APPROVAL OF LIENS FOR DELINQUENT WATER AND SEWER ACCOUNTS,
The Chief Financial Officer stated that the charges identified by Account Numbers: 044-
0044-2 and 103-0141-4 had been paid and should be remow~d from the lien list.
M/S/C (Lightfoot-Negrete) that the liens for delinquent water and sewer accounts
be approved for processing with the exceptions as noted by the Chief Financial Officer.

189807 distributed during the period of June 21, 2002 through June 28, 2002 in the
amount of $84,539.74 and Payroll Fund Disbursements for period ended June 21,2002

RADON RULE UPDATE
The General Manager reported on the District's progress with the Rule to date; that the
VA/HUD bill had not been "marked up" yet; that the Dis,tdct was working with and
receiving support from the Rural Water Association. Information only.
AGREEMENT TO FORM THE UPPER SANTA ANA RIVER WASH LAND
MANAGEMENT AND HABITAT CONSERVATION PLAN TASK FORCE was
presented to the Board for approval.

Form the Upper Santa Aha Wash Land Management and Habitat Conservation Plan
Task Force.

Recommendation:
Approve the transfer of these accounts to the Tax Rolls.
Background:
Attached is the list of delinquent accounts that were liened during the period June 2001
to May 2002, and that were outstanding as of July 1, 2002. According to Ordinance 358, section
13.01, a list of these liened accounts is to be submitted to the Board of Directors for consideration as
tax liens. The total eligible for County Tax Rolls for the 2002-2003 fiscal year is $7,708.65.

Dear Sir,
I am purchasing a new home at TR 14326-1). Its projected
completion date is August 6. This property has a ten foot East Valley Water District (EVWD) easement
along its north side, wh/ch is the near side to an EVWD water tank facilitb,,
After speaking with Mr. Paul Dolter, its my understanding that the easement may no longer be needed by
your organization, and that I should contact you regarding the quitclaiming of it. Would you please
consider the quitclaiming of that easement? It would greatly add to the w.lue of the property, increasing
the usable lot size by 1,390 square feet, allow/ng the north wall to be built on the property line, and make
my future plans for the backyard (pool and such) feasible.
The ten foot easement on the property is in addition to an existing twenty-one foot wide space that
lies between, and runs the length of, the property line and the block wall of the EVWD water tank
facility. Its my understanding that this was intended as a driveway to allow access to the back (west) side
of the water tank facility and that twenty-one feet of width would meet your access needs, precluding the
need for the easement on the property. I have attached a tract diagram to help illustrate the above.
I hope you will consider my request. Please feel fi-ee to contact me if you need additional information, or

AGREEMENT REGARDING PROPOSED STREAM OR LAKEALTERATION
THIS AGREEMENT, entered into between the State of California, Department of Fish and Game,
hereinaffercalledthe Department, and RobertMartin of East Valley Water District, P.O. Box3427,1155
Del Rosa Avenue, San Bemardino, CA 92413, (909} 885-4900, State of California, hereinafter called the
Operator, is as follows:
WHEREAS, pursuantto Section 1601 of California Fish and Game Code, the Operator, on February
25, 2002, notified the Departmentthattheyintend to divert or obstruct the natural flowof, orchangethe
bed, channel, orbankof, oruse matedal fromthestreambed(s) of, the following water(s): CityCreek,
tributary to the Santa Ana River, San Bernardino County, California, Section 4, Township1 South,
Range 3 West.
WHEREAS, the Department(represented by Juan Hemandez) has determined thatsuch construction
may substantially adversely affect those existing fish and wildlife resources within City Creek, tributary to
the Santa Aha River, specifically identified as follows: Fish: SantaAna .qucker, arroyo chub, and speckled
dace; Amphibians: California red-legged frog, Pacific salamander, western toad, and Pacific tree frog;
Reptiles: San Diego homed lizard, orange-throatedwhiptail,westem rat'desnake, western fence lizard,
side-blotched lizard, gopher snake, and common kingsnake; Birds: white-tailed kite, red-tailed hawk,
American kestrel, burrowing owl, killdeer, California quail, mourning dove, hummingbirds, California
thrasher, Common flicker, scrub jay, northern mockingbird, brown towhee, yellow-breasted chat, yellow-
rumpedwarbler, black phoebe, finches, and sparrows (song, sage, fox, white-crowned, and house);
Mammals: San Bemardino kangaroo rat, Pacific kangaroo rat, raccoon, opossum, skunk, coyote,
California ground scluirrel, black-tailed jackrabbit, Docket gopher, and mice (San Diego pocket, house,
and deer mouse); Riparian Vegetation which provides habitat for those species: willows, mulefat, and
cottonwood; and all otherfish andwildlife resources, including that dpadan vegetafionwhich provides
habitat for such species, in the area.
THEREFORE, the Department hereby proposes measures to protect fish and wildlife resources dudng
the Operator's work. The Operatorherebyagrees to accept the following measures/conditions as partof
the proposedwork.
If the Operator's work changes from that stated in the not'~cafion specified above, this Agreement is no
Iongervalid and a new notification shall be submitted to the Department of Fish and Game. Failure to
comply with the provisions of this Agreement and with other pertinentcode sections, including but not
limited to Fish and Game Code Sections 5650, 5652, 5937, and 5948, may result in prosecution,
Nothing in thisAgreement authorizes the Operatorto trespass on any land or property, nordoes it
relieve the Operator of responsibility forcompliance with applicable federal, state, or local laws or
ordinances. A consummated Agreement does not constitute Department of Fish and Game endorsement
of the proposed operation, orassure the Department's concurrencewith permits required from other
agencies.
STREAMBED ALTERATION~'~REEMENT FOR NOTIFICATION NUIV~ER: 6-2002-025
July 2, 2002
This Agreement becomes effectivethe date of Department's signature andterminates on
September 1,2003 for construction ofthe proposed project only. This Agreement shall remain in effectfor
thattime necessary to satisfy the terms/conditions of this Agreement. Any provisions of the agreement
may be amended at anytime provided such amendmentis agreed to inwriting by both parties. Mutually
approved amendments become part of the original agreement and are subjectto all previously negotiated
provisions. The Operator may request an extension ofthe agreement annually for a 12-month period if
additional construction time is necessary. The extension shall be requested priorto the termination date of
the agreement.
1. The following provisions constitute the limit of activities agreed to and resolved by this Agreement. The
signing of this Agreement does not imply thatthe Operator is precluded from doing other activities atthe
site. However, activities not specifically agreed to and resolved by this Agreement shall be subject to
separate notification pursuantto Fish and Game Code Sections 1600 et seq.
2. The Operator proposes to alter City Creek to excavate an approximate 30*foot-wide by 12 to 15-foot-
deep trench around the existing sewer pipeline that crosses beneath the creek. Once exposed, the pipe
will be encased in a minimum of 4-foot-wide by 4-foot-deep concrete encasement in orderto reinforce the
clay pipe. To protectthe pipe from potential scourofthe channel, a rock concrete rip rap cradle will be
placed overthe encasement; the cradlewill be about 2 feetthick and extend outward and downward from
the encasement at about a 1.5:1 slope to a minimum depth of about 12 feet below the channel towline,
Side slopes of the trench forthe dp rap cradle will be constructed at about a 1:1 slope. This will result in
abouta 50-foot-wide by a minimum 12-foot-deep trench. To constructthese facilities, a 20-foot-wide
construction access road will be developed adjacentto the trench, as described in the submitted
application. Installation of the pipe facilifieswillimpact appreximately 0.;B0 acre of streambed.
3. The agreed workincludes activities associated with Condition No. 2 (above). The project area is located
approximately 200 feet northerly of the Fifth Street Bddge crossing in the City of Highland in City Creek,
tributary to the Santa Aha River, in San Bemardino County. Specificwc,rk areas and mitigation measures
are described on/in the plans and documents submitted by the Operator.
4. TheOperatorshallnotimpactmorethan0.80acres Allimpacts aretemporary.
5. The Operator shall restore the temporarily disturbed 0.80-acre site follo~ving construction. Restoration
shall include the revegetation of the site with native vegetation. Restoration shall also include the removal
of exotic vegetation from the restoration area throughoutthe monitorin!;3 and maintenance period and until
the site is deemed successful by the Department. Monitoring and maintenance of the mitigation site(s)
shall be done annually for a minimum of five years, and untilthe Department determines the restoration
sites are successful, and reports shall be submitted annually to the Department for review.
In addition, the City shall purchase one (1) credit (equivalent to one (1) acre) from Cajon Creek
Conservation Bank pdorto commencing project activities. The Cajon Creek Conservation Bankis located
offsiteinthe Cajon Creekwash and administered byVulcan Materials Company, CalMat Division
Contact: Doug Spregue). This purchase is to compensate forthe impacts to San Bemardino kangaroo rat
and its associated alluvial fan sage scrub habitat. Proof of purchase of the credit shall be submitted to the
Department prior to commencing project activities.

Sierra Watersheds Tour
September 11-13, 2002
Sponsored by the Water Education Foundation
The goal of watershed management is to take a broad, holistic view at all issues in a river
basin - water supply, water quality, flood control, land use, and environmental protection.
The Sierra Watersheds Tour explores efforts to coordinate downstream and upstream issues
in three diverse watersheds: the American River, the Truckee River - including Lake Tahoe
vand~the~Yuba River.
This fast-paced, three-day tour begins Wednesday at Sacramento International Airport
and travels through the footh/lls and Sierra Nevada portions of these watersheds before
returning to the airport by 6 p.m. Friday. Travel is by air-conditioned bus. The tour is
co-sponsored by the California Department of Water Resources and the UiS. Bureau
of Reclamation, Mid-Pacific Region.
Resource people from a variety of local, state and federal agencies, environmental
organizations and public interest groups_ provide expert commentary as we travel.
The tour is a must for water policy-makers, water board managers and directors,
attorneys, consultants, environmentalists, farmers, journalists and anyone interested
in watershed management.
On the tour you will learn about:
Efforts to control nonpoint source pollution
Flood control - from both the valley and mountain perspectives
Operation of Folsom Dam, part of the Central Valley Project
Efforts to protect and enhance ch/nook and kokanee salmon hms
Lake Tahoe and its water clarity
Wild and Scenic River issues on the Yuba
Impacts of mining and logging on water quality
