SPECIAL MEETING JANUARY 12, 1979
NOTICE
A Special Meeting of the Board of Directors of the EaSt San Bernardino
County Water District has been scheduled for 4:00 p.m., January 12,
1979 at the District Office, 1155 Del Rosa Avenue, San Bernardino, Ca.
The purpose of this meeting is to discuss Director Norman W. Forrest's
activities, as related to the East San Bernardino County Water District
and the Local Agency Formation Commission.

Bonnie R. Eastwood, being first duly sworn, deposes and says:
That she is and at all times herein mentioned was the duly qualified
Secretary of the East San Bernardino County Water District, San
Bernardino County, California; and that she caused to be posted on
or near the door of the meeting place of the Board of Directors of
said District a copy of the Notice of a scheduled Special Board Meet-
ing of the Board of Directors of the East San Bernardino County
Water District.
Said posting was commenced on January 11, 1979 and remained posted
to time of the Meeting, said Meeting being January 12, 1979, 4:00
p.m.

MINUTES
President O.A. Wall called the meeting to order at 4:07 p.m. and
led the flag salute.
ROLL CALL VOTE:
PRESENT: O.A. Wall, President; Dennis L. Johnson, Vice-Presi-
dent; Directors Norman W. Forrest, Philip A. Disch,
Gerald W. Stoops
ABSENT: None
CONSULTANTS: Robert J. Farrell, Legal Counsel

DIRECTOR NORMAN W. FORREST'S ACTIVITIES, AS RELATED TO THE EAST SAN
BERNARDINO COUNTY WATER DISTRICT AND THE LOCAL AGENCY FORI~J~TION
COMMISSION
Director Forrest indicated he had a written statement which he wished
to read to the Board. He also indicated after having read the state-
ment that he wished to have it entered in the Minutes as written:
To: President O.A. Wall and Board of Directors of the East San Bernar-
dino County Water District. From: Norman W. Forrest, Director, East
San Bernardino County Water District. Today's Special Meeting has been
called by a majority of the Members of the Board, although I did not
receive a legal notice in writing in person or by mail at least 24
hours before the meeting time, in regard to the following: 1. To
discuss Director Norman W. Forrest and his activities as a Director
on the East San Bernardino County Water District 2. To discuss
Director Norman W. Forrest and his activities as a Commissioner of the
Local Agency Formation Commission. I represent all 59 special dist-
ricts. The question before LAFCo was (1) The change of the sphere of
influence of the City cf San Bernardino; (2) The annexation to the
City of the property known as the Highland Hills development. As a
Commissioner, I could not vote against these two matters even though
it had been discussed many times among the directors of the East San
Bernardino County Water District that the take-over and operation by
the City of San Bernardino Water Department would eliminate the Dis-
trict. Sometime before Prop. 13 passed, I personally became aware
of the ever rising administrative costs; salary increases passed after
Prop. 13, energy costs, and especially all the fringe benefits the
Directors have received (including myself), such as retirement bene-
fits, medical and dental coverage for each Director and his family;
per diem allowance, travel, food and lodging for each Director;
membership in and out of county-water, sewer and engineering associa-
tions; huge legal and accounting fees incurred by the District, not
including annual audits and water and sewer rate increases. Thus,
I carried out my responsibilities to the E.S.B.C. Water District and

our constituents, both within and outside the city limits. It is
not my aim to perpetuate myself in office, or build an empire. If
the annexation means an eventual take-over by the City of San Bernar-
dino, we, as Directors, should be big enough to face it and accept
it for the taxpayers' benefit. As far as talking to any of the Com-
missioners on LAFCO before 12/13/78, it was perfectly natural to do so.
Discussion goes on at all levels of government and between private
individuals any place and any time. I request this statement be enter-
ed in the Minutes as written. Yours very truly /Norman W. Forrest/

EXECUTIVE SESSION
A discussion ensued regarding the legality of holding an executive
session. Attorney Farrell indicated if the executive session was
based on legal action, then it would be in order. Director Johnson
stated he felt that it was concerning legal matters.
M/S/C (Johnson-Disch) that an executive session be held with
legal counsel present.

A discussion ensued regarding minutes being taken of the executive
session.
M/S/C (Johnson-Disch) that President Wall be authorized to act as
secretary during the executive session.

ABSENT: None
The Board of Directors went into executive session at 4:16 p.m.
M/S/C (Stoops-Disch) that the Board reconvene at 4:48 p.m.

RESOLUTION 1979.2 REQUESTING THE ASSOCIATION OF SAN BERNARDINO
COUNTY SPECIAL DISTRICTS TO INSTITUTE PROCEEDINGS TO REMOVE NORMAN
W. FORREST AS A SPECIAL DISTRICT REPRESENTATIVE ON THE LOCAL AGENcf
FORMATION COMMISSION
M/S/C (Johnson-Stoops) that the Board authorize Resolution 1979.2
to be presented by the Vice-President to the Association of San
Bernardino County Special Districts requesting that proceedings be
instituted to remove Norman W. Forrest from the Local Agency Formation
Commission; that the Board further authorize and direct the Vice-

President, in the absence of the President, to present Resolution
1979.2 at the next meeting of the Association of San Bernardino
County Special Districts on January 15, 1979.
Director Forrest was not present for the vote.
M/S/C (Johnson-Disch) that the meeting be adjourned at 5:10 p.m.
