HomeMy WebLinkAboutRes - 1997.65 - Establishing Procedures for the Sale of Surplus Personal PropertyRESOLUTION 1997.65 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE EAST VALLEY WATER DISTRICT ESTABLISHING PROCEDURES FOR THE SALE OF SURPLUS PERSONAL PROPERTY WHERAS, the East Valley Water District (the "District") is a County Water District organized and operated pursuant to Water code Sections 30000 et seq., and the District is not specifically required to dispose of surplus property try any particular procedure; and WHEREAS, there is a need to promote uniformity in the procedures for the sale of surplus personal property owned by the District when the District's Board of Directors determines that such sale shall be conducted internally. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Directors of the East Valley Water District that the District's staff shall observe the: following procedure when the District's Board of Directors determines that sale of surplus personal property shall be handled in-house. 1. The District may dispose of surplus property upon adoption of a re:>olution in accordance with the procedures set forth below. a. Description of the Property. The resolution shall specify that the; property is surplus, and shall contain a description of the property. b. Tvoe of Sale. The property shall be sold by the District through a sale conducted by sealed bids, with the highest bid taking possession of the property. Bids shall not be accepted for less than a specified minimum bici. c. Bidding Procedures. All interested parties may review the property up to the day of the sale. Closed bids shall be submitted to the District. Ttre General Manager will then open and review the bids and determine the highest bidder. d. Payment. Payment for the property is due at the time of sale. Payment shall be made to the East Valley Water District, and shall be in orie of the following forms: 1) cash; 2) cashier's check. RESOLUTION NO. 1997.65 Page 2 e. Removal of Items. The property shall be removed by the purchaser immediately following the sale, unless other arrangements are made with the General Manager. f. Notice of Sale. Notice of the sale shall be given in all specified posting places and in a newspaper of general circulation at least once prior to the sale. g. Date of Sale. The date of the sale shall be determined by the: General Manager. h. Disposal of Remaining_Prooertv. In the event that all of the property is not purchased during the sale, the remaining property may be stored for a second surplus sale through the acceptance of sealed bids, whit a minimum bict stipulated; or may be sold at auction to the highest bidder; or may be deemed to be unwanted surplus and may be given to a nonprofit organization; or m<ay be disposed of in an appropriate disposal or recycling site. 2. This Resolution shall take effect immediately upon its adoption.
