Director Lightfoot led the flag salute. PRESENT: Directors: Goodin, Lightfoot, Sturgeon, Wilson ABSENT: Negrete STAFF: Robert Martin, General Manager; Paul Dolter, District Engineer; Brian Tompkins, Chief Financial Officer; Justine Hendricksen, Administrative Assistant LEGAL COUNSEL: Steve Kennedy GUEST(s): Jo McAndrews, Charles Roberts (Highland Community News), Munira Syede (The Sun Newspaper) APPROVAL OF AGENDA MIS/C (Sturgeon-Goodin) that the April 26, 2005 Agenda be approved as submitted. PUBLIC PARTICIPATION President Wilson declared the public participation section of the meeting open at 2:01 p.m. There being no written or verbal comments, the public participation section was closed. APPROVAL OF APRIL 12, 2005 BOARD l\fEETING MINUTES. MIS/C (Lightfoot-Sturgeon) that the April 12, 2005 Board Meeting Minutes be approved as submitted. Minutes: 04/26/05 APPROVAL OF LIENS FOR DELINQUENT WATER AND SEWER ACCOUNTS The General Manager stated that the charges idèntified by Account Number: 0730011-00 had been paid and should be removed from the lien list. MIS/C (Lightfoot-Sturgeon) that the liens for delinquent water and sewer accounts be approved for processing with the exception aslloted by the General Manager. DISBURSEMENTS MIS/C (Lightfoot-Sturgeon) that General Fund Disbursements #201272 through 201469 distributed during the period of April 8, 2005 through April 21, 2005 in the amount of $590,286.13 and Payroll Fund Disbursements for the period ended April 15, 2005 and March 31, 2005 in the amount of $101,178.24 and $5,000.000 totaling $696,464.37 be approved. RADON RULE/PERCHLORATE RULE UPDATE The General Manager stated that he had no updates at this time for the Radon Rule or Perchlorate Rule. Information only. - DISTRICT HEADQUARTERS REVIEW AND UPDATE The General Manager stated that final plans should be submitted to the City of San Bernardino in April. DISCUSSION AND POSSmLE ACTION REGARDING DISTRICT ADVERTISEMENT IN THE SAN BERNARDINO CONVENTION & VISITORS BUREAU No action taken. DISCUSSION AND POSSmLE ACTION REGARDING DISPOSAL OF SURPLUS EQUIPMENT The General Manager concurs with staff's recommendation that the following equipment be declared surplus and said products to be sold at public auction. (Vehicle #37, 30, 18 and a non-operable engine analyzer) MIS/C (Sturgeon-Goodin) that the equipment described by staff be declared surplus and that staff be authorized to sell said products at public auction. 2 Minutes: 04/26/05 DISCUSSION AND POSSmLE ACTION REGARDING CLAIM FOR WRONGFUL DEATH, PERSONAL INJURIES, ON JANUARY 10, 2005 IN THE VICINITY OF BASELINE STREET AND THE CITY CREEK CROSSING, mGHLAND, CA, FROM DANIEL MARTINEZ, was presented to the Board. Director Sturgeon suggested the District request a copy of the investigation report regarding the incident. MIS/C (Sturgeon-Lightfoot) that the Claim for Damages by Daniel Martinez be denied and referred to District's Legal Counsel and Insurance Agency. DISCUSSION AND POSSmLE ACTION REGARDING AN EAST VALLEY WATER DISTRICT WATER QUALITY CONFERENCE FOR 2006 The General Manager commented on the Water Quality Conference that the District hosted in 2004; that the conference dealt with emerging water quality issues throughout the Country; that he requests the Board's direction on whether they are interested in hosting a 2006 Water Quality Conference. MIS/C (Sturgeon-Lightfoot) that. the . District host a 2006 Water Quality Conference. DISCUSSION AND POSSffiLE ACTION REGARDING THE APPROVAL OF ARTICLES OF ASSOCIATION FOR THE UPPER SANTA ANA WATER RESOURCES ASSOCIATION MIS/C (Lightfoot-Goodin) that the Articles of Association for the Upper Santa Ana Water Resources Association and the Acceptance of Terms of Membership and Designation of Member and Alternate letter be accepted and approved. FINANCIAL STATEMENTS FOR PERIOD ENDED MARCH 31, 2005 were presented to the Board for review. MIS/C (Lightfoot-Goodin) that the Financial Staternents for period ended March 31, 2005 be accepted. INVESTMENT REPORT FOR QUARTER ENDED MARCH 31, 2005 The Investment Report for Quarter ended March 31, 2005 was reviewed. Information only. Minutes: 04/26/05 GENERAL MANAGER'S REPORT The General Manager reported on the District's operations to date; that he suggested professional photos be taken of the Board and Senior staff; that the District has purchased a new generator for ernergency power; that the District is co-sponsoring an Emergency Response Training and table top exercise with the Environmental Protection Agency (EPA) and the California-Nevada Section' American Water Works Association (Cal-Nev A WW A) on May 25-26, 2005. Information only. ORAL COMMENTS FROM BOARD OF DIRECTORS Director Sturgeon suggested that photos of current and previous employees and directors be displayed at the District Headquarters. Director Goodin requested an update regarding the Seven Oaks Dam. President Wilson commented that he was the keynote speaker at the San Bernardino Chamber of Commerce luncheon on April 26th. There being no further verbal or written comments from the Directors, this section of the meeting was closed. Information only. The following roles and regulations related to public access for inspection and copying of District records are hereby adopted pursuant to Government Code Secti~n 6253( e): A. All District records and documents not deemed to be exempt under the California Public Records Act ("the Act"), California Government Code Section 6250 et seq., shall be open to the public for inspection and copying pursuant to the requirements of the Act and the procedures established herein. B. Any person who wishes to inspect or copy any document or record of the District shall submit or unequivocally convey such a request to the District which reasonably and particularly describes an existing and identifiable record. The person seeking the record may, but need not, state his or her reason for making the request and/or the use to which the information will be put. C. When a member of the public requests to inspect a public record or obtain a copy of a public record, the District, in order to assist the member of the public make a focused and effective request that reasonably describes an identifiable record or records, shall perform all of the following, to the extent reasonable under the circumstances: (1) Assist the member of the public to identify records and information that are responsive to the request or to the purpose of the request, if stated; (2) the records exist; and Describe the information technology and physical location in which (3) Provide suggestions for overcoming any practical basis for denying access to the records or information sought. D. If the District receives a request for approved minutes, publicly-posted agendas, adopted budgets, and/or other simple, routine, and otherwise readily-available documents in the District's immediate possession, said records shall be released to the party so requesting for inspection as soon as possible. If copies thereof are requested, said records shall be released to the party so requesting as soon as possible after payment of the fee adopted by the District pursuant to Section I.H. hereof. RESOLUTION NO. Page Two E. All requests for records that are outside the scope of Section 1.D. hereof shall be reduced to written form. The District shall furnish the requesting party with a standard form for his or her convenience in describing the records sought, but the use of that form shall not be the exclusive means by which a member of the public may identifY said documents in writing. If the requesting party refuses or is unable to submit a request in writing, the District shall prepare a written memorandum articulating the request as it is understood. F. Within ten (1 0) days afterreceiptof arequest to inspect or copy any document or record of the District identified in the writing prepared pursuant to Section I.E. hereof, the District shall determine whether the request, in whole or in part, seeks copies of disclosable public records in the possession of the District, and shall immediately notifY the person making the request of such determination and the reasons therefor. G. Under unusual circumstances as defined in the Act, the time limit prescribed in Section I.F. hereof may be extended by written notice by the General Manager of the District, or his or her designee, to the person making the request setting forth the reasons for the extension and the date on which a determination is expected to be dispatched. No such notice shall specifY a date that would resnlt in an extension for more than fourteen (14) days. H. If the District determines that the records requested shall be made available for public inspection or copying, the District shall promptly make the records available to the requesting party. If copies are requested, the District shall promptly provide copies of the records to the requesting party upon payment of a fee to cover the District's direct cost of duplication, which shall be calculated in the following manner: (1) If the copies are made by the District's staff, the amount of the fee to be paid to the District by the requesting party shall be twenty-five cents ($.25) per page, or three dollars and fifty cents ($3.50) per page for maps and/or oversize (2' x 3') documents, which sum covers the cost of running the equipment from which the copy is produced and the expense of the person operating it, but does not include the ancillary tasks necessarily associated with the retrieval, inspection, and handling of the file from which the record is extracted for reproduction. (2) If the records for which copies are requested are being held by consultants of the District, including the District's legal counsel, the direct cost of duplication shall be no different than the fee established pursuant to Section l.H.(I) above. (3) If the size, quantity, or unique nature of the records for which copies are requested is such that the District determines in the reasonable exercise of its discretion that the reproduction thereof shonld not be conducted by District staff or consultants, then the District shall attempt to coordinate a mutually-acceptable alterna~ve arrangement with the requesting party. No RESOLUTION NO. Page Three such arrangement shall pennit a copying protocol that would expose any District records to being permanently removed, damaged, defaced, or destroyed. If the District is unable to reach such an agreement with the requesting party, then the District shall send said records to a printer or commercial copying service for reproduction and the direct cost of duplication shall be the same amount that is charged by the printer or commercial copying service for the services so performed. I. If the District determines that the records requested shall not be made available for public inspection or copying, the District shall justify withholding any record by demonstrating that the record in question is exempt under the Act, that the District is unable to identify the information requested in the writing prepared pursuant to. Section I.E. hereof after making a reasonable effort to provide the assistance described in Section loC. hereof and elicit additional clarifying information from the requester that would help identify the record or records, or that, based on the facts of the particular case, the public interest served by not making the record public clearly outweighs the public interest served by disclosure of the record. Any notification of denial of any request for records shall set forth the names and titles of each person responsible for the denial. J. If the District determines that any part of an otherwise public record shall not be made available for public inspection or copying, any reasonably segregable portion of the record shall be provided to the person requesting such record after deletion of the portions which are exempt by law and upon (a) compliance with Section 1.H. hereof as to the portions released to the requesting party and (b) satisfaction of Section 1.1. hereof as to the portions deleted therefrom. Section 2. This Resolution supercedes Resolution No. 1998.4 adopted by the Board of Directors of the District on March 9, 1998. This Resolution will be reviewed and revised as deemed appropriate by the District's Board of Directors. Section 3. This Resolution shall take effect immediately upon its adoption. Last year, as in years past, your tap water met all Environmental Protection Agency (EPA) and State drinking water healtli standards. East Valley Water District vigilantly safeguards its water supplies. We are proud to report that our system has never exceeded a Maximum Contaminant Level (MCL) or violated any other water quality standard. East Valley Water District currently services more than 66,000 residents within our 26 square mile service area through 272 miles of water mains. We have several high quality water sources from which we service our cus- tomers. Those sources include the Santa Ana River, the Bunker Hill Groundwater Basin, and the City of San Bernardino domestic water system. During dry years, when the water supplies mentioned above are short, the District has yet another alternative. We can obtain water from the State Water Project through the San Bernardino Valley Municipal Water District. The District draws water from the Bunker Hill Groundwater Basin through eighteen active groundwa- ter wells. These wells are scattered throughout the District: from the wilderness east of Cone Camp Road (Plant 125) to our Park site at Lynwood Drive and Harrison Street (Plant 24); from the McDaniel Well (Plant 141) on Third Street to Mountain Avenue and Marshall Boulevard (Plant 25). We also have four groundwater wells that are currently inactive due to various water quality issues. (East Valley Water District is actively pursuing rehabilitation of two of those wells through testing and treatment technologies). Another high quality water source is the Santa Ana River, which originates high in the San Bernardino Mountains. It is diverted for our use at a point east of the Seven Oaks Dam, picked up at Southern California Edison's SAR #3 hydroelectric plant, and transported via the North Fork Canal to our Philip A. Disch Surface Water Treatment Plant. ' Water from the City of San Bernardino domestic water system is received at our Plant #107 Well site (Citrus St., between Mountain Ave. and Lorna Ave.). The City's water is blended with our water to reduce the nitrate levels produced by our Well #107. Before blending, the maximum nitrate level at Well #107 was 46 parts per million (ppm) compared to a Maximum Contaminant Level (MCL) of 45 ppm. Once blended with the City's water, the nitrate level at Well #107 is decreased to a safe, and manageable, 37 ppm or less. We also obtain Northern California water that is made available to us through the State Water Project which is managed by the State Department of Water Resources and the San Bernardino Valley Municipal Water District. Regional water, acquired from the Santa Ana River and the Bunker Hill Groundwater Basin, is the preferred source of water for the community. Our Board of Directors meet on the second and fourth Tuesday of every month at 2:00 p.m. The meetings are held at the main office located at 3654 Highland Avenue, Suite 12. As water travels over the surface of the land or through the ground it dis- solves naturally occurring minerals and, in some cases, radioactive material. It can also pick up substances resulting from the presence of animals or from human activity. Contaminants that may be present in source water include: ' Microbial contaminants, such as viruses and bacteria, may come from sewage treatment plants, septic systems, agricultural livestock operations or wildlife. Radioactive contaminants, which can be naturally occurring or be the result of oil and gas production and mining activities. Inorganic contaminants, such as salts and metals, can be naturally occurring or result from urban stormwater runoff, industrial or domestic wastewater discharges, oil and gas production, mining or farming. Pesticide and herbicides, which may come from a'vari- ety of sources, such as agriculture, urban storm water runoff, and residential uses. Organic chemical contaminants, including synthetic and volatile organic chemicals, that are byproducts of industrial processes and petroleum production, and can also come from gas stations, urban stormwater runoff and septic systems. Water Quality Data Drinking water, including bottled water, may reason- ably be expected to contain at least small amounts of some contaminants. The table below lists all the drink- ing water contaminants that we detected in our water system during the 2004 calendar year. The presence of these contaminants in the water does not necessarily mean that the water poses a health risk. Unless other- wise noted, the data presented in this table is from test- ing done between January 1 - December 31, 2004. Such nitrate levels in drinking water can interfere with the capacity of the infant's blood to carry oxygen, result- ing in a serious illness. Symptoms include shortness of breath and blueness of the skin. Nitrate levels above 45 ppm may also affect the ability of the blood to carry oxygen in other individuals, such as pregnant women and those with certain specific enzyme deficiencies. Nitrate levels may rise quickly for short periods of time because of rainfall or agricultural activity. If you are caring for an infant or are pregnant, you should ask for advice from your health care provider. Radon is a radioactive gas that you can't see, taste or smell. It is found throughout the United States. Radon can move up through the ground and into a home through cracks and holes in the foundation. Radon can build up to high levels in all types of homes. Radon can also get into indoor air when released from tap water while showering, washing dishes, and other household activities. Compared to Radon entering the home through the soil, Radon entering the home through tap water will, in most cases, be an extremely small source of Radon in indoor air. Radon is a known human car- cinogen. Breathing air that contains large amounts of Radon can lead to lung cancer. If you are concerned about the Radon in your home, have the air in your home tested. Testing is inexpensive and easy. You should have your home repaired if the level of Radon in your air is 4 Pico Curies per liter of air (pO/L) or higher. There are simple ways to fix a Radon problem that are relatively inexpensive. For additional information, call your State Radon Program or call EPA's Radon Hotline (800-767-7236). Arsenic levels above 5 parts per billion (ppb) up through 10 (ppb): While your drinking water meets the current standard for Arsenic, it does contain low levels of this contaminant. The Standard balances the current understanding of Arsenic's possible health effects against the costs of removing Arsenic from drinking water. The Department of Health Services (DOHS) con- tinues to research the health effects of low levels of Arsenic, which is a mineral known to cause cancer in humans at high concentrations and is linked to other health effects such as skin damage and circulatory prob- lems. Cryptosporidiurn is a microbial pathogen found in sur- face water throughout the U.S. Although filtration removes Cryptosporidium, the most commonly used fil- tration methods cannot guarantee 100 percent removal. Current test methods do not allow us to determine if the organisms are capable of causing disease. Ingestion of Cryptosporidium may cause Cryptosporidiosis, an abdominal infection. Symptoms of infection include nausea, diarrhea and abdominal cramps. Most healthy individuals can overcome the disease within a few weeks. However, immuno-compromised people are at greater risk of developing life threatening illness. We encourage immuno-compromised persons to consult their doctor regarding appropriate precautions to avoid infection. Cryptosporidium must be ingested to caude disease, and it may be spread through means other than drinking water. Perchlorate is both a naturally occurring and a man- made chemical. Most of the Perchlorate manufactured in the United States is used as the primary ingredient of solid rocket propellants, fireworks and explosives. It also has a variety of industrial uses, such as a compo- nent of air bag inflators amongst others. Perchlorate interferes with iodide uptake into the thy- roid gland. Iodide is needed for the production of thy- roid hormones, which are necessary for normal prenatal and postnatal growth and development. Therefore, fetuses, infants and children are at risk if their thyroid glands cannot function normally. In adults, thyroid hor- mones are needed for normal body metabolism. It is "unregulated" because it has no MCL at this time. For contaminants found in drinking water that lack MCL's, the DOHS uses advisory Action Levels (ALs) to protect customers from their adverse health effects. In an effort to keep our water customers continually informed on issues that may affect them, we are follow- ing the DOHS recommendations to notify you regarding the possibility that some water containing Perchlorate, at levels slightly above the new action level, will be delivered through our system. Several of our wells have been found to contain this chemical at levels that exceed the State of California Department of Health Services' Action Level (AL) of 4 ppb. Concentrations in water samples from the affected wells ranged from <4.0 ppb to 11 ppb. These levels were found in sampling conducted in 2003, as a result of state requirements for Perchlorate monitoring. Although some wells have concentrations over 4 ppb, DOHS does not recommend removing them from service until the concentration levels reach 40 ppb. NOTE: Office of Environmental Health Hazards Assessment (OEHHA) established its Public Health Goal (PHG) for Perchlorate in March 2004. The PHG - (6 parts per billion - ppb) - will contribute to DOHS' MCL determination process. To protect consumers until an MCL is in place, DOHS will now use a 6-ppb Action Level, instead of the 4 ppb Action Level it used previously. State law requires all public water systems to notify local governing bodies (for example, the Board of Directors or the city council) whenever a well exceeds an Action Level or a drinking water standard. Our staff has provided this information to the East Valley Water District's Board of Directors.' The District also sent this information to the Council Persons at the Cities of San Bernardino and Highland in addition to the San Bernardino County Supervisors. Lead: Infants and young children are typically more vulnerable to Lead in drinking water than the general population. It is possible that Lead levels at your home may be higher than at other homes in the community as a result of materials used in your home's plumbing. If you are concerned about elevated Lead levels in your home's water, you may wish to have your water tested. Flushing your tap for 30 seconds to 2 minutes before using tap water may lower the Lead content. Additional information is available from the Safe Drinking Water Hotline (800-426-4791). In order to ensure that tap water is safe to drink, the United States Environmental Protection Agency (USEPA) and the California Department of Health Services (DOHS) prescribe regulations that limit the amount of certain contaminants in water provided by public water systems. We are required to treat our water according to the DOHS regulations (California's Department of Health Services' regulations are the same or more stringent than USEPA's regulations). DOHS regulations also establish limits for contaminants in bot- tled water that must provide the same protection for public health. Some people may be more vulnerable to contaminants in drinking water than the general population. Immuno-compromised individuals such as persons undergoing chemotherapy, persons who have under- gone organ transplants, people with HIV / AIDS or other immune system disorders, some elderly, and infants can be particularly at risk from infections. These people should seek advice about drinking water from their health care providers. USEPA/Centers for Disease Control (CDC) offer guidelines on appropriate means to lessen the risk of infection by Cryptosporidium and other microbial contaminants. These guidelines are available by calling the Safe Drinking Water Hotline (800-426-4791). Preventing contamination is the key to keeping water supplies safe. Once a drinking water supply becomes contaminated, a community is faced with the difficult and costly task of installing treatment facilities or locat- ing an alternative source. You can help protect our pre- cious water supply by disposing of harmful household products and other toxic chemicals in the proper manner. Household hazardous waste includes, but is not limited to, cleaners, glues, soaps, pesticides, paints, fertilizers, medicines, chlorine, motor oil and batteries. Never dump these wastes down the drain, in the trash or on the ground. Instead, take them to a hazardous waste collection or recycling center. Only certified employees operate, monitor and regulate the wells, reservoirs and treatment plants that make up your water system. Our Water Quality Technicians must also possess and maintain state certification in water treat- ment. To ensure that the water you drink meets all State and Federal standards for domestic drinking water, we collect and test more than 1000 water quality samples throughout the water system each year.
