REGULAR MEETING FEBRUARY 14, 1972

ADJOURNED The February 14, 1972 Regular Meeting of the
REGULAR Board of Directors of the East San Bernardino
MEETING County Water District was adjourned by the
Secretary due to lack of a quorum.
MEETING Notice of Meeting was posted in the District
POSTED Office noting an Adjourned Regular Meeting to
be held on February 15, 1972 at 7:30 P. M. at
the District Office, 1155 Del Rosa Avenue, San
Bernardino, California, all in accordance with
Government Code Section 54955, et seq.

time the twenty-inch line was out of service
for cement lining. He said Contractor TCH is
working in this area and gave the District
a good price to install a by-pass to the five
or six feet of line so District could
arrange for the work on the twenty-inch line
before the summer demands were made upon
the system in the Browning Road Area.
MOTION Upon motion by Director Wall, duly seconded
by Director Forrest and carried unanimously,
Staff was authorized to pay the additional
cost of $225 to TCH Pipeline Inc for the by-
pass at Browning Road and Base Line.
President and Secretary authorized to execute
Change Order No. 1.
RESOLUTION 1513 Resolution No. 1513 was presented requesting
PIPE LINE LICENSE authorization for President and Secretary to
AT&SF, JOB W-777 execute Pipe Line License agreement of AT&SF
railway company for installation of 12 3/4
inch water transmission line in Base Line
under Santa Fe Railroad Street, Job W-777.
Engineer Garcia pointed out the area on the
map where tke pipe line is to be installed
by the open trench method under railrad
tracks at Base Line and Railroad Street,
stating that Contractor TCH Pipeline Inc
indicated by letter they will pay if any
problems arise. Attorney Farrell explained
that the letter dated February 15, 1972 of
TCH Pipeline Inc. would hold the District
harmless of any damage to railroad property,
and TCH were also required under the Pipe Line
License, to furnish the Santa Fe with an
insurance policy also covering the District,
Directors, Officers and employees.
MOTION Upon motion by Director Forrest, duly seconded
by Director Littleton and carried unanimously,
Resolution No. 1513 was adopted and the
President and Secretary were authorized to
execute the Pipe Line License.
RESOLUTION 1512 Resolution No. 1512 was presented, accepting
ACCEPTING GRANT DEED Grant Deed from Frank S. Whiting and Elsie E.
ESTATE OF MARION Hunt, Trustees under the Will of Marion Teagle,
TEAGLE (FOR PLANT deceased. This covers the pumping station
104) site, Plant 104, at Base Line and Railroad
Street noted in District's Resolution 1510
for purchase price of $350. The General
Manager recommended acceptance of the Grant Deed.
MOTION Upon motion by Director Forrest, duly seconded
by Director Wall and carried unanimously,
Resolution No. 1512 was adopted, and the
Auditor was authorized to pay $350 purchase
price of the property and Secretary instructed
to record tke instrument with County Recorder.
BIG BEAR MUTUAL WATER The General Manager brought up for discussion,
DIST CONDEMNATION Big Bear Municipal Water District condemnation
SUIT/NORTH FORK suit of Bear Valley Mutual Water Company's Big
INFO Bear Dam and Lake in conjunction with North
Fork Water Rights. He said he received a call
from Attorney Edwards of Surr and Hellyer to
discuss the District's interest in the water
rights of tke Big Bear Lake due to the
District's ownership of North Fork Water
Company stock which is approximately twenty
percent of North Fork shares.

MOTION Upon motion by Director Forrest, duly
seconded by Director Littleton and carried
unanimously, Staff, Consultants and Attorneys
Denslow Green and Farrell were authorized to
meet with the Water Committee and the Attorneys,
Edwards and Bierschbach of Surr and Hellyer
and Mr. Paul Jennings, Senior, President of
North Fork Water Company to discuss the mutual
problem if any, and make recommendations back
to the Board at a later date.
CITY OF SB, NOTICE The General Manager displayed audio visual maps
PROPOSED ZONE of locations of Proposed City of San Bernardino
CHANGES Change of Zones at Del Rosa and Marshall Blvd.,
Golden Avenue and Olive, and Osbun and Pumalo.
All three locations were requesting change
to R3 Multiple Family Residential. Since the
District serves all three locations, Engineer
Garcia questioned if District's sewer service
was of the capacity to adequately service
additional building of this size. Tke General
Manager asked the Board Members if it should
be a policy of the District in the future, to
notify City of problems that may be created
in District facilities by suck zone change
approvals.
MOTION Upon motion by Director Wall, duly seconded by

of San Bernardino Planning Departments on
zone changes involving higher density that
could effect District's facilities.
ATTY GREEN'S The General Manager stated that he, David
REPORT PUMP TAX Garcia and Joseph A. Rowe were reviewing Attorney
COMMITTEE Green's Report on the Pump Tax Committee Meeting
of January 17, 1972. Engineer Rowe stated that
the twelve studies attached to Mr. Green's
recent letter, were c~puted on different
figures than he had used when he made his water
pricing study with Mr. Green and he had contacted
the SB Valley Municipal Water District, which
was supplying him with the new set of figures
and cost. He also made note that surface water
is more valuable water rights the District
should continue to protect. Mr. Rickert stated
Attorney Green has another Committee Meeting
on February 17 and he had a call in to him.
Attorney Farrell gave the General Manager a
copy of a letter he received from the San
Bernardino Valley Conservation District, dated
February 10, 1972 covering Water Rights Taxation,
prepared by Bill Hiltgen noting consequences
which might result if net pump tax were adopted.
STATUS OF CLAIMS Each Director received a copy of Morgan and
BY INSURANCE Franz, Insurance carrier's letter dated
CARRIER January 31, 1972 noting the status of claims
filed against the District for water and sewer
damage. Mrs. Davidson, 8154 Shirley Street -
paid $52.75; Juanita Hogan, 7020 Conejo - in
the hands of attorney; Martha Perkins, 6766
Dwight Way, paid $267.83; Kenneth R. Floyd,
25427 35th Street, paid $380.00; and Julius E.
Streck, 25373 4th Street which was noted
earlier in these Minutes. The General Manager
also presented letter dated January 31 from
Chubb/Pacific Indemnity Group noting payment
in full to Martha Perkins, 6766 Dwight Way,
San Bernardino and requested reimbursement of
100 deductible.
