RESOLUTION 2003.39 - NOTICE OF COMPLETION FOR TIlE REHABILITATION OF DISTRICT WELL 132-2, LOCATED AT 7479 SAN FRANCISCO STREET IN TI~IE CITY OF I:[IGFILAND was presented to the board for approval. M/S/C (Sturgeon-Wdson) that Resolution 2003.39 be approved. DEVELOPlVIENT AGREEMENT BETWEEN EAST VALLEY WATER DISTRICT AND NORTH AMERICAN RESIDENTIAL COMMUNITIES, INC. TO PROVIDE WATER AND SEWER SERVICE TO FORTY-SEVEN (47) DWELLING UNITS WITHIN TRACT #14757 LOCATED SOUTH OF HIGIII,AND AVE., WEST OF SEVII,LE AVE., IN TIlE CITY OF BIGItLAND was presented to the Board for approval. M/S/C (Sturgeon-Wilson) that the Development Agreement between East Valley Water District and North American Residential commumtaes, Inc. be approved. APPROVAL OF LIENS FOR DELINQUENT WATER AND SEWER ACCOUNTS. The General Manager stated that the charges ~dent~fied by Account Numbers: 0330007-01 and 0810001-02 had been paid and should be removed from the lien list. M/S/C (Sturgeon-Wilson) that the liens for delinquent water and sewer accounts be approved for processing with the exceptions as noted by the General Manager. DISBURSEMENTS M/S/C (Sturgeon-Wilson) that General Fund Disbursements #194701 through 194921 distributed during the period of September 19, 2003 through October 10, 2003 in the amount of $1,168,869.81 and Payroll Fund Disbursements for the period ended September 26, 2003 and October 10, 2003 m the amount of $90,252.89 and $83,064.13 totaling $173,317.02 be approved DISCUSSION AND POSSIBLE ACTION REGARDING AUDIT REPORT FOR FISCAL YEAR ENDING JUNE 30, 2003 AND 2002. A detailed presentation of the District's Audit Report for Fiscal Year Ended June 30, 2003 was offered by Mr. Bob Memory and Mr. Joe Walsh from Rogers, Anderson, Malody & Scott, LLP (RAMS). M/S/C (Wllson-Lightfoot) that the Audit Report for Fiscal Year ended June 30, 2003 be accepted. 2 Minutes 08/12/03 RADON RULE UPDATE The General Manager reported on the District's progress w/th the Rule to date; that parties were awaiting the VA/HUD Appropriation Report which had not been adopted yet, that a report containing more realistic water and air reqmrements was being prepared for Congress. DISTRICT F[EADQUARTERS SITE UPDATE The General Manager gave an updated report on the District's Headquarters Site; that the design contract for the new District Headquarters Building has been prepared for consideration and formal presentation to the C~ty of San Bemardino; a pre-selected date of November 25th had been determined to show the public what was going to happen on the site but the Board decided to only have a ground-breaking ceremony in the Spring of 2004 and a dedication ceremony when close to occup)nng the new facihty. ONE-MONTH EASEMENT EXTENSION AGREEMENT BETWEEN EAST VALLEY WATER DISTRICT AND THE METROPOLITAN WATER DISTRICT FOR PIPELINE/TUNNEL CONSTRUCTION was presented to the Board for authorization. M/S/C (Lightfoot~Wilson) that the one-month easement extension agreement between EVWD and 1VI~T be authorized. RESOLUTION 2003.41 - AUTHORIZING INVESTMENT OF MONIES IN THE LOCAL AGENCY INVESTMENT FUND was presented to the Board for approval. M/S/C (Wilson-Sturgeon) that Resolut/on 2003.41 be approved. REVIEW AND APPROVE ENTRY PERMIT TO MWD TO ALLOW INGRESS AND EGRESS ON PROPERTY TO CONDUCT SURFACE AND SUBSURFACE OPERATIONS AND INVESTIGATIONS FOR THE CONSTRUCTION, INSTALLATION AND MAINTENANCE OF A WATER CONVEYANCE PIPELINE AND APPURTENANT STRUCTURES NEAR PLANT 59. The Board instructed Legal Counsel to modify the te~ms and conditions of the perrmt using similar language from the previous Entry Pemiit. M/S/C (W~lson-Sturgeon) that Staff approve the modified Pemut and that the approved and amended Permit be presented as an "information only" item after fmahzed. DIRECTORS' FEES AND EXPENSES FOR SEPTEMBER 2003 were presented to the Board for approval. 3 Minutes 08/I2/03 M/S/C (Lighffoot-Wilson) that the Directors' fees and expenses for September 2003 be approved. DISCUSSION AND POSSIBLE ACTION REGARDING TI:IE DISTRICT AS MOST FOR AN ASBCSD MEETING IN 2004. The Board elected to not respond to the request from ASBCSD to host a membership meeting in 2004. REVIEW AND APPROVAL OF AGREEMENT BETWEEN EAST VALLEY WATER DISTRICT AND GARY W. MIl&ER, ARCltlTECT & ASSOCIATES, INC. Staff and Legal Counsel were directed to discuss the contract with Gary M~ller and revise Agreement using ex~sting EVWD Professional Servmes Agreement format. M/S/C (Sturgeon-Wilson) that the Agreement with Gary Miller, Architect & Assocmtes be approved in concept and put into the new format. DISCUSSION AND POSSIBLE ACTION REGARDING SUPPORT FROM EVWD FOR SBPEA'S TlrlIR1) ANNUAL BENEFIT GOLF TOURNAMENT ON OCTOBER 24, 2003. M/S/C (Wilson-L~ghtfoot) that the District provide water in support of their 3rd Annual Benefit Golf Tournament and Fundraiser on October 24, 2003. TRAVEL EXPENSE REQUEST FROM GENERAL MANAGER FOR WESTCAS WASI-IINGTON DC MEETINGS was presented to the Board for approval. M/S/C (Negrete-W~lson) that the General Manager's request for expense reimbursement be granted. DIRECTORS GOODIN AND STURGEON VOTED NO. RELEASES OF LIEN FOR DELINQUENT WATER AND SEWER ACCOUNTS. GENERAL MANAGER'S REPORT The General Manager reported on the District's operations to date; reminded all of the Distnct Tour tomorrow, October 15th and that the Cull Well would be added to the itinerary; d~rected the Chief Financial Officer, Brian Tompkins, to give a report on the status of the District's new "Automatic Payment Plan"; that the District had been asked to partmipate ~n the Environmental Expo at Cal State San Bemardmo on November 22, 2003. Due to the lack of rain to replenish the basin with native water, the Association members considered purchasing State Water Project (SWP) water. The Association members approached the Boards of Directors of the San Bemardino Valley Municipal Water District (Muni) and the San Bernardino Valley Water Conservation District (Conservation District) for assistance. Muni is the State contractor that can supply water from northern California. The Conservation District is the agency that replenishes the San Bernardino groundwater basin with native water from Mill Creek and the Santa Aha River when available. West Valley Water District, City of San Bernardino Municipal Water Department, East Valley Water District, and City of Redlands Municipal Utilities Department are agencies that also have the ability to replenish the San Bemardino groundwater basin. Yucalpa Valley Water District has the ability to replenish the Yucaipa groundwater basin. After several meetings and workshops, Muni agreed to reduce the purchase cost to the water agencies by 50%, and adsorb the other 50% within existing resources. The Conservation District, which does not receive a large subsidy from property taxes, agreed to pay $400,000 of the remaining 50% to the water agencies within the Conservation District boundaries, and make all its groundwater replenishment facilities available at no cost. The City of San Bemardino Municipal Water Department, West Valley Water District, East Valley Water District, City of Redlands Municipal Utilities Department, and Yucaipa Valley Water District were identified as agencies willing to purchase additional water under the cost-sharing program. Recharge Locations The Drought Management Recharge Project (DMRP) began delivering SWP water on September 3, 2002 and continued until December 31, 2002. Recharge took place in five areas: Sweetwater spreading grounds north of Cai State San Bernardino; Waterman Canyon spreading grounds off of East Twin Creek; Santa Ana River spreading grounds; Mill Creek, Redlands Airport, and Bear Valley spreading grounds in the Redlands area; and Wilson spreading grounds in Yucaipa. The Sweetwater and Waterman spreading basins are owned and operated by the San Bemardino County Flood Control District. Through an agreement with the City of San Bernardino Municipal Water Department, the City can purchase SWP water and use these basins for groundwater recharge when the basins are not being used for detention of storm flows. In addition, Lytle Creek and Linden Ponds spreading facilities were identified, but were not available for recharge during this project. There were two locations in which water was delivered to the Santa Aha River spreading grounds. The first location was the Santa Aha low turnout off of the Foothill Pipeline to the Conservation District's most westerly basins 10 through 17. The second location was offofthe Santa Ana River Connector (SARC) pipeline. Two temporary pipelines were installed by East Valley Water District and the Conservation District from the SARC pipeline to the Seven Oaks Dam borrow pit basins. In the Mill Creek area, the Conservation District constructed a crossover structure on the Redlands Aqueduct. This structure allowed for SWP water, Santa Ama River water, and/or Mill Creek water to be diverted into the most westerly basins in the Mill Creek spreading grounds. In addition, the Conservation District had the ability to spread water in the easterly spreading basins in the Mill Creek spreading grounds. The City of Redlands spread water into their Airport and Bear Valley spreading basins offofthe Mentone Reservoir. The Wilson spreading basins are owned and operated by the San Bemardino County Flood Control District. Through an agreement with Yucaipa Valley Water District, SWP water can be purchased for groundwater recharge when the basins are not being used for detention of storm flows. By the completion of this project, 14,631.75 acre-feet of SWP water had been recharged in the five different locations: Sweetwater spreading basins, 2,558.21 acre-feet; Waterman spreading basins 3,528.74 acre-feet; Santa Ana River spreading grounds (combination of Santa Ana low and EVWD/SOD borrow site), 6,835.59 acre-feet; Mill Creek spreading grounds, Redlands Airport spreading basins, and Bear Valley spreading basins, 1,647.51 acre-feet; and Wilson spreading basins, 61.70 acre-feet. See Table 1 for the breakdown by month of the amount of SWP water delivered to the different spreading grounds. See Table 2 for the cost-sharing breakdown by participating agencies. Appendix A contains hydrographs and data of the daily deliveries to the respective spreading grounds. A digital file of the hydrographs and data can be found on the attached CD. Data Collection As part of this recharge project, the participating agencies .and the Conservation District took on an intensive effort of data collection. The type of data collected was: the total amount of water recharged on a daily basis; location of the recharge; groundwater levels downstream of the recharge basins (twice a week); and the production of groundwater (rate, total gallons, and start and stop times of pumps) in the area downstream of the recharge basins. Once the recharge was complete, data was to be compiled and distributed to the participating agencies for analysis and evaluation. Before any recharge began, the participating agencies sat down and developed criteria for the data collection. The data collection was broken down into three categories: Recharge; Groundwater Levels; and Production. Data was collected prior to, during, and after the recharge activities so as to see the influence of the recharge on the surrounding production wells. Table 3 is a list of data collection criteria for the above categories. Once the area of influence for recharge was identified, each agency developed a list of wells that could be used to collect groundwater levels twice a week. See Exhibit A and Exhibit B for the location of the recharge basins, recharge zone of influence, and groundwater level monitoring wells. Table 4 is a list of groundwater level monitoring wells, by recharge area, provided by the participating agencies. The Conservation District has compiled all of the data submitted from the participating agencies and has included it in this document or the attached CD. The Conservation District has taken some extra steps to provide groundwater level monitoring well hydrographs. Appendix B contains a printed copy of the groundwater level monitoring well hydrographs by recharge area. The production data is in a digital fmmat and is included on the attached CD. In addition, Appendix C includes the available well data sheets for groundwater level monitoring wells. Tompkins / Chief Financial Officer Subject: Obsolete computer equipment Recommendation: Declare attached list of old computer equipment to be surplus and authorize staff to dispose of the equipment by 1) contribution, 2) disposal, or 3) pay for hazardous waste disposal if necessary. Background: Computer and office equipment that is obsolete, and/or in need of repair, is stacking up in the District's warehouse. Attached is a list of that equipment. Many of the items developed problems and, because of their age or the magnitude of repairs needed, the District opted to replace them with new equipment. Other of the items may still work but they are 'pre-Pentium' technology. We have asked the County Solid Waste Management Department what options the district has for disposing of the equipment. All components, other than monitors, may simply be placed in a dumpster. Monitors need to be taken to a hazardous waste center. We have received quotes of $15 to $35 each for their disposal Another company said they would take all of the computer e(~uipment and charg.e 29¢ per pound. Staff has made preliminary inquiries of four not-for -profit organizations, but only one, Salvation Army, expressed any willingness to look at the items we have. Staff requests that the board of directors declare the items on the attached list to be surplus equipment, and authorize staff to dispose of the equipment by first, offering it to not-for-profit organizations, and second, paying for its disposal in the most cost effective, and legal, way possible.
