HomeMy WebLinkAboutMinutes - North Fork Water Company - 05/28/1980NORTH FORK WATER COMPANY BOARD MEETING May 28, 1980 A meeting of the Board of Directors of the North Fork Water Company was held on May 28, 1980, at 7:00 p.m. in the offices of the East San Bernardino County Water District, 1155 Del Rosa Avenue, San Bernardino, California. The meeting was called to order by Arnold Wright. Directors Present: Arnold L. Wright Joseph Rowe Rod Hanway Victor Ray Laird Roddick Harold M. Fones, Secretary It was moved by Rod Hanway, seconded by Victor Ray to approve the Minutes of the Board Meeting of May 8, 1980. President Arnold Wright read a letter he had sent to Mr. Arnott. The letter was placed in our correspondence file. At the present time there has been no personal contact with Mr. Arnott. Laird Roddick inquired as to the legal opinion re East San Bernardino County Water District supplying money to upgrade the North Fork ditch. The question is: "Would such an expenditure be a gift of public funds?" As of the present time, Mr. Farrell has not rendered an opinion. Tract 10195 was discussed, particuarly in that they have approval from the County to discharge drainage water into the North Fork ditch. After much discussion, it was moved by Director Ray, seconded by Director Rowe for Mr. Roddick and Mr. Wright to contact Bear Valley to request that they share the expenses of Surr & Hellyer for the Friday, May 30th meeting. Surf & Hellyer would be used in any event. Approved unanimously. Moved by Director Roddick, seconded by Director Rowe to instruct President Wright, Director Hanway, Secretary Fones or other directors in attendance at the meeting on Friday to reject any drainage into the ditch. Director Hanway left the meeting at this point. There was a brief discussion on the problem with Eugene Lee and it was moved by Director Rowe, seconded by Director Roddick to pay the judgment. Further discussion was had on the disposition of the funds and the stock in this case. As a result Mr. Lee has his money for the stock and the East San Bernardino County Water District has the stock itself, it was moved by Director Ray, seconded by N.o 87 Director Roddick to bring a small claim action against the East San Bernardino County Water District for the amount paid in the judgment. Voted unanimously. It was discussed about water deliveries in city streets. After some discussion, it was moved by Director Ray, seconded by Director Roddick that the secretary send a letter to the City informing them that private owners have ditch rights on Palm Avenue, however, North Fork has no maintenance obligation on Palm Avenue. Furthermore, the North Fork Water Company has a historic right to spill water at the end of their facilities at the corner of Palm and Highland. Motion passed unanimously. Meeting was adjourned at 8:50 p.m. Harold M. Fortes Secretary
