The meeting was called to order at 2:00 p.m. by President Goodin. Eilecn Bateman led
the flag salute.

PUBLIC PARTICIPATION
President Goodin declared the public participation section of the meeting open at 2:01
p.m. There being no written or verbal comments, the public parfmipation section was
closed.

M/S/C (Lightfoot/Negrete) that the meeting adjourn to Closed Session.
The Board entered into Closed Session at 2:02 p.m. as provided for in the California
Open Meeting Law, Government Code Section 54945.9(a), to discuss those items listed
on the Agenda.

APPROVAL OF LIENS FOR DELINQUENT WATER AND SEVOgR
ACCOUNTS.
The Chief Financial Officer noted that the lien identified by Number 004-0217-0 had
been paid and should be removed from the lien list.
M/S/C (Lightfoot-Wilson) that the liens for delinquent water and sewer accounts
be approved for processing with the revision noted by the Chief Financial Officer.
REVIEW AND ACCEPT FINANCIAL STATEMENTS FOR TItE PERIOD
ENDED MA3RCH 31, 2002.
M/S/C (Lightfoot-Wilson) that the Financial Statements for the period ended
March 31, 2002 be accepted.
DISBURSEMENTS
M/S/C (Lightfoot-Wilson) that the General Fund Disbursements #188674
through 188840 in the amo~mt of $1,308,211.58 and Payroll Checks distributed April 12,
2002 in the amount of $76,613.08 totaling $1,384,824.66 be approved.

Director Sturgeon stated that he would not be able to attend the next Board Meeting.
Director Wilson reported on the Radon Rule to date. Information only,
Director Goodin requested that a later date be considered for the Budget Workshop.

BE IT HEREBY RESOLVED by the Board of Directors of the East Valley Water District, as
follows:
WHEREAS, the sanitary sewers and appurtenant structures constructed in accordance
with specifications of the East Valley Water District at Tract 15969 for public use in the City of
Highland, have been dedicated to East Valley Water District by Jeffrey Hirsh, Harwood Homes.
NOW THEREFORE, BE IT HEREBY RESOLVED, that the Dedication of Sewers dated
April 4, 2002 and executed by Jeffrey Hirsh on April 4, 2002 be accepted and all rights, title and
interest in and to said sewers be vested in the East Valley Water District, and that the Secretary
of this District be, and is hereby authorized and directed to record this Resolution with said
Dedication of Sewers attached hereto, in the office of the County Recorder of the County of San
Bernardino, State of California.
The foregoing resolution was duly adopted at a meeting of the Board of Directors of the
East Valley Water District, upon motion duly made, seconded and carried on May 14, 2002.

authorizing execution of a Grant of Easement to the Southern California Edison
Company, an easement and right of way to construct, use, maintain, operate,
alter, add to, repair, replace, reconstruct, inspect and remove at any time and
from time to time overhead and underground electrical supply systems and
communication systems necessary or useful for distributing electrical energy and
for transmitting intelligence by electrical means, in on, over, under, across and
along that certain real property in the County of San Bernardino, State of
California.
BE IT HEREBY RESOLVED AND ORDERED that the Grant of Easement
dated May 14, 2002 and signed by Donald D. Goodin, Board President for East
Valley Water District as grantor (s) to the Southern California Edison Company,
its successors and assigns a Grant of Easement over, under, through and across
the real property described therein.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that a copy of this
resolution be attached to said Grant of Easement, and that the same be recorded

SUBJECT: ALTERNATIVE METHODS TO FUND THE SPECIAL
DISTRICTS' SHARE OF THE NET COST FOR THE LOCAL
AGENCY FORMATION COMMISSION
Several weeks ago, each independent special district received a draft copy
of the preliminary LAFCO budget for review and comment. On April 17%
the Commission adopted the preliminary budget, and adoption of a final
budget is scheduled for May 15u~.
Based on the calculations in the preliminary budget, the independent
special districts' share of the net LAFCO cost will be approximately
$170,000 for Fiscal Year 2002-03. Even though the total LAFCO budget
for FY 02-03 will remain roughly the same as it was for the current fiscal
year, the cities', county's, and districts' share of the LAFCO cost is
projected to increase a total of $12,000 over last year because the LAFCO
cash carryover into the new fiscal year will be less than last fiscal year.
In early March, independent special districts were invited to a meeting to
consider alternative funding formulas for the districts' share of the
LAFCO cost. Those in attendance agreed that three funding alternatives
should be presented for consideration, and it was agreed that whatever
formula is ultimately selected will remain in effect unless it is changed at
some point in the future by a majority of districts.
Attached for your consideration are the three funding alternatives
selected in the districts' March meeting, a chart which compares the cost
to each district under each alternative, and a ballot for your use in
making a selection.
~'~ ~ Special Districts
Funding Alternatives
Alternative "A' is the existing funding method that was selected by the
independent special districts for use in FY 01-02. This alternative simply
extends that fo,mula into future years, and the attached chart reflects
updated costs for each of the districts.
Alternative "B' was proposed by Norm Hunt, General Manager of the
Crestline Village Water District. This alternative allocates costs based on
percentages of total revenues, with maximums and exceptions built into
the formula. Specific questions concerning this alternative can be
addressed to Mr. Hunt at 909-338-1727.
Alternative "C" was proposed by Burnie Cavender, General Manager of
the San Bemardino Valley Water Conservation District. This alternative
apphes percentage factors to "tiers" of districts based on revenues, and
consists of a greater number of tiers than the other alternatives. Specific
questions concerning this alternative can be addressed to Mr. Cavender
at 909-793-2503.
As noted, a ballot is also included as an attachment to this letter. Your
district may vote for more than one alternative. If one alternative
receives 28 or more votes (from districts representing a majority of the
population of the County), that altemative will be put into effect for
FY 2002-03, and it will remain in effect unless superseded by some
future alternative formula. In the event of a tie vote, or if none of the
alternatives receives support from a majority of the districts representing
a majority of the population, then a run-off ballot with the top two
alternatives will be held.
ALL BALLOTS MUST BE SUBMITTED TO THE LAFCO STAFF OFFICE
BY 5:00 P.M. ON MAY 31, 2002.

ALTERNATIVE FUNDING FORMULA ~A" FOR THE
INDEPENDENT SPECIAL DISTRICTS' SHARE
OF LAFCO COSTS
(EXISTING FORMULA)
Provided below is the alternative funding formula that was approved by a
majority of independent special districts last year, but it was to remain
operative for only Fiscal Year 2001-2002. This is presented as ~Opti0n A'
for your consideration.
1. Each of the three Health Care Districts in San Bemardino County
(also known as "Hospital Districts") shall each contribute $500 to the
Independent Special Districts' share of the LAFCO cost, regardless of
the amount of their current total revenues.
2. All Independent Special Districts with total revenues less than
$50,000, as reported in the most recent State Controller's Report on
the "Financial Transactions Concerning Special Districts" shall each
contribute $25.
3. All Independent Special Districts with total revenues between $50,000
and $100,000, as reported in the above-noted State Controller's
Report shall each contribute $50.
4. All Independent Special Districts with total revenues between
$100,000 and $200,000, as reported in the above-noted State
Controller's Report shall each contribute $250.
5. All Independent Special Districts with total revenues between
$200,000 and $1,200,000, as reported in the above-noted State
Controller's Report shall each contribute $2~750.
6. All Independent Special Districts with total revenues in excess of
$1,200,000, as reported in the above-noted State Controller's Report
shall equally divide the balance of the Districts' share of the LAFCO
costs {For FY 2002-03, that cost is estimated to be $4,954.63).
ALTERNATIVE FUNDING FORMULA"B" FOR
THE INDEPENDENT SPECIAL DISTRICTS'
SHARE OF LAFCO COSTS
Provided below is a description of the proposed funding formula which is identified
as Alternative "B" on the ballot:
1. Each of the three Health Care Districts in San Bernardino County
(also known as "Hospital Districts") shall each contribute $500 to the
Independent Special District's share of the LAFCO net cost,
regardless of the amount of their current total revenues; and,
2. All Independent Special Districts with total revenues in excess of
$50,000,000, as reported in the most currently available State
Controller's Report on the ~Financial Transactions Concerning
Special Districts', shall each contribute $20,000 to the Independent
Special District's share of the LAFCO net cost; and,
3. All Independent Special Districts with total revenues less than
$50,000,000, shall each contribute an amount not to exceed
$10,000 to the Independent Special District's share of the LAFCO net
cost. The amount to be contributed is determined by the ratio of
each District's Total Revenues as compared to the Total Revenues for
all districts in this category whose share does not exceed $10,000.

ALTERNATIVE FUNDING FORMULA "C" FOR THE
INDEPENDENT SPECIAL DISTRICT'S SHARE
OF LAFCO COSTS
The following alternative funding formula is proposed for consideration by the Independent Special
Districts in San Bernardino County as their share of the LAFCO costs. The proposal is to define
relatively similar Revenue Groups as a method of developing "fair share" contributions. In this
proposal, the members of a Revenue Group share equally in the total cost for that group.
For the Revenue Groups below, amounts were allocated based on the FY 2001-2002 LAFCO budget.
The amounts for FY 2001-2002 were converted to percentages, which would be used with future
LAFCO budgets that might have different totals than FY 2001-2002.
The FY 2002-2003 LAFCO budget changed from $158,725 to $170,000. Therefore, the percentages
were used to compute the Revenue Group amounts for FY 2002-2003.
REVENUE GROUPS
1. Hospital Districts. Each of the Health Care Districts in San Bernardino County (also known as
Hospital Districts) shall initially contribute $527. The total of this Revenue Group is $1,581, which
equates to 0.93% of the Independent Special District's share of the net LAFCO cost.
2. Under $50,000. All Independent Special Districts with total revenues less than $50,000, as reported
in the 1997-1998 State Controller's Report on the "Financial Transactions Concerning Special
Districts" (the latest publication available), shall each initially contribute $26. The total of this
Revenue Group is $78, which equates to 0.047% of the Independent Special District's share of the net
LAFCO cost.
3. Between $50,000 and $100,000. All Independent Special Districts with total revenues between
$50,000 and $100,000, as reported in the above-noted State Controller's Report shall each initially
contribute $51. The total of this Revenue Group is $130, which equates to 0.09% of the Independent
Special District's share of the net LAFCO cost.
4. Between $100,000 and $200,000. All Independent Special Districts with total revenues between
$100,000 and $200,000, as reported in the above-noted State Controller's Report shall each initially
contribute $264. The total of this Revenue Group is $1584, which equates to 0.93% of the
Independent Special District's share of the net LAFCO cost.
5. Between $200,000 and $I ,000,000. All Independent Special Districts with total revenues between
$200,000 and '$1,000,000, as reported in the above-noted State Controller's Report shall each initially

contribute $2,678. The total of this Revenue Group is $29,458, which equates to 17.33% of the
Independent Special District's share of the net LAFCO cost.
6. Between $1,000,000 and $2,000,000. All Independent Special Districts with total revenues
between $1,000,000 and $2,000,000, as reported in the above-noted State Controller's Report shall
each initially comribute $3,204. The total of this Revenue Group is $12,816, which equates to 7.54%
of the Independent Special District's share of the net LAFCO cost.
7. Between $2,000,000 and $5,000,000. Alt Independent Special Districts with total revenues
between $2,000,000 and $5,000,000, as reported in the above-noted State Controller's Report shall
each initially contribute $4,289. The total of this Revenue Group is $44,000, which equates to 27.75%
of the Independent Special District's share of the net LAFCO cost.
8. Between $5,000,000 and $10,000,000. Ail Independent Special Districts with total revenues
between $5,000,000 and $10,000,000, as reported in the above-noted State Controller's Report shall
each initially contribute $5,358. The total of this Revenue Group is $30,000, which equates to 18.91%
of the Independent Special District's share of the net LAFCO cost.
9. Over $10,000,000. All Independent Special Districts with total revenues over $10,000,000, as
reported in the above-noted State Controller's Report shall each initially contribute $6,431. The total
of this Revenue Group is $42,000, which equates to 26.48% of the Independent Special District's share
of the net LAFCO cost.
The attached Table A depicts the information described above. Table B depicts the contributions by
member agency within the Revenue Groups.

Subject: Selection of vendor for credit card processing.
Recommendation:
Authorize staff to sign a 3-year contract with First Data
Merchant Services for processing of credit card payments
Background:
The new utility billing software (Harris) approved by the Board of Directors on March 12, 2002 will give
the District the ability to provide our customers with the option of paying by credit card. In preparing for
this new capability, it is necessary for the District to establish new financial relationships.
Most important is a credit card processor. Once the District has obtained customer credit card
information as payment, the Processor will deliver that information to the merchant banks for
settlement. After settlement, the Processor will then deposit the funds into our designated bank
account. There are hundreds of Processors to choose from, but staff only considered companies that
had been referred in an attempt to assure a relationship with a quality organization.
The following Schedules I and II present quoted information from 5 Processors. Two are banks; the
other three are independent sales organizations (ISO's). Two of the ISO's, Paymentech and First Data
Merchant Services, were among the four companies awarded Master Service Agreements (MSA) by
the state of California. State agencies and departments, including special districts like EVWD, can
contract with these companies under the State's MSA and receive the rates negotiated by the State.
Schedule I is a comparison of the fees and rates the 5 Precessors would charge for the three different
scenarios that are most likely to occur at East Valley Water District. Card Present fees / rates apply
when a customer comes in, presents a card, and the card is swiped and a signature obtained. Card not
present - telephone would be applied when a customer calls in and gives their card number over the
phone. Card not present - internet would be applied when a customer accesses their account on-line
(a capability with Harris), chooses to make a payment, and is transferred to a secure sight where they
can input their card information.
There are many other scenarios with different rates, such as corporate card presented, and Discover
and Amex cards have Card Not Present rates as well. the comparison was limited to those items shown
simply to keep the schedule manageable.
Schedule II presents Equipment costs, licensing fees and contract terms, and also gives examples of
the amount that would be charged to EVVVD for credit card payments in different amounts.
Fiscal Impact:
Start up costs range from $1,500 to $2,000. Transaction fees will range from $.75 to $1.90 per
transaction assuming an average receipt of $45. We have been told that we should expect to process
about 10% or our payments with credit card by the end of the first year of offering this payment option.
Currently, we process about 18,500 payments per month. If 10%, or 1,850, pay by credit card, the
monthly cost of offering our customers the credit card option will be $1,390 to $3,500.

reimbursement of District costs incurred to comply with the
Open Meetings Act and other unfunded mandates.

Background:
State of California Senate Bill 90 established a provision whereby special districts could request
reimbursement from the state for unfunded mandates. The majority of unfunded mandates apply to
school districts, but some, such as compliance with the Open Meetings Act, are applicable to water
districts as well.
Centration, Inc. is a consulting firm that specializes in assisting special districts with the preparation of
claims for reimbursement in accordance with SB 90. Per discussions with representatives from
Centration, the most common cost reimbursed to water districts is the cost of preparing meeting
agendas for both full board and committee meetings. The state has established a minimum of $100 per
meeting that it will reimburse, but most often actual costs of labor and other allowable expenses
involved in preparing each agenda turns out to be substantially more than $100. However, if only the
minimum of $100 per meeting, for board meetings on[y, is claimed, the District will be reimbursec
$2,400 for each fiscal year.
There is currently a window of opportunity for Districts to submit claims for fiscal years back to 1994.
That window will probably close in August, 2002. Thereafter, only claims for current fiscal years will be
accepted by the State.
East Valley's CFO contacted Bear Valley Community Services District, one of the special districts on
Centration's list of references for these services. The General Manager for Bear Valley stated that
Centration's procedures were relatively painless, and that if his own staff had tried to learn the
reimbursement procedures, it would not have been near as cost-effective. Bear Valley received
reimbursements totaling $64,947.

Fiscal Impact:
increase District unrestricted net assets (equity) by $15,000. Centration's fee for this service is the
lesser of 20% or $6,500, but this fee is also reimbursable and will be included on the claim submitted to
the State.

The Bay-Delta Tour
June 19-21, 2002
Sponsored by the Water Education Foundation
All roads in California water policy lead to the Bay-Delta, heart of California's surface water delivery system
and a vital habitat for fish, birds and wildlife. It also is the focus of one of the largest ecosystem restoration
efforts in the nation - the CAi,FED Bay-Delta Program. This tour of the San Francisco Bay/Sacramento-San
Joaquin Delta Estuary provides the opportunity to view significant features firsthand by bus and boat, and gain
a better understanding of the challenging issues that must be resolved.
This fast-paced, three-day tour leaves Sacramento International Airport Wednesday, June 19, traveling
through the Delta and across the Bay, returning to the airport by 6 p.m. Friday, June 21. Travel is by air-
conditioned bus, Delta houseboats and the San Francisco Ferry. The tour is co-sponsored by the California
Department of Water Resources and the U.S. Bureau of Reclamation, Mid-Pacific Region.
On the tour you will learn about:
· The various state and federal agencies that have a stake in Bay-Delta decisions
· The viewpoints of the major stakeholder groups - agricultural,
urban and environmental - as well as in-Delta users and those
who live in the watersheds above the Delta
· Levee subsidence and flood control
· Water project operations and efforts to protect fish
· Delta farming
· Water quality, salt intrusion, drinking water treatment and THMs
· The latest on CALFED
· Ecosystem restoration projects
· Industrial water use, wastewater treatment and discharge
· Wetlands and waterfowl
· Introduced species

· Yolo Bypass Flood Control System/Wetlands

Registration fee for one person, single occupancy room - $550
Registration fee for two people, double occupancy room - $950

The tour begins at 8 a.m., Wednesday, June 19, at the Sacramento airport and ends by 6 p.m. Friday, June 21 at
the Sacramento airport. Travel will be by air-conditioned bus equipped with video monitors and restroom, Delta
houseboats and the San Francisco Ferry. The tour registration fee includes alt lodging and meals while on the
~our including Thursday night dinner at the historic Alta Mira Restaurant in Sausalito overlooking San
Francisco Bay. Tour participants are responsible for their own transportation to and from Sacramento.
This activity has been approved for Minimum Continuing Legal Education credit by the State Bar of
California in the amount of 20 hours. The Foundation certifies that this activity conforms to the standards for
approved education activities prescribed by the rules and regulations of the State Bar of California governing
minimum continuing legal education. There is an additional charge of $100 to register for MCLE credit.
Seating on this tour is limited. All reservations are on a first-come, first-serve basis. Reservations can be
made by completing the attached form and returning it to the Foundation with your payment. Faxed reserva-
tions will be accepted with credit card or purchase order payments. Fee includes all meals, lodging, trans-
portation while on the tour and background material. Deadline to cancel and receive a full refund is 5 p.m.
June 7 due to hotel, meal and transportation bookings. Request for a
