Summary: Existing law imposes various limitations on
emissions of air contaminants for the control of air
pollution from vehicular and nonvehicular sources. Existing
law generally designates the State Air Resources Board as
the state agency with the primary responsibility for the
control of vehicular air pollution, and air pollution
control districts and air quality management districts with
the primary responsibility for the control of air pollution
from all sources other than vehicular sources. This bill
would prohibit air pollution control districts and air
quality management districts from restricting the use of
engines powered by natural gas by a city, county, or special
district, including a water district, to operate water
pumps.

Summary: Existing law requires the Secretary of the
Resources Agency to convene a committee to develop and
submit to the Governor and the Legislature, on or before
December 31, 2008, a Strategic Vision for a Sustainable
Sacramento -San Joaquin Delta with specified components. This
b_:11 would declare the intent of the Legislature to enact
legislation to implement the recommendations in the Final
Delta Vision Strategic Plan issued by the Delta Vision Blue
R'. boon Task Force and the Delta Vision Committee established
pursuant to Executive Order S -17 -06 and Chapter 535 of the
Statutes of 2006.

Summary: Existing law requires the Department of Water
Resources to convene an independent technical panel to
provide information to the department and the Legislature on
new demand management measures, technologies, and
approaches. "Demand management measures" means
those water conservation measures, programs, and incentives
that prevent the waste of water and promote the reasonable
and efficient use and reuse of available supplies. This bill
would require the state to achieve a 20% reduction in urban
per capita water use in California by December 31, 2020.

Summary: Existing law requires a city or county that
determ:ines a project is subject to the California
Environmental Quality Act to identify any public water
system that may supply water for the project and to request
those public water systems to prepare a specified water
st.pply assessment. If no public water system is identified,
the city or county is required to prepare the water supply
assessment. This bill would revise that definition of
project" to provide that specified business,
commercial, hotel or motel, industrial, manufacturing, and
mixed -use developments are within the scope of that
definition only if the projected water demand of the
development would be equivalent to, or greater than, the
amount of water required by a 500 dwelling unit project, as
dE term.ined by the public water system. This bill contains
other .related provisions and other existing laws.

Summary: Under the Natural Heritage Preservation Tax
Credit Act of 2000, property may be contributed to
departments, as defined, any local government, or any
nonprofit organization designated by a local government or
department, based on specified criteria, in order to provide
for the protection of wildlife habitat, open space, and
acricultural lands. The act defines "donee" as a
department within the Resources Agency to which a donor has
applied to donate property, a local government requesting
approval of a donation of property to it, or a designated
nonprofit organization. This bill would expand the
dsfinicion of "donee" to include a local
government that has filed with a donor an application that
wa.s submitted directly to the Wildlife Conservation Board.
Tire bill would make related changes. This bill contains
other related provisions and other existing laws.

Summary: Existing law establishes various programs to
provide financial assistance to public and private entities
to improve their energy efficiency. This bill would state
the intent of the Legislature to enact legislation to
develop an implementation plan for distributing federal
economic stimulus dollars for energy efficiency projects and
programs to help facilitate the state's economic
recovery while making investments in the state's
environment and improving the quality of life of the people
of the state.

Summary: The Subdivision Map Act prohibits approval of
a tentative map, or a parcel map for which a tentative map
was not required, or a development agreement for a
subdivision of property of more than 500 dwelling units,
except as specified, including the design of the subdivision
or the type of improvement, unless the legislative body of a
city or county or the designated advisory agency provides
written verification from the applicable public water system
that a sufficient water supply is available or, in addition,
a specified finding is made by the local agency that
sufficient water supplies are, or will be, available prior
to completion of the project. This bill would require, until
January 1, 2020, the legislative body of a city or county or
the designated advisory agency to approve or disapprove the
subdivide.r's water savings projections attributable to
voluntary demand management measures, as defined, after
being reviewed by the retail water supplier and verified for
accuracy, as specified, by the public water system or the
local agency if there is no public water system. Water
savings projections would be authorized to be calculated
ueing the water savings projections adopted by the
California Urban Water Conservation Council. Water savings
projections for measures for which the California Urban
Water Conservation Council does not have adopted findings
would be required to be based on substantial evidence in the
record and included in the water supply assessment adopted
by the water supplier. If a project applicant proposes to
use a new voluntary water reduction demand management
measure that is not based on water savings projections
adopted by the California Urban Water Conservation Council,
tt.e legislative body of a city or county or the advisory
acency would be required to have the project applicant enter
into an agreement with the water utility to implement and
monitor the actual water savings over time, as specified.
The public water system would be required to prepare a
written report of the projected water demand versus the
actual water use 5 years after the project has been fully
developed. By adding to the duties of the public water
system, this bill would impose a state - mandated local
program. This bill contains other related provisions and
other existing laws.

Summary: Existing law authorizes the legislative body of
any city, defined as a city, county, or city and county, to
determine that it would be convenient and advantageous to
designate an area within which authorized city officials and
free: and willing property owners may enter into contractual
assessments and make arrangements to finance public
improvements to specified lots or parcels or to finance the
installation of distributed generation renewable energy
sources or energy efficiency improvements that are
permanently fixed to real property, as specified. Existing
law requires the legislative body to make these
determinations by adopting a resolution indicating its
intention to do so and requires the resolution to include
certain specified information. This bill would expand these
provisions to authorize the legislative body of any public
agency, as defined, to determine that it would be in the
public interest to designate an area within which authorized
city officials and free and willing property owners may
enter into contractual assessments to finance the
installation of water efficiency improvements that are
permanently fixed to real property, as specified. The bill
would 'also, with respect to all of the provisions relating
to public improvements and the installation of distributed
generation renewable energy sources or energy efficiency
improvements, redefine the term "city" as a
public. agency" to include, every governmental
subdivision, every district, every public and quasi - public
corporation, every public agency and public service
corporation and every town, city, county, and city and
county, and municipal corporation, whether incorporated or
not and whether chartered or not. The bill would similarly
modify the definition of "legislative body" to
also include the governing body of a public agency or any
other public body created by statute. The bill would also
specify that these improvements are not new construction
which would be subject to property taxation. The bill would
declare the intent of the Legislature in this regard. This
bill contains other related provisions.

Summary: The California Bay -Delta Authority Act

Nat:ura_ Resources Agency. The act requires the authority and
the implementing agencies to carry out programs, projects,
and activities necessary to implement the Bay -Delta Program.

Summary: Existing law, known as the California Safe
Dx'i.nking Water Act, requires the State Department of Public
Health to administer provisions relating to the regulation
of drinking water to protect public health, including, but
not: limited to, conducting research, studies, and
demonstration programs relating to the provision of a
dependable, safe supply of drinking water, enforcing the
federal Safe Drinking Water Act, adoption of enforcement
regulations, and conducting studies and investigations to
assess the quality of water in domestic water supplies. This
bill would, in addition, require posting of the notices and
reports on the public water system's Internet Web site,
if the public water system maintains an Internet Web site.
The bill would permit the public water system to remove or
amend the posted information when certain conditions are
met. This bill contains other existing laws.

Summary: Existing law prohibits a municipally owned or
operated public utility (publicly owned utility) furnishing
light, water, power., or heat, or an electrical, gas, heat,
or water corporation, (corporation) from terminating
residential service for nonpayment of a delinquent account
in specified situations, including on the certification of a
licensed physician and surgeon that to do so will be life
threatening to the customer and the customer is financially
unable to pay for service within the normal payment period
and willing to enter into an amortization agreement with the
publicly owned utility or corporation with respect to all
charges that the customer is unable to pay prior to
delinquency. Existing law permits a customer meeting these
requirements to amortize the unpaid balance of a bill over a
pe:r.''_od not exceeding 12 months. This bill would increase the
maxi-mum amortization period to 18 months. This bill contains
other related provisions and other existing laws.

Summary: Existing law, until January 1, 2012, generally
prohibits a person from possessing, importing, shipping, or
transporting in the state, or from placing, planting, or
causing to be placed or planted in any water within the
state, dreissenid mussels, and authorizes the Director of
Fish and Game or his or her designee to engage in various
enforcement activities. Existing law exempts a public or
private agency that operates a water supply system from
those enforcement activities, if the operator of the
facilities has prepared and implemented a prescribed plan to
control or eradicate dreissenid mussels. This bill would
provide that an operator of water delivery and storage
facilities, who has prepared and implemented a plan to
control and eradicate dreissenid mussels in accordance with
tl.e above existing provisions of law, would not be subject
to any civil or criminal liability for the introduction of
dreissenid mussel species as a result of operations of those
facilities. This bill contains other related provisions and
other existing laws.

Summary: Existing law contains various provisions
relating to the bidding process for public works projects.
Exi.sting law prohibits a local public entity, charter city,
or charter county from requiring a bidder to assume
responsibility for the completeness and accuracy of
architectural or engineering plans and specifications on
public works projects, except on clearly designated
design-build projects. This bill would require a local
public entity, charter city, or charter county, before
entering into any contract for a project, to provide full,
complete, and accurate plans and specifications and
estimates of cost, giving such direction as will enable any
competent mechanic or other builder to carry them out. The
bilL would exempt from these provisions any clearly
identified design -build projects or design -build portions
thereof. The bill would specify that a local public entity,
charter city, or charter county would not be required to
provide bidders with plans and specifications for projects
that are completed entirely through an annual contract for
repair, remodeling, or other repetitive work according to
unit prices. This bill contains other related provisions.

Summary: Existing law, with certain exceptions, requires
each person who diverts water after December 31, 1965, to
file with the State Water Resources Control Board a
prescribed statement of diversion and use. Existing law
requires a statement to include specified information,
including, on and after January 1, 2012, monthly records of
water diversions. Under existing law , the monthly record
requirement does not apply to a surface water diversion with
a combined diversion capacity from a natural channel that is
less than 50 cubic feet per second or to diverters using
siphons in the tidal zone. This bill would delete an
except'-on to the statement requirement for diversions
included in the consumptive use data for the delta lowlands
pLblished by the department in its hydrologic data
btlletins. The bill would, commencing January 1, 2011,
impose the monthly record requirement on any surface water
diversion of any size that is within the Sacramento -San
Joaquin Delta, as defined. The bill would also provide that
L2-e monthly record requirement would not apply to surface
diversion that is outside of the Sacramento -San Joaquin
Delta, and that has a combined diversion capacity from a
natural channel that is less than 50 cubic feet per second.

Summary: Under existing law, various measures have been
approved by the voters to provide funds for water
protection, facilities, and programs. This bill would enact
tt.e Safe, Clean, Reliable Drinking Water Supply Act of 2010
which, if approved by the voters, would authorize, for the
pu.rnoses of financing specified water supply reliability and
wager source protection programs, the issuance of bonds in
the amount of $10,035,000,000 pursuant to the State General
Obliga'_ion Bond Law. This bill contains other existing

Summary: The Department of Water Resources operates the

Summary: The Subdivision Map Act establishes a
statewide regulatory framework for controlling the
s.zbdividing of land. The act generally requires a subdivider
to submit, and have approved by the city, county, or city
and ccunty in which the land is situated, a tentative map.
Tae act requires the legislative body of a city or county or
the advisory agency, to the extent that it is authorized by
local ordinance to approve, conditionally approve, or
disapprove the tentative map, to include as a condition in

any tentative map that includes a subdivision a requirement
that a sufficient water supply be available. The act
authorizes the legislative body to request written
verific:at:Lon of sufficient water supply, and, when the
written verification relies on projected water supplies that
are not: currently available to the public water system to
provide: a sufficient water supply to the subdivision,
requires that the written verification as to those projected
water supplies be based on prescribed elements. This bill
would establish a Water Conservation Mitigation Fund to be
aoministered, as specified, by a public water system. A
legislative body of a city or county or the advisory agency,
tc --he extent that it is authorized by local ordinance to
approve, conditionally approve, or disapprove the tentative
map, would be required to include as a condition in any
tentative map that includes a subdivision a requirement that
the subdivision have a sufficient water supply be available
or that: sufficient water supplies will be made available
through a Water Conservation Mitigation Fund held by the
public water system. The amount of funding needed for
voluntary participation by the subdivision applicant in the
Water Conservation Mitigation Fund would be required to be
based on offsetting at least 100 percent of the projected
water demand associated with the subdivision, as determined
by the public water system. The public water system would be
required to expend all funds in the Water Conservation
Mitigation Fund on water conservation measures that will
offset at least 100 percent of the projected demand
associated with the subdivision, as specified. By adding to
the duties of public water system officials, this bill would
inpose a state- mandated local program. This bill contains

Summary: Existing law requires various state agencies
to administer programs relating to water supply, water
quality, and flood management in the Sacramento -San Joaquin
Delta. The Johnston- Baker - Andal- Boatwright Delta Protection
Act. of 1992 creates the Delta Protection Commission and
requires the commission to prepare and adopt a comprehensive
long -germ resource management plan for specified lands
within the Sacramento -San Joaquin Delta. This bill would
enact the Sacramento -San Joaquin River Delta, Clean Drinking
Water, Water Supply Security, and Environmental Improvement
Act of 2009. The bill would establish the Delta Ecosystem
and Water Council. The council would be required to prepare

and adopt a plan referred to as the California Delta
Ecosystem and Water. Plan (plan) to advance the coequal goals
of restoring the Delta ecosystem and creating a more
reliable water supply in California. The council would be
required to establish a goal for the adoption of the plan by
December. 1, 2010. If the plan is not completed by that date,
the council would be required to adopt an interim strategic
plan. ^he plan would be required to include specified
components, including species protection requirements, Delta
water flow and water quality requirements, and information
relating to land use in the Delta. This bill contains other

Summary: The California Constitution provides that
mechanics, persons furnishing materials, artisans, and
la.borecs of every class have a lien upon the property upon
which -hey have bestowed labor or furnished material for the
value of the labor done and material furnished. The
Califo:cnia Constitution also requires the Legislature to
provide, by law, for the speedy and efficient enforcement of
those :Liens. This bill would revise and recast those
statutory provisions and make both substantive and technical
changes. The bill would also replace the terms

procedures and parameters for local jurisdictions to comply
with Articles XIII C and XIII D of the California
Constitution. This bill would limit the information an
agency is required to provide in a notice by mail to the
record owner of each identified parcel prior to levying the
assessment. The bill would prescribe other requirements for
the tabulation of ballots if an agency uses agency personnel
or a. vendor, and for the availability and preservation of
ballots to the public as disclosable public records. By
creating new requirements for property assessments conducted
by counties and cities, the bill would impose a

Summary: Existing law authorizes various agencies to
acquire land for purposes related to conservation. Existing
law establishes procedures for the independent appraisal
review of land to be acquired for conservation and
establishes a conservation easement registry. Existing law
prohibits, with a specified exception, conservation lands
from being sold to another owner or having possession and
control. transferred to another agency, unless specified
actions occur. This bill would prohibit a governmental
entity from condemning a conservation easement acquired by a
stage agency or nonprofit land trust, unless specified
procedures are followed. The bill would require the
governmental entity to give the holder of the easement
notice and an opportunity to state any objections to the
condemnation. The bill would also require the governmental
entity to prove by clear and convincing evidence that its
proposed use satisfies statutory requirements that the
condemnation be for compatible use and necessary for public
use. This bill contains other related provisions and other
existing laws.

Summary: The Ralph M. Brown Act requires the meetings
o:: the legislative body of a local agency to be conducted
openly and publicly, with specified exceptions. Under the
act, the legislative body of a local agency may hold a
c -osed session with the local agencies' designated
representatives regarding negotiations concerning employee
compensation but is required, in an open and public session
prior to those closed sessions, to disclose specified
information identifying the agency's designated
re.pr.esentatives. Existing law prohibits a closed session
from including any final action on the proposed compensation
of unrepresented employees. The act also requires the
legislative body of a local agency to publicly report any
action taken in closed session, as prescribed, including the
apps ^oval of an agreement concluding labor negotiations with
represented employees after the agreement is final and has
been accepted or ratified by the other party. The act
provides a legislative body or elected official is not in
vi_ol.ation of certain provisions of the act if the agenda
that: describes a closed session item is in substantial
compliance by including specified information. This bill
would additionally require a local agency, before holding a
closed session regarding employee compensation, to identify
the employee or class of employees that are the subject of
the negotiations, the representatives of the employees, and
all. known matters within the scope of the negotiations, and
to also make available to the public certain written
proposals. The bill would require the legislative body,
before commencing negotiations for a new collective
bargaining agreement or initial proposal for an
