Dana Brooks, President February 19, 1957 EAST SAN BERNARDINO COUNTY WATER DISTRICT BOARD OF DIRECTORS - REGULAR MEETING FEBRUL, Y 19 1957_ The Board of Directors met at 2:00 P.M., February 19, 1957, at the regular meeting place. Directors present: Botts, Littleton, Wall Present at 3:00 P.M.: Brooks, Taylor Also present: Manager Rickert; Engineer Rowe; Kenneth I. Jones of Kirkbride, Wilson, Harzfeld & Wallace; James Reiter of Daniel, Mann, Mendenhall & Johnson; Y other interested parties; and the Secretary. PRESIDENT PRO TEM Upon motion by Director Littleton, duly seconded by Director Wall, and carried unanimously, Director Botts was chosen President Pro Tem in the absence of President Brooks. MINUTES Upon indication that each member present had read the minutes of the previous meeting and that there were no additions or corrections, the minutes were declared approved. ANNEXATIONS The President announced that this was the time and place for the Board to consider certain annexations to the District. ANNEXATION The Secretary presented the petition of Annexation 1957 -1 together NO. 1957 -1 -with the Affidavit of Publication showing that the publication had been TRACT 110. 2792,made as required by law. LOTS 41 -62 INCL. The President announced that this was the time and place as set by the Notice of Hearing to hear all protests and consider all written objec- tions to the proposed annexation. The Secretary presented her certi- ficate that the petition is signed by a majority in number of the holders of title, or evidence of title,-to a majority in acreage of the land proposed to be annexed. There being no written protest and there ap- pearing no persons to offer written or oral. objections to the proposed annexation, and discussion had and evidence taken relating to the benefits to the District and the territory proposed to be annexed which would result from the annexation, it was moved by Director Littleton, duly seconded by Director Wall, and carried unanimously, that the hearing be closed. ORDINANCE NO. 38 Ordinance No. 38 was presented to the Board._ Upon motion of Director Littleton, duly seconded by Director Wall, and carried unanimously, Ordinance,No. 38, Altering Boundaries of the East San Bernardino County Water District, was passed on roll call vote. The Secretary was directed to post in three public places within the District copies of the above entitled Ordinance. Upon motion of Director Littleton, duly seconded by Director Wall, and carried unanimously, Ordinance No. 40, Altering Boundaries of the East San Bernardino County Water District, was - passed on roll call vote. The Secretary was directeJ to post in three public places within the District copies of the above entitled Ordinance. OPENING OF BIDS, The President stated that now was the time for the opening of bids UNITS I AND II under the Water Improvement Program of Unit No. I and Unit No. II for the installation of water distribution mains and various appurtenant facilities. The Secretary stated that only one bid had been said bid being as follows: Notice of Hearing to hear all protests and consider all written objec- tions to the proposed annexation. The Secretary presented her certi- ficate that the petition is signed by all the holders of title to the land proposed to be annexed. There being no written protest and there appearing no persons to offer written or oral objections to the proposed annexation, and discussion had and evidence taken relating to the benefits to the District and the territory proposed to be annexed which would result from the annexation, it was moved by Director Littleton, duly seconded by Director Wall, and carried unanimously, that the hearing be closed, j ORDINANCE NO. 39 Ordinance No. 39 was presented to the Board. CCUGHLIN & SONS Unit No. I - Completion Date May 1, 1957 - $21 Unit No. II - Completion Date April 12, 1957 - $11 If contractor awarded contract for both units - $31,150.00 It was the decision of the Board that Mr. Coughlin would be notified at a later date as to bid acceptance. Attorney Jones advised the Board that the Notary date of the bond of Unit No. II submitted by L. J. Coughlin & Sonswas incorrect. Upon motion by Director Wall, duly seconded by Director Littleton, and caTri unanimously, the Secretary was instructed to return said bond to Mr. Coughlin for correction. UNITS III, IV Manager Rickert recommended that a special adjourned meeting be held AND V for letting of bids on Units III, IV and V. Upon motion by Director Littleton, duly'seconded by Director Wall, and carried unanimously, it was the decision of the Board that an adjourned meeting be held the first week of March at the regular meeting time and place for the purpose of letting bids on said units. 3:00 P.M.: Director Brooks and Director Taylor arrived.) ESCROW INSTRUC-The Secretary presented amended escrow instructions from Land Title TIONS, BRUCE Company as requested by William F. Bruce. Said amendment contained PROPERTY instructions for the installation of a chain -link fence and the planting of oleander bushes between the Bruce property and the property purchased by the District. Upon motion by Director Littleton, duly seconded by Director Wall, and carried unanimously, the President and Secretary were authorized to sign, on behalf of the District, the amended escrow instructions. ESCROW INSTRUC-Upon motion by Director Littletoni duly seconded by Director Wall, TIONS, VAN CAMP and carried unanimously, the President and Secretary were authorized PROPERTY to sign escrow instructions on behalf of the District for the purchase of the Van Camp property for the construction of Reservoir No. lA. PROGRESS REPORT Manager Rickert reported that the following completion dates for the installation of the three storage tanks had been submitted by the Pittsburgh -Des Moines Steel Company: Reservoir No. 2 - Foothill Drive July 10, 1957 Reservoir No. lA - Sterling and Marshall August 10, 1957 Reservoir No. 3 - Perris Hill September 10, 1957 PRICE ADJUSTMENT Manager Rickert reported that, due to requested changes on the float RESERVOIR NO. 2 control on Reservoir No. 2, that an additional amount of`$439.00 AND RESERVOIR would have to be included in the installation cost of Reservoir No. 2, and NO. 3 due to change in size of tank at Perris Hill, an additional amount10if30.00. Upon motion by Director Littl6ton., duly seconded by Director Wall, and carried unanimously, the Board approved the additional cost of 439.00, and $1,130.00 for Reservoirs No. 2 and No. 3, respectively. RESERVOIR NO. 3 The Secretary read a letter received from W. A. Sidler, County Flood RIFT -OF -WAY Control Engineer, regarding a right -of -way over Flood Control District FLOOD CONTROL properties. Said letter reads, in part, as follows: DISTRICT Please be advised that ore have reviewed this and subject to reserva- tions hereinafter stated will be willing to recommend the granting of the parcel indicated to $ Water District. A document plat of the size and form confoxming to the sample enclosed herewith should be prepared by your engineers covering the parcel re- quested and on linen or paper of type •Clearprint, Dieterich -Post Co. No. 1000H• or equal. Deed Documents, original and three copies, should be prepared with proper legal descriptions and furnished to this office. 116 February 19, 1957 "The Deed should contain a reservation in favor of the San Bernardino County Flood Control District retaining to it the rights of ingress or egress over that portion of the property to be granted not occupied by the tank structure as shown on your plan. It should be further agreed that the Flood Control District by its future excavation opera- tions may excavate to the southerly line of the property to be granted and held free and harmless from any liability arising therefrom as regards subsequent erosion, sloughing, etc, or effects. Upon receipt of the maps and documents hereinbefore mentioned, our office will have necessary appraisals made and recommend granting of the parcel for the appropriate consideration." Engineer Rowe recommended that further negotiation with the Flood Control District should be had, as it was his opinion that the District should request for a 40 -foot set -back in regard to flood control excavation, instead of 25 feet. It was the decision of the Board that Manager Rickert and Engineer Rowe negotiate with the Flood Control District and report to the Board at March 5 meeting. COMPF2 ;TION - Director Botts stated that it was his opinion that the Secretary to the SECRETx= TO Board should be compensated for the additional work now required over BC RD and above the duties of Office Lanager. It was Director Botts' recommendation that the compensation be for Board duties only, and that no change be ride as to classification as the Office Manager. V Upon motion by Diroctor Wall, duly seconded by Director Littleton, and carried unanimously, it was authorized that Myrle G. North be compensated for secretarial duties to the Board of Directors at the rate of 4 80.00 per month, said rate to be retroactive to November 1, 1956. APPLIC':TIOh -Engineer Reiter presented for consideration by the Board of Directors FEDEPnL GR21T -the withdrawal of the District's application for a Federal grant under PUBLIC L41 660 -Public Law 660, for the fiscal year ending June 30, 1957, and also StIERAGE recoi:,unnded that the District make application for the grant for the fiscal year ending 1958. His recounendations were based on the following: 1) That only portions of the work that can be let to construction prior to June 30, 1957, are eligible for consideration under the current fiscal year. The District would, therefore, be required to make aprli- cation next year in order to complete the program. 2) It would not be desirable to sell a small portion of the revenue bonds now and then the c:,ajor portion of the bonds nine months to a year later, the point being that a favorable interest rate probably would not be quoted. Engineer Reiter also stated that the District can make application next fiscal year and that withdrawing the present application would not prejudice this future a_ >plication. Iir. Reiter also stated that there is a possibility that even more money will be available to the State of California next year. Upon motion by Director Brooks, duly seconded by Director Wall, and carried unanimously, the Secretary was order- to sulxuit a let'-er to the State Water Pollution Control Board requesting that the District's application be deferred for this fiscal year, stating the reasons for withdrawal and requesting that the District be infori.re d on future a_plication procedures.
