HomeMy WebLinkAboutMinutes - EVWD Board of Directors - 11/13/2000APPROVED: NOVEMBER 27, 2000 EAST VALLEY WATER DISTRICT REGULAR BOARD MEETING MINUTES NOVEMBER 13, 2000 The meeting was called to order at 5:35 p.m. by President Lightfoot. Director Negrete led the flag salute. PRESENT: Directors Sturgeon, Negrete, Goodin, Lightfoot ABSENT: Director Wilson STAFF: Robert Martin, General Manager; Paul Dolter, District Engineer; Alberta Hess, Chief Financial Officer, Mary Wallace, Administrative Assistant. LEGAL COUNSEL: Steve Kennedy GUEST(s): Ken McVey, Mary Ann McVey, Andrew McVey, Ann Marie McVey, Arnold Wright, Elizabeth Kiel, Don Kiel, Jo McAndrews, Jim Cimino Prior to any EVWD business being conducted, Arnold Wright, North Fork Water Company President, presented a Resolution to the family of Joseph A. Rowe which was represented by Mrs. McVey (Joseph Rowe's daughter). Elizabeth Kiel, North Fork Director, was in the audience for the presentation. She was accompanied by her husband Don Kiel. APPROVAL OF AGENDA M /S /C ( Negrete- Goodin) that the November 13, 2000 Agenda be approved as submitted. PUBLIC PARTICIPATION President Lightfoot declared the public participation section of the meeting open at 5:45 p.m. The General Manager introduced Jim Cimino who presented a special report on the three (3) acre parcel on Webster Street. There being no further written or verbal comments, the public participation section was closed. APPROVAL OF OCTOBER 23, 2000 BOARD MEETING MINUTES. go M /S /C (Goodin- Sturgeon) that the October 23, 2000 Board Meeting Minutes be approved as submitted. APPROVAL OF LIENS FOR DELINQUENT WATER AND SEWER ACCOUNTS. The General Manager noted that the owner of property at 3246 Conejo Dr., and 24506 Court St. had paid the account and should be removed from the lien list. M /S /C (Goodin- Sturgeon) that the liens for delinquent water and sewer accounts be approved for processing with the exceptions as noted by the General Manager. DISBURSEMENTS M /S /C (Goodin- Sturgeon) that General Fund Disbursements #182750 through #182952 in the amount of $1,086,485.27, Payroll Fund Disbursements #7972 through #8064 in the amount of $87,713.86 totaling $1,174,199.13 be approved. RADON RULE UPDATE The General Manager reported on the District's progress with the Rule to date; that the `.r President had signed the VA/HUD Appropriation Bill; that Congress had reconvened today. Information only. DIRECTOR'S FEES AND EXPENSES FOR SEPTEMBER 2000 were presented to the Board for approval. M /S /C (Goodin - Negrete) that the Director's fees and expenses for October 2000 be approved. DISCUSSION AND POSSIBLE ACTION REGARDING PROPOSAL FROM WESBAY BOTTLING CO. The General Manager presented a proposal from Wesbay Bottling to the Board for consideration. He stated that bottled water from the District would be used as a "Public Relations' item for District Tours, etc. M /S /C ( Negrete- Sturgeon) that the proposal be accepted with the provision that staff secure acceptable answers to various questions; ie: liability insurance, shelf life, public health criteria. aw 2 November 13, 2000 CLAIM FOR DAMAGES AT 677 E. 9 ' St., SAN BERNARDINO, BY LUIS GINER (THE BUDGET AUTO WORKS). M /S /C (Goodin - Negrete) that the claim for damages at 677 E. g' St, from the Budget Auto Works by Luis Giner be denied and referred to District's Legal counsel and Insurance Agency. DISCUSSION AND POSSIBLE ACTION REGARDING A BALLOT FOR ACCEPTING OR REJECTING SECOND AMENDED JOINT CHAPTER 11 PLAN OF REORGANIZATION OF LENOX HEALTHCARE, INC. AND AFILIATES. M /S /C (Sturgeon - Negrete) that the ballot be cast for acceptance of second Joint Chapter 11 Plan of Reorganization of Lenox Healthcare, Inc. and Affiliates. NOVEMBER 3, 2000 RELEASES OF LIEN FOR DELINQUENT WATER AND SEWER ACCOUNTS. List of liens released on November 3, 2000 was reviewed. Information only. INCOME STATEMENT FOR SEPTEMBER 2000. The Draft Income Statement for the period ending September 30, 2000 was reviewed. Information only. GENERAL MANAGER'S REPORT The General Manager reported on District operations to date; that the District has received 3 — 4 claims for damage from sewage on Conejo St. in San Bernardino. Information only. ORAL COMMENTS FROM BOARD OF DIRECTORS. There being no verbal or written comments from the Directors, this section of the meeting was closed. ASBCSD MEMBERSHIP MEETING — NOVEMBER 20, 2000, L'ORANAGE ROOM, SAN BERNARDINO, CA. Information only. CSDA "LAFCO 2001" — SACRAMENTO CONVENTION CENTER, DECEMBER 6, 2000. Information only. CLOSED SESSION M /S /C ( Negrete- Goodin) that the meeting adjourn to Closed Session. 3 November 13, 2000 The Board entered into session at 6:15 p.m. as provided for in the California Open Meeting Law, Government Code Section 54945.9(a), to discuss those items listed on the Agenda. W ADJOURN TO REGULAR SESSION M /S /C (Negrete- Goodin) that the meeting adjourn to regular session. ANNOUNCEMENT OF CLOSED SESSION ACTIONS The Board returned to session at 6:25 p.m. The items listed on the Agenda were discussed in closed session with no reportable action being taken.
