M:nutes: 01/25/05 DEVELOPMENT AGREEMENT BETWEEN EAST VALLEY WATER DISTRICT AND STANDARD PACIFIC HOMES TO PROVIDE WATER AND SEWER SERVICE TO (253) TWO HUNDRED FIFTY-THREE DWELLING UNITS IDENTIFIED AS TRACT 16014 WillCH IS LOCATED AT THE NORTHEAST CORNER OF IDGHLAND A VENUE AND CHURCH STREET IN THE CITY OF HIGHLAND, COUNTY OF SAN BERNARDINO, STATE OF CALIFORNIA was presented to the Board for approval. M/SIC (Sturgeon-Negrete) that the Development Agreement between East Valley Water District and Standard Pacific Homes be ¡>~proved. APPROVAL OF LIENS FOR DELINQUENT WATER AND SEWER ACCOUNTS. The Administrative Assistant stated that the charges identified by Account Numbers 0010192-02, 0020160-14, 0520242-02, 0842775-04, 1231153-02, 1420142-07 had been paid and should be removed from the lien list. M/S/C (Sturgeon-Negrete) that the liens for delinquent water and sewer accounts be approved for processing with the exceptions as noted by the Administrative Assistant. DISBURSEMENTS M/SIC (Sturgeon-Negrete) that General Fund Disbursements #200117 through 200298 distributed during the period of January 7, 2005 through January 19, 2005 in the amount of $557,996.87 and Payroll Fund Disbursements for the period ended January 7, 2005 and December 31, 2004 in the amount of $93,274.03 and $3,280.37 totaling $654,551.27 be approved. RADON RULE UPDATE / PERCHLORATE RULE UPDATE President Wilson stated that he was pleased with the recent appointment of Congressman Jerry Lewis to chair the Appropriations Committee. Vice President Sturgeon stated that he had attended a meeting regarding Perchlorate where Senator Soto was the speaker. DISTRICT HEADQUARTERS SITE UPDATE President Wilson reported on the District's operations to date. Information only. ADOPT THE NEGATIVE DECLARATION; ADOPT THE MITIGATION MONITORING AND REPORTING PROGRAM; ADOPT A DE MINIMUS ïlV1PACT FINDING; AND FILE THE NOTICE OF DETERMINATION AND CERTIFICATE OF FEE EXEMPTION WITH THE COUNTY OF SAN BERNARDINO CLERK OF THE BOARD OF SUPERVISORS AND THE STATE 2 Minutes: 01/25/05 OFFICE OF PLANNING AND RESEARCH, STATE CLEARINGHOUSE was presented to the Board for approval. M/S/C (Lightfoot-Negrete) that the District adopt the Negative Declaration; adopt the Mitigation Monitoring and Reporting Program; adopt a De Minimus Impact Finding; and file the Notice of Determination and Certificate of Fee Exemption with the County of San Bernardino Clerk of the Board of Supervisors and the State Office of Planning and Research, State Clearinghouse be approved. DISCUSSION AND POSSIBLE ACTION REGARDING AD HOC COMMITTEES. President Wilson stated he would like all Board Members to be involved in Ad Hoc Committees; that the first Ad Hoc Committee will be to Review the District's Property, Casualty and Workers Compensation Insurance; that he and Vice President Sturgeon will be serving on the committee. REVIEW AND ACCEPT FINANCIAL STATEMENTS FOR PERIOD ENDED DECEMBER 31, 2004. M/S/C (Lightfoot-Negrete) that the Financial Statements for period ended December 31, 2004 be accepted. DIRECTOR GOODIN ARRIVED AT 2:16 P.M. THE GENERAL MANAGER ROBERT MARTIN ARRIVED AT 2:17 P.M. DISCUSSION AND POSSIBLE ACTION REGARDING THE PIPING MATERIAL PROCUREMENT PACKAGE FOR THE STERLING & 6TH STREET PIPELINE PROJECT. The District Engineer updated the Board on the anticipated Perchlorate Project; that the proposal package prepared by CDM consists of specifications to bid for the purchase of the pipeline materials. The General Manager stated that the proposal is for materials only; that to control installation costs District staff will be installing the pipeline; that the District will serve as Main Contractor on the project; that he recommends approval on the Procurement Proposal Package. Steve Kennedy concurs with the General Manager but recommends the proposal be subject to minor changes recommended by the General Manager and concurrence by Legal Counsel. M/S/C (Negrete-Lightfoot) that the Piping Material Procurement Package for the Sterling & 6th Street Pipeline Project be approved. Minutes: 01/25/05 RELEASES OF LffiN FOR DELINQUENT WATER AND SEWER ACCOUNTS. List of liens released on January 18,2005 was reviewed. Information only. INVESTMENT REPORT FOR QUARTER ENDED DECEMBER 31, 2004 The Investment Report for quarter ended December 31, 2004 was reviewed. Information only. GENERAL MANAGER'S REPORT The General Manager reported on the District's operations to date; that proposed Legislation regarding an alternative to the Ortiz Bill from last year is being reviewed; that the 7 Oaks Dam holding pools have risen more than expected and are much higher than anticipated: th?t Edison is shut down et the present time due to tÌ'e floors; that the water being released is contaminated and the District's Trea!ment Plant is unable to process the water; that the General Manager is concerned that our water supply is being compromised; that a number of agencies are going to set up a meeting with the County of San Bernardino Flood Control and the Army Corps of Engineers to address this problem. Information only. ORAL COMMENTS FROM BOARD OF DIRECTORS Director Goodin apologized for being late to the Board Meeting; that he was attending the funeral for Robert E. Dodson. Vice President Sturgeon suggested the District send a condolence card to Mrs. Dodson on the death of her husband; that he suggested the District possibly contact and resume negotiations with Nextel and would like to know if the Board is interested in adding this item to the Agenda. State Of California. BE IT HEREBY RESOLVED AND ORDERED that the Convevance of Pipeline Easement dated January 17, 2005, and signed by Carlos Hàgar and Deana L. Hagar as grantor (s) grants to the East Valley Water District, its successors and assigns a Pipeline Easement over, under, through and across the real property described therein, be and the same is hereby accepted for and on behalf of said Water Company. RECITALS A. District is formed and organized pursuant to the County Water District Law, Water Code Section 30000 et seq. B. Owner's holds title to property located at City of Highland, County of San Bernardino, State of California, and more particularly described as ("the Property"). C. The Property is located within the service area of the Arroyo Verde Mutual Water Company, is a private corporation organized and operating as a mutual water company that provides water service to its shareholders ("Company"). D. Company's water system consists of a well, booster pump, and various types of piping that are inoperable andlor not in compliance with the legal standards enforced by the State of California Department of Health Services ("the Water System"). As a result, Company's shareholders are currently receiving domestic water service by virtue of two (2) emergency connections to District's water distribution system. E. In or about 1999, Company's shareholders formally requested that District permanently assume the operation and control of the Water System and that the properties served thereby become part of District's official service area. District agreed to consider said proposal if outside funding can be obtained to repair and replace the Water System and a majority of the shareholders of Company consent to the financing mechanism deemed appropriate by District to repay the costs thereof. F. On December 11,2000, District's Board of Directors adopted Resolution No. 2000.26 which authorized the submission of an application for construction monies from the Safe Drinking Water State Revolving Fund ("the Fund") for the purpose of securing revenue to be used for the construction offacilities necessary to bring the Water System into a condition deemed appropriate by District to assume the operation and control thereof ("the Project"). G. In or about January of 2002, District and Company entered into a Notice of Application Acceptance issued by the State of Califomia Department of Water Resources on or 1 about December 19, 2001, for Project No. 3610064-01, wherein the Fund would provide a construction loan in the amount of$136,034.00 ("the Loan") and a construction grant in the amount of$544, 136.00 ("the Grant"), for a total contribution by the Fund of$680, 170.00 to be applied to the cost of the Project, the total price of which is currently estimated to be the sum of $810,170.00. H. On June 11,2002, District's Board of Directors adopted Resolution No. 2002.25 which authorized the initiation of proceedings to form the Arroyo Verde Assessment District ("A V AD") in accordance with California law to repay the Loan and reimburse District for the portion of the Project costs not covered by the Fund. I. On November 26, 2002, District's Board of Directors adopted a Negative Declaration for the proposed Project pursuant to the California Environmental Quality Act (public Resources Code Section 21000 et seq.) and the Guidelines promulgated thereunder (14 California Code of Regulations Section 15000 et seq.). J. On or about May 20, 2003, District caused a Notice of Public Meeting and Public Hearing and Official Ballots ("Ballots") to be delivered to the records owner(s) of each parcel within the A V AD as determined from the last eqltalized property tax roll as set forth in the Water System Improvement Project report prepared by W.J. McKeever, Inc., anå WilliaI1l J. McKeever, a registered professional engineer certified by the State of California ("the McKeever Report"). K. The McKeever Report also sets forth the amount of each assessment to be levied on the properties within the A V AD. At the time the S1cKeever Report was being prepared, Owner (or Owner's predecessor) was given the option of making private arrangements for the connection of the Property to the Project (and paying for the costs thereof) or choosing to have the District make the connection of the Property to the Project (and having the costs thereof incorporated into the amount of the Property's AVAD assessment). Owner (or Owner's predecessor) chose to make private arrangements for the connection of the Property to the Project, so the costs thereof were not included in the amount of the assessment to be levied on the Property under the McKeever Report. L On June 10,2003, District's Board of Directors conducted a public meeting on the proposed AVAD. M. On July 8, 2003, District's Board of Directors conducted a public hearing on the proposed A V AD and heard all public testimony offered in connection therewith and accepted all Ballots returned to District until the close of the public hearing. At the conclusion of the hearing, District's Board of Directors found that a majority protest to the Project did not exist and thus adopted Resolution No. 2003.30 approving the McKeever Report and the formation ofthe A V AD. N. Owner now requests that the District make the service connection from the Property to the Project and have the costs thereof included in the amount of the A V AD assessment levied on the Property. 2 COVENANTS IN CONSIDERATION OF THE MUTUAL COVENANTS, AGREEMENTS, REPRESENTATIONS, AND WARRANTIES CONTAINED IN THIS AGREEMENT, THE PARTIES AGREE AS FOLLOWS: 1. District shall perform such services as prudent in the exercise of its sole discretion to connect the Property to the Project so as to enable the District to provide water service from the Project to the Property. District shall not be responsible for any subsequent maintenance, repair, and/or replacement of said service connection. 2. Owner hereby agrees to the following: (a) Owner consents to an increase of the annual assessment to be levied on the Property pursuant to the A V AD such that the annual amount of such assessment shall be $ (b) Owner waives and reI inquishes any right to challenge the formation of the A V AD or the aluount of any assessmel11 levied on the Properly pursuant to the A VAD; (c) Owner shall comply with the terms and conditions of all rules, regulations, ordinances, resolutions, and policies that have been or may hereafter be adopted by District; and (d) Owner shall duly execute, acknowledge, and deliver the District's Water/Sewer Service Order for the Property and any further deeds, assignments, conveyances, and other assurances, documents, and instruments of transfer reasonably requested by District, and will take any other action consistent with the terms of this Agreement that may reasonably be requested by District for the purpose of carrying out the intent of this Agreement. 3. Owner hereby releases the District from any liability as follows: (a) Owner, on behalf of himself and his descendants, ancestors, dependents, heirs, executors, administrators, agents, servants, employees, representatives, assigns, and successors ("Releasors"), hereby fully releases aI1d discharges District and its officers, directors, administrators, assigns, agents, servants, stockholders, employees, representatives, and successors ("the Released Parties") from all claims, demands, damages, debts, liabilities, obligations, contracts, agreements, causes of action, suits, and costs of whatever nature, character, or description, whether known or unknown, anticipated or unanticipated, which Owner and Releasors now have or may hereafter have or claim to have against District and the Released Parties arising out of or related to the Project, the A V AD, the levy of any assessments on the Property, District's connection of service from the Project to the Property, District's provision of services to the Propeliy, District's termination of services to the Property, and/or any other acts or omissions performed by District under this Agreement. (1) This Release, notwithstanding Section 1542 of the California Civil Code, which 3 provides that "a general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release which if known by him must have materially affected his settlement with the debtor," shall act as a full release by Owner and Releasors of any and all claims that may arise against District and/or the Released Parties regarding the above whether such claims are currently known, unknown, foreseen, or unforeseen. Owner understands and acknowledges the significance and consequence of such specific waiver of Section 1542, and hereby assumes full responsibility for any resulting liabilities. 4. The parties hereto agree as follows: (a) This Agreement constitutes the entire Agreement between the parties pertaining to the subject matter contained herein, and supersedes all prior and contemporaneous agreements, representations, and understandings of the parties. No supplement, modification, or amendment of this Agreement shall be binding unless executed in writing by all of the parties. No waiver of any of the provisions of this Agreement shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by the party making the waiver. (b) This Agreement may be executed simultaneously or in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. ( c) This Agreement shall be binding on and inure to the benefit of the parties hereto, their respective heirs, legal representatives, successors, and assigns, and any subsequent owners of the Property. (d) If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorneys' fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled. Walton, President East Valley Water District Memorandum "'""»,""'~ To: Bob Martin, General Manager; Paul Dolter, District Engineer From: Andy Quach, Associate Civil Engineer ;4J2 2/1 ((;IS Date: 2/1/2005 Re: Proposed Rehabilitation of Tanks at Plant 39 As part of the District's annual reservoir maintenance program, staff had contracted with Harper and Associates Engineering, Inc. to perform a condition and corrosion evaluation of the two water storage tanks at Plant 39. The associated report was reœllily COLlpkted in Jan¡;ary 2005. D~¡e to the condition of the interior coating as shown in the report, rehabilitation of the 1.4 MG water tank should be of high priority. This work will require the tank to be removed from service during rehabilitation, therefore this work needs to be started and completed during the winter months when demand on the tanks are low. The'report recommends the 0.9 MG tank, referred to as tank 39A, exteriGr be repainted to repair random rust spots and overcome the chalking and fading appearance. The report recommends the 1.4 MG tank, referred to as tank 39B, exterior be repainted to repair random rust spots and overcome the chalking and fading appearance. Although the exterior coatings are in fair to good condition, it is anticipated the coating will degrade increasingly faster with time. It is more cost effective to do all this work at one time, instead of waiting a few more years to do the exterior coating. The coal tar coating on the interior shell and roof of tank 39B has exceeded its life expectancy of 20 years and exhibits large areas of cracking and de-lamination with excessive corrosion. The interior roof and shell of tank 39B is recommended to be abrasive blast cleaned with an epoxy coating applied to the roof and shell afterwards. The tank 39B bottom is recommended to be completely abrasive blast cleaned with an epoxy coating applied afterwards. The report also recommends various items of structural work to conform to safety and health codes. Overall cost of the tank rehabilitations will be approximately $185,000 to $215,000. Please see the attached cost estimate for details. Access to the roof is via and exterior caged ladder and a safety climb device is installed on the ladder, Site Conditions The tank is on an unpaved site enclosed by a chain link f~nce, There is adequate space for large equipment around the tank, assuming use of nonnal portable air compressor and related equipment. There are homes that would be adversely affected by dust and contamination associated with abrasive blast cleaning and painting operations, Residential streets arc near the site, Accordingly, extreme caution must be exercised duri~gail cleaning and painting operations. Existing Paint System Evaluation of Plant 39 A Tank East Valley Water District 1. This tank was recoated in 1994 and the specili')f ~ns indicated the paint system to be the following: a. Title 22 Heavy Metal Analyses Samples of exterior paints were removed for analyses for presence of heavy metals, specifically lead, chromium compounds and zinc. Iwalysis was accomplished by an approved Department of Health Services laboratory. E. Contract Information Harper & Associates Engineering, Inc. was retained 0:: the District to accomplish field investigation ofthe tank to observe exterior surfaces ar,,\ conditions with photographs taken to record conditions. Evaluation of Plant 39 A Tank East Valley Water District Exterior ladders do not meet OSHA regulation. Corrosion is present on the center ve¡,1 sòreening. There is no gap or àir break present in the overflow. No observations were formulated as ll1 the tank meeting current seismic codes. Based on the above noted observations, the following .:onclusions are drawn: 1. Exterior Surfaces a. b. Roof and Appurtenances 1) The overall condition of the paint system must be rated as fair to good. 2) Moderate oxidation (chalking) and fading offinish is normal for an alkyd paint system ofthis age. 3) Corrosion on the center vent cover and structure is typically the result of poor application techniques, as these irregular surfaces require brush application of th,; paint. Also the moist warm air passing through the vent cau:.cs a more corrosive condition. 4) The random mechanical dam:>ge on the roof is the result of personnel working on the roof or vandals throwing missiles on to the roof. Overtime corrosioa L.velops in the damaged areas. 5) Adhesion testing was performed by method ASTM D3359 Option A, illustrating marginal adheòiun of the paint. 6) Corrosion on the hatch curl; and LLI piping is the result of poor application techniques, as the configuration of theses surfaces requires brushing on the paint. Rusting, fouled or torn screening 011 vents is a violation of health and sanitation regulations. The lack of an air break in the overDOW pipe is a violation of health and sanitation regulations. v. LABORATORY TESTING OF COATING AND PAINT At the request of the District, samples of the paint v','re removed, by Consultant, from exterior and interior surfaces. Samples were forwarded to testing laboratory for analyses. Reports were prepared on basis oflead, chromium and zinc concentrations. The test results are as follows: A. Exterior roof - Lead at 826 PPM is below H:e maximum allowable concentration of 1,000 PPM. Zinc at 2,935PPM is below the maximum allowable concentration of 5,000 PPM. No chromium compounds w :re detected. 1. Exterior shell. Lead at 82.6 PPM is below (,.~ maximum allowable concentration of 1,000 PPM. Zinc at 2,616 PPM is below t~e :naximum allowable concentration of 5,000 PPM. No chromium compounds were detected. 2. B. The levels of lead, chromium compounds and zinc nn all exterior surfaces are below the allowable concentrations or were not detected, thereîore removal operations on the exterior surfaces do not need to be classified as a hazardous mQ;~rials/waste project. The process for working with heavy metal based '.";ë:ings and paints and for final determination of spent abrasive as hazardous waste is f.S 'ollows: 1. 2. 3. All personnel working on and around site .aust strictly adhere to OSHA and NIOSH regulations for working with lead pai 'Is. Regulations include personnel biological testing and monitoring of workcis air and air in vicinity of site. Inclusively, regulations outlined in 29 CFR Part 1926 and Cal-OSHA Title 8 must be strictly adhered to. Paints must be removed by vacuum blasting, or by conventional methods with total containment of tank, or by grit blasting with total containment and recovery of abrasive, partial containment in areas wh'~re water blast cleaning is being accomplished. Other methods, which remove the coating and paint without any abrasive, include the following: a.,':' Roto peening with dust collector outlet attachment and vacuum: this method propels a tungsten carbide tipped flap assembly and performs like a controlled shot blasting system. A minimum of 8" clearance is required in most cases. This method dramatica':y reduces the cost of hazardous waste operations, because only the paint is bulked for handling and disposal. However, this method leaves an irregular profile, generally . necessitating the abrasive blasting of the surface with a conventional abrasive after completion of the pow~r tool cleaning. b. Needle scaler with dust collector "utlet attachment and vacuum: this method propels a series of steel needles against the surface. Unlike the Roto Peener, this method is also used for corners, around fittings and other restricted areas. This method also dramatically reduces the cost of hazardous waste operations as only the paint is bulked for handling and disposal. However, this method leaves no surface profile, necessitating the abrasive blasting of the surface wilh a conventional abrasive after completion of the power tool cleaning. c. Water blast cleaning with bicarbonate vf soda abrasive: This method is new and unseasoned, so with this meflod water containing the removed paint particles must be collected otfore it touches the ground or surrounding surface. Contaminated wa:orthen requires settling of particles and removal of residual waste, or d :sposal of the total sum as hazardous waste. AdditiDnally, the blast cleaning leaves no profile in the steel, necessitating the abrasive blasting of the surface with a conventional abrasive after completion of the witter blasting. d. Chemical Stripping System: This metllDd applies a chemical paint stripper to the surfaces, and after a number of hours is peeled off, removing the paint with the stripper. As with the \':ater blast method, this method leaves no profile in the steel, necessitating the abrasive blasting ofthe surface with a conventional abrasive after compktion of the stripping operations. Evaluation of Plant 39 A Tank East Valley Water District Upon completion of coating and paint removal from tank s'.lrfaces, a representative sample of the spent abrasive, with the r~moved coating and p~int particles within the abrasive, is taken and sent to an approved testing laboratory for test¡:1g under Title 22 and Land Ban requirements. E. Iftests indicate the spent abrasive with removed coating a!ld paint particles is not hazardous, wastes can be disposed of in a local Class III or unclassified dump, regardless of presence of heavy metal coating or paint particles. However, t!te local Regional Water Quality Control Board which has jurisdiction over the landfill may require further testing to ensure the waste does not violate any of their local regulations. This could result in the waste being classified as a Designated Waste, which requires disposal at a Class II landfill. F. If tests still indicate excessive levels of lead or zinc, spent abrasive must be placed in approved containers, be removed to an approved Clafs I landfill via a licensed hazardous waste transporter, and disposed of in strict conformance to Title 22 and Land Ban regulations. G. The District can eliminate the landfill disposal requirement by specifying the use of an additive in the abrasive which will render the heavy meta: waste non-hazardous. The waste can then be incinerated or encapsulated in concrete o. '),:Ier binder-type materials, thereby eliminating the City's "cradle to grave" responsibi:i:y created by the landfill disposal method. PLEASEREMEMBER:THEOWNEROFTHETA~KiSALWAYSTHEGENERATOR OF THE HAZARDOUS WASTE!!!!!!!!!! This liability ~annot be transferred to any other party involved in the project, regardless of the contract provisions or specification requirements. The City can meet its responsibility to properly and legally handle and dispose ofthe toxic or hazardous wastes generated by the surface preparation requirements of a project by including this work as part ofthe work to be accomplished by the Contractor on the project. Therefore it is recommended that the District repaint the exterior surfaces to repair random rusting areas and overcome ti,e chalking and fading appearance. Because of the changes in the VOC reguiations and the new coatings used on the exterior surfaces, it will be necessary to brush-off blast clean the exterior surfaces in accordance with SSPC-SP7. Rusting spots on the roof and shell should be spot vacuum blast cI~aned or spot vacuum power tool cleaned to SSPC-SPIO, a full coat of epoxy primer applied, an epoxy intermediate coat and urethane finish GO~t applied to all surfaces. I) Prior to application of new p&;n~ system, it would be advisable to accomplish additional adhe~iJI1 testing and application of test samples of new paint to en~u.e good adhesion of new paint to existing finish. b. The asphalt covering over the BPE retains water against the BPE. It is recommended that the district potho:e around the tank to examine the condition of the BPE. Safety, Health & Code Features a. Vertical surfaces below the water level were investigated by diving the tank and traversing the bottom and perìmetcl or the tank. Light was supplied via high intensity portable light and natural light from roof hatch and center vent. Various chipping tools were employed to examine typical areas of defective coating and corrosion within reach. Based on the above noted observations, the following cOtdusions are drawn: 1. Exterior Surfaces a. 5) b. Roof and Appurtenances 1) The overall condition of the paillt system must be rated as fair to good. 2) Moderate oxidation (chalking) and fading offinish is nonnal for an alkyd paint system of this age. 3) Corrosion on the center vent co"er and structure is typically the result of poor application techniques, as these irregular surfaces require brush application of the ¡Jaint. Also the moist warm air passing through the vent causes a more corrosive condition. 4) The random debris and mechal,ical damage on the roofis the result of personnel working on the roof or vandal throwing missiles on to the roof. Overtime corrosion will develop in the damaged areas. Adhesion testing was performed by method ASTM D3359 Option A, illustrating marginal to fair adhesion of the paint. 6) Ponding is the result of poor original construction of the tank. The ponding allows water and debris to remain on the roof surface longer which accelerates the "ùrrosion process and can cause the topcoat to delaminate. 7) Corrosion on the auxiliary hatch, LLI piping, roof hatch, and handrailing is the result of pOD. application techniques, as the configuration of theses surfaces requires brushing on the paint. Shell, Ladder and Appurtenances 1) Conclusions and comments noted above for roof surfaces generally apply to ihese surfaces. 2) Corrosion present on the ladder, vandal guard, overflow, inlet/outlet, and manhole is the result of poor application techniques as the painters ,'ftcn do not brush these irregular surfaces. 3) The staining on the top angle is the result of the water and dirt running off of the roof and collecting under the top angle. 4) Coating runs present on the shell are the result of poor application Harper & Associates Engineering, Inc. Dirt and debris hold moisture on the surface longer which accelerates the corrosion process. Underside ofRoofanå Structural Me,,"lbers The overall condition of the coating on the roof plates and structural members must be ra\ed as poor. 2) Overall n. c coating is in poor condition with several large areas of cracked evating with corrosion present. The coating is about 23 years old and this coating typically has a life expectancy of20 to 25 years. Even though the coating has basically reached the life expectancy, the large areas ~f cracked coating and corrosion is excessive. 3) Corrosion present at the center npport column and adjacent rafters is the result of these surfaces nl): being properly coated originally and the moist warm air passing through the vent causing a more corrosive .condition. 4) Delamination of the coating ort the roof plate is probably due to contaminants between coats ouring application process. 5) The twisted rafter is either the r. ,suit of seismic activity generating a wave that makes contact with the support structure or poor original construction practic~ of forcing the rafter into the desired position. 6) The blistering on the sheil IS cither the result of poor surface preparation, the presence of noisture or contaminates on the surface at the time the coati"g was applied. Shell and Appurtenanccs I) The overall condition ofthe coatie,; on the shell and appurtenances must be rated as poor. 2) Severe corrosion present on the .'l'ety climb rail is probably the result of these surfaces never being coated 3) As noted ahove, the solvent cut b,.ck coal tar coating on the upper shell has e;(ceeded the life expectancy. The severe cracked coating and corro5'on on the shell is a result of this being the most severe environmcnt within the tank. Tilt: :1Ot/cold and wet/dry cycle of the shell caused by the weather and ""tier fluctuations tends to dry out the coating causing it to become orittle and crack, 4) Random blistering on the shell ar,d column is probably the result of contamination or moisture preoent on the surface during coating application. 5) Corrosion present at the edges and inner circumference of the lower shell penetrations, inlet!c"tlet and manholes is typical as these areas are difficult to cont and often are not thoroughly holiday detected to identify the existing coating defect. Bottom Surfaces and Appurtenances I) The overall condition of the botbm surfaces and appurtenances must be rated as fair where surfaces could be observed. 2) Corrosion present on the inner ~ircumference of the drain and , bottom of the LLI guide wires ¡, .robably due to poor application techniques, as the configuration of these members requires due diligences on the part of the appiìcator. 3) Random tubercles on the bottom are the result of not electrically detecting the bottom thorough:y prior to acceptance of the project as complete. 4) The cracking of the coating is r. result of the age of the coating and possibly overheating the enamel during the original application. Overheating the enamel cooks the oils out of the product leading to premature deterioration as 6e ~namel becomes brittle and cracks exposing the substrate to the corrosion process. 3. Rusting, fouled or torn screening on veats is a violation of health and sanitation regulations. d. Interior and exterior ladders are undersized for current OSHA regulations. e. The lack of an air break in the overflow pipe is a violation of health and sanitation regulations. LABORATORY TESTING OF COATING AND PAINT A. B. c. D. At the request of the District, samples of the paint were removed, by Consultant, from exterior and interior surfaces. Samples were forwarded to testing laboratory for analyses. Reports were prepared on basis oflead, chromium and zinc concentrations. The test results are as follôws: 1. Exterior roof - No lead was detected. Zinc at J 4,540 PPM is above the maximum allowable concentration of 5,000 PPM. No chromium compounds were detected. 2. Exterior shell - No lead was detected. Zinc at 8,420 PPM is above the maximum allowable concentration of 5,000 PPM. No chromium compounds were detected. 3. Interior roof- No lead was detected. Zinc at 44.; PPM is below the maximum allowable concentration of 5,000 PPM. No chror. '¡um compounds were detected. 4. Interior rafter - No lead was detected. Zinc at 18.1 PPM is below the maximum allowable concentration of 5,000 PPM. No chromium compounds were detected. 5. Interior shell - Lead at 360 PPM is below the Ilux:mum allowable concentration of 1,000 PPM. Zinc at 76.8 PPM is below the ffiax:mum allowable concentration of 5,000 PPM. No chromium compounds were Óiected. 6. Interior bottom - Lead at 206 PPM is below the maximum allowable concentration of 1,000 PPM. Zinc at 39.9 PPM is below the ",..ximum allowable concentration of 5,000 PPM. Chromium compounds at 21.3 PPM are below the maximum allowable concentration of3,065 PPM. The level ofzinc on the exterior surfaces are above the allowable concentrations, therefore paint removal operations on the exterior surfaces will be classified as a hazardous materials/waste project. The levels of lead, chromium compounds and zinc on all interior surfaces are below the allowable concentrations or were not detected, therefore rzmoval operations on the interior surfaces do not need to be classified as a hazardous ntatcrials/waste project. AIl personnel working on anJ around site must strictiy adhere to OSHA and NIOSH regulations for working with lead paints. Regul¡¡tio:ls include personnel biological testing and monitoring of worker's air and air ¡" vicinity of site. Inclusively, regulations outlined in 29 CFR Part 1926 and Cal-OSHA Title 8 must be strictly adhered to. Paints must be removed by vacuum blasting, or by conventional methods with total containment of tank, or by grit blasting with total containment and recovery of abrasive, partial containment in areas where water blast cleaning is being accomplished. Other methods, which remove the coating and paint without any abrasive, include the following: a. Roto peening with dust collector outlet attachment and vacuum: this method propels a tungsten carbide tipped :lap assembly and performs like a controlled shot blasting system. A n.iDÌ!1lllm of 8" clearance is required in most cases. This method dramaticaliy reduces the cost of hazardous waste operations, because only the t;~i"t is bulked for handling and disposal. However, this method leaves an irregular profile, generally necessitating the abrasive blasting of the surface with a conventional abrasive after completion of the power tool cleaning. b. Needle scaler with dust collector outlet attachment and vacuum: this method propels a series of steel needies against the surface. Unlike the Roto Peener, this method is also used for corners, around fittings and other restricted areas. This method also dramatically reduces the cost of hazardous waste operations as only the paint is bulked for handling and disposal. However, this method leaves no surface profile, necessitating the abrasive blasting of the surface wi:h a conventional abrasive after completion of the power tool cleaning. c. W'lter blast cleaning with bicarbonate of soda abrasive: This method is new and unseasoned, sO with this mç(r.od water containing the removed paint particles must be collected be [ore it touches the ground or surrounding surface. Contaminated wate:' then requires settling ofparticles and removal of residual waste, or disposal of the total sum as hazardous waste. Additionally, the blast cleaning leaves no profile in the steel, necessitating the abrasive blasting of lhe surface with a conventional abrasive after completion of the water:' ."sting. d. Chemical Stripping System: This method applies a chemical paint stripper to the surfaces, and after a number of hours is peeled off, removing the paint with the stripper. As with the water blast method, this method leaves no profile in the steel, necessitating the abrasive blasting of the surface with a conventional abrasive after complet:on of the stripping operations. Upon completion of coating and paint removal from tan:' ~ urfaces, a representative sample ofthe spent abrasive, with the removed coating and pc,:nt particles within the abrasive, is taken and sent to an approved testing laboratory for testi:!g under Title 22 and Land Ban requirements. F. If tests indicate the spent abrasive with removed coatinga¡, ! paint particles is not hazardous, wastes can be disposed of in a local Class III or unclassified dump, regardless of presence of heavy metal coating or paint particles. However, the local Regional Water Quality Control Board which has jurisdiction over the landfill may require further testing to ensure the waste does not violate any of their local regulations. III is could result in the waste being classified as a Designated Waste, which requires dispùsai at a Class II landfill. G. If tests still indicate excessive levels of lead or zinc, f.,cnt abrasive must be placed in approved containers, be removed to an approved Class I landfill via a licensed hazardous waste transporter, and disposed of in strict conformao;ce to Title 22 and Land Ban regulations. H. The Districtcan eliminate the lanùfill disposal requirement by specifying the use of an additive in'the abrasive which will render the heavy metal waste non-hazardous. The waste can then be incinerated or encapsulated in concrete or ether binder-type materials, thereby eliminating the City's "cradle to grave" responsibili:y created by the landfill disposal method, I. PLEASE REMEMBER: THE OWNER OF THE TANK IS AL WAYS THE GENERATOR OF THE HAZARDOUS WASTE!!!! I!!!!! This liability cannot be transferred to any other party involved in the project, regardless of the conl,~ct provisions or specification requirements. The City can meet its responsibility ~o properly and legally handle and dispose of the toxic or hazardous wastes generated by the surface preparation requirements of a project by including this work as part of the work:o lJe accomplished by the Contractor on the project. This work includes, but is not limited lO ¡he following: 1. Obtaining all permits and EPA numbers, for ;I'e !)istrict 2. Processing all related project paperwork 3. Blood tes'.ing of all involved personnel 4. Sampling and testing of waste as required s. Bulking, packaging and storing waste atjobsite 6. Using licensed hazardous waste transporters to deliver the hazardous wastes to their ultimate legal disposal site RECOMMENDA TrONS A. The exterinr surfaces are in generally fRir to good condjtion except for ranùom spots of corrosion and mechanical damage present. Therefore the District may want to repaint the exterior surfaces when the interior is recoated to repair random rusting areas and overcome the chalking and fading appearance. Because of the chanbc3 in the VOC regulations and the new paints used on the exterior surfaces, it will be necessary to brush-off blast clean the exterior surfaces in accordance with SSPC-SP7. Rusting spots on the roof and shell should be spot vacuum blast cleaned or spot vaouum power tool cleaned to SSPC-SPII, a full coat of epoxy primer applied, an epoxy intermediate coat and urethane finish coat applied to all surfaces. I) Prior to application of new paint .,ystem, it would be advisable to . accomplish additional adhesion testing and application of test samples of new paint to ensure good adhesion of new paint to existing finish. b'. The vegetation at the bottom plate extension(BPE) should be removed and the District should schedule regular maintenance to keep the vegetation away from the BPE. Interior Roof, Structural Members and Shell a. As noted above, typically the solven~ cutback coal tar coating system has a twenty to twenty five year life cyc1~ and this coating is reaching the end of the life cycle, The roof surfaces are already exhibiting metal loss on the rafter flanges. Therefore it is recommended all interior roof and shell surfaces should be abrasively blast cleaned to Near White Metal (SSPC- S1'10) and apply a three-coat epoxy coating to a total dry film thickness of i 5.0 mils on surfaces above the bottcm, Interior Lottom a. The bottom surfaces appear to be in fa.ir condition and typically coal tar enamel has a life cycle of 50 to 15 years, but it is impossible to determine the exact condition of the coating w:,hout removing the silt. In addition it is impossible to determine how brittle the coating is without draining the reservoir. It may be possible to spot repair and overcoat the coal tar enamel on the bottom, but it can not be determined for sure until the reservoir is drained, b. The technical specification can be prepared based on the bottom being spot abrasively blast cleaned to Near White (SSPC-SPIO), and complete surfaces Brush-off Blast Cleaned (SSPC-SP7) to remove surface contaminants, Exposed metal would be spot primed with a coal tar adhesive and complete surfaces would receive a 3/32" of coal tar enamel coating applied to the bottom surfaces and 6" onto the shell. An air break should be installed in the exterior overflow pipe. f. As the tank is over twenty years of age, a possibility exists the tank will not m~et current seismic codes. An evaluation should be accomplished by an experienced tank structural engineer to e¡¡able rendering a decision as to the seismic reliability ofti,e structure. A. Based on current and previous projects of similar scopc, preliminary cost estimates for work as noted in RECOMMENDATIONS, were calculated ry using data from those projects. 1. 2. 3. Brush-off blast cleaning of exterior surîaces, spot abrasive blast cleaning v:a vacuum method or power tool cleaning to SSPC-SPII, priming and application of an epoxylurethane paint system would be in the range of $40,840 to $49,008, based on surfaces being classified as a hazardous materials/waste project. b. Abrasive blast cleaning of complete exterior surfaces and application of an epoxylurethane paint system to complete exterior of tank would be approximately $106,185, based on surfaces being classified as a hazardous materialslwaste project. This estimate is not a recommendation, but is furnished for comparative cost purposes. Interior Roof, Structural Members and Shell a. Abrasive blast cleaning of interior surfaces and application of 15 mils of c;>oxy coating to interior roof and she;; surfaces will be in the cost range of $73,219 to $85,422, based On surfac-òs being classified as a non-hazardous rnaterials/waste project. In the Lower Basin, virtually every drop of the river is allocated and yet demand is growing. How the Lower Basin states - Arizona, California ànd Nevada - use and manage this water to meet agricultural, urban, environmental and industrial needs is the focus of this tour. The tour travels along the Lower Colorado River from Hoover Dam to the Salton Sea and the Coachella ValÌey. The tour is a must for water policy-makers, water district managers and directors, lawyers, consultant~¡ journalists, and anyone interested in Colorado River issues.
