates that they currently present any symptom associated with COVID-19 or cannot certify that they do not present any such symptom, the District will deny that individual access to the District facility or worksite until the individual is able to certify that they do not currently present any symptom associated with COVID-19. This policy shall supplement any of the other policies, protocols or guidelines that the District has adopted in order to prevent or reduce the likelihood of transmission of the virus that causes COVID-19 among and between employees. Non-Compliance Violations of this policy may result in disciplinary action up to and including termination. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for the Use and Disclosure of Confidential Medical Information Related to COVID-19 Original Approval Date: Last Revised: Policy No: Page 1 of 5      Purpose The purpose of this policy is to safeguard Medical Information in a manner compliant with the Confidentiality of Medical Information Act (“CMIA”) and the Americans with Disabilities Act (“ADA”) with respect to all Medical Information that the East Valley Water District acquires during the administration of these policies, or obtains by other means. The East Valley Water District recognizes the importance of confidentiality concerning the information at issue and will fully and faithfully comply with CMIA in its use and disclosure of such information. Authority The East Valley Water District is authorized to conduct the [COVID-19 testing and/or temperature testing and COVID-19 symptom screening and/or an accommodation policy for high-risk employees under the authority provided for under those policies. Compliance The East Valley Water District will fully and faithfully comply with the CMIA and ADA in the implementation and administration of this policy as well as the associated COVID-19 testing policy and/or COVID-19 symptom screening policy and/or an accommodation policy for high-risk employees policies. Policy This policy covers all Individually Identifiable Medical Information of all East Valley Water District employees and applicants that the East Valley Water District acquires or obtains and which relates to COVID-19, including, but not limited to, symptoms associated with COVID-19, positive COVID-19 test results, and other health or medical conditions that would place the employee at high-risk for a serious illness if the employee contracted COVID-19. Specifically, this policy covers the following types of Medical Information:  All Medical Information acquired by East Valley Water District during or as a result of the administration of the District’s COVID-19 testing policy and/or a temperature testing and COVID-19 symptom screening policy and/or an accommodation policy for high-risk employees. For example, the policy covers COVID-19 test results, temperature test results, the results of screenings for EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for the Use and Disclosure of Confidential Medical Information Related to COVID-19 Original Approval Date: Last Revised: Policy No: Page 2 of 5      symptoms associated with COVID-19, and information regarding other medical conditions.  All Medical Information that the East Valley Water District obtains by means other than by testing administered by the District. For example, the County Public Health Department may inform the East Valley Water District that an East Valley Water District employee has tested positive or an East Valley Water District employee may voluntarily disclose a positive COVID-19 diagnosis not as the result of a test administered by the District.  All Medical Information related to COVID-19 that the East Valley Water District acquires or obtains, including, but not limited to, information about an employee’s health or medical conditions that may put the employee at increased risk of serious illness should the employee contract COVID-19 as provided under the District’s accommodation policy for high-risk employees. Effective Dates: This policy shall be effective immediately upon adoption and shall remain in effect as long as necessary to safeguard Medical Information acquired or obtained by the East Valley Water District employees and as otherwise required by law. Notice of Privacy Practices: The East Valley Water District will provide a Notice of Privacy Practices to employees to explain their rights under this policy. Employee Authorization to Disclose Medical Information: Permissible disclosures of employee Medical Information without prior written authorization from an employee are limited. Should an employee wish to provide the East Valley Water District authority to make additional disclosures of Medical Information related to COVID-19, the employee or their legal representative may authorize such disclosure using the Authorization for Disclosure and Use of Medical Information (“Authorization”), and completing each of the required fields provided therein. An employee may also authorize the Disclosure and Use of Medical Information in a handwritten document. Such a handwritten Authorization must: EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for the Use and Disclosure of Confidential Medical Information Related to COVID-19 Original Approval Date: Last Revised: Policy No: Page 3 of 5       State the specific uses and limitations on the types of Medical Information to be disclosed.  State the name or function of the East Valley Water District that may disclose the Medical Information.  State the names or functions of the persons or entities authorized to receive the Medical Information.  State the limitations, if any, on the use of the Medical Information by the persons or entities authorized to receive the Medical Information; and  State a specific date after which the East Valley Water District is no longer authorized to disclose the Medical Information. Permissible Uses and Disclosures of Medical Information: Generally, the East Valley Water District may not disclose Medical Information without prior written authorization from an employee. The East Valley Water District may, however, use and disclose an employee’s Medical Information for certain public interest and benefit purposes, including, but not limited to:  If compelled by judicial or administrative process or by any other specific provision of law.  That part of the information which is relevant in a lawsuit, arbitration, grievance, or other claim or challenge to which the East Valley Water District and employee are parties and in which the patient has placed in issue his or her medical history, mental or physical condition, or treatment may be used or disclosed in connection with that proceeding;  For the purpose of administering and maintaining employee benefit plans, including health care plans and plans providing short-term and long-term disability income, workers' compensation and for determining eligibility for paid and unpaid leave from work for medical reasons.  To a provider of health care or other health care professional or facility to aid the diagnosis or treatment of the employee, where the employee or other person authorized by law to permit disclosure of Medical Information on the employee’s behalf, is unable to authorize the disclosure. The uses and disclosures of an employee’s confidential information for these purposes do not require the employee’s authorization. Further, it shall not be a violation of the Policy and Protocols for the East Valley Water District to disclose information that does not contain Individually Identifiable information of an employee. For example, the East Valley Water District may notify EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for the Use and Disclosure of Confidential Medical Information Related to COVID-19 Original Approval Date: Last Revised: Policy No: Page 4 of 5      other employees that an employee has tested positive for COVID-19 so long as the East Valley Water District does not disclose information that would lead others to identify that employee (e.g. their name, work location, position). In such a circumstance, it may be necessary for the East Valley Water District to inform certain persons, such as the individual’s supervisor, janitorial staff, that an employee has tested positive so that East Valley Water District may take appropriate steps to ensure a healthy and safe workplace for all East Valley Water District employees. Disclosures of Medical Information to the Employee: Employees are entitled to access and review their medical file as maintained by the District. The East Valley Water District must disclose the Medical Information contained in the employee’s medical file to the employee when requested. Reasonable Safeguards for Medical Information: The East Valley Water District employs reasonable safeguards in order to protect against and limit the incidental use and disclosure of employee’s Medical Information. The East Valley Water District will store Medical Information in a medical file that is separate and distinct from the employee’s personnel file. East Valley Water District employees follow the following safeguards in order to limit the incidental use and disclosure of Medical Information: 1. Determine who is with an employee before discussing the employee’s Medical Information. 2. Do not assume that an employee will permit disclosure of their Medical Information to a family member or friend. 3. Request that individuals leave the room or vicinity in order to provide the employee an opportunity to object to the disclosure of their Medical Information. 4. Dispose of unnecessary paper products that have protected health information in a shredder. EAST VALLEY WATER DISTRICT Administrative Policies & Programs Policy Title: Administrative Policy and Protocols for the Use and Disclosure of Confidential Medical Information Related to COVID-19 Original Approval Date: Last Revised: Policy No: Page 5 of 5      Limiting the Disclosures of Medical Information: All requests for Medical Information, whether routine or non-routine, are handled by the District’s Department of Human Resources. All East Valley Water District employees must therefore direct all requests for Medical Information to the District’s Department of Human Resources. Policy on Requests to Review and/or Amend Employee Authorization for Disclosure of Medical Information: Employees are entitled to request a true copy of an employee’s authorization for the disclosure of Medical Information. Employees are also entitled to cancel or modify an employee authorization for the disclosure of Medical Information. Employees who wish to cancel or modify an employee authorization must provide written notice to East Valley Water District. Cancellations and modifications of employee authorizations only become effective after East Valley Water District receives written notice of any such action. Policy on Requests to Restrict Use and Disclosure of Medical Information: Employees are entitled to request that the East Valley Water District restrict the use and/or disclosure of protected health information, as outlined in Civil Code Section 56.11(d)-(h). If an employee has authorized disclosure of Medical Information but wishes to restrict such authorization, East Valley Water District shall communicate to the person or entity to which it discloses the Medical Information any limitations in the authorization regarding the use of the Medical Information. Non-Compliance Violations of this policy may result in disciplinary action up to and including termination.
