DISTRICT HEADQUARTERS REVIEW AI+iD SITE UPDATE
The C~eneral Manager updated the Boazd on the Headquarters Project; that a meeting is being set
to discuss traffic issues and review site plan. Information only.

DISC:USSION AND POSSIBLE ACTION REGARDING EAS'T VALLEY WATEI~
DIST'RICT'S SAIVITARY SEWER NiANAGEMENT PLAN (SSMP) GAP APIALYSI5 was
presented to the Board for approval.
The General Manager stated that the Water Resources Control Board has established new
regul:itions to stop sewa~e overflows in Califomia and that the District has a program to meet
these new requirements.
Gary Stuxdivan reviewed the SSMP Gap Analysis in detail
The I~istrict Engineer also reviewed the SSMP Gap Analysis with information regarding the cost
to the District to meet the requirements.
Direc:tor Goodin requested the District res~azch economic<,l solutions to the requirements
M/S/C (Negrete-Wilson) that the District's Sanitary Sewer Management Plan by CDM
Engineering be approved.
DISCUSSION AND POSSIBLE ACTION REGARDING AUTHORIZATION TO
pREPARE AGEEMENTS WITH SHAREHOLDERS OF THE NORTH FORK wATER
COi1ZPANY REGARDING PAYMENT OF SPECIAL ASSESSMENTS FOR TAE
NORTH FORK PIPELINE REPLACEMEN'I' PROJECT
The General Manager stated that there would be some Federal assistance for this North Fork
Pipeline Replacement Project and the remainder of the cost would have to be bome by East
Valley Water District and the Shareholders of the North Fork Water Company; he recommends
that the East Valley Water District Board of Directors present an agreement to assist the North
Fork.. Shareholder in the costs with repayment from each shareholder; that the item will be
discussed as a group and he will report details to the Board of Directors

CONSULTANTSREPORTS
Jo McAndrews commended the Jeneral Manager for a great job in representing the District at
the Natural Resources Water znd Power Subcommittee; that she had received ;nformation from
Janet Hartin, University of California regazding landscape grants and would like to par[ner wi~h
the L~istrict for the new District headquarters; that she will request to have a descriptive
presentation for the Headquarter Committee

Legal Counsel presented a brief overview of the time requirement for the Boazd to appoint a
new Board Member; that the Califomia Water Code 35055 that was provided was not the
corract Water Code for the District; that California Water Code 30500 is the correct Water
Code for the District
Vice President Negrete stated that the procedures presented by the General Manager are a fair
process
Dire~ctor Wilson asked Legal Counsel if the appointed Boazd Member was required to run in
the :iext election
Leg:~l Counsel stated that the information would need to be clarified by the registrar of voters

Each candidate was given five minutes for his or her presentation
Pre:sident Sturgeon stated that it is an honor te have everyone here interested in the position of
the new Board Member of the District; that the participation expresses how much the
conununity cares
Dir°ctor Wilson stated that the District is fortunate to have many interested individuals for the
position; that there is much qualifications in all of the candidates; that it is going to be a
difiicult decision

A RESOLUTION OF THE BOARD OF D[RECTORS
OF THE EAST VALLEY WATER DISTRICT
APPROVING AWARD OF SOLE SOURCE CONTRACTS
TO ROQUET PAVING, INC.,
FOR CERTAIN STREET PAVING PROJECTS
WHEREAS, the East Valley Water District ("DisVict") is a Counry Water District organized and
operating pursuant to California Water Code Section 30000 et seq.;
WHEREAS, the District, as a County Water District, is not subject to the competitive bidding
requirements of the. California Public Contracts Code ~Associated Builders and Contraclors v. Contra Costa
Water I~istrict (199~) 37 Cal. App. 4`h 466, 43 Cal. Rptc 2d 600];
WHEREAS, on April 8, 1991, the DistricCs Board of Directors ("Board") adopted Resolution No.
1991.4:i which established bidding and contract procedures as part of the District's Rules and Regulal.ions so
as to provide guidance and direction to the District's staff in obtaining outside services for projects initiated by
the District;
WHEREAS, Resolution No. ]991.45 also provided that the "Contract Procedures" se[ forth [herein
may be modified by the Board from time to time as deemed necessary;
WHEREAS, on February 9, 1998, the Board adopted Resolu[ion No. 1998.1 which modified Ihe
°Contr~.ic[ Procedures" contained in Resolution No. 1991.45 to exempt from any formal and informal bidding
requirements any project for which a"sole source convactor" has been designated;
WHEREAS, for purposes of Ihe °Contract Procedures" con[ained in Resolution No. 1991.45, the term
"sole source contractor" is defined in Resolution No. 1998.1 as "a contractor or consultant that has been
evaluatrd to provide a unique or specialized service which cannot be obtained from other contractors," which
designation must be approved by the Board;
WHEREAS, the Distric[ occasionally requires immediate street paving and spot repair after
completion of projects involving [he operation, installation, maintenance, and repair or underground piping and
other appurtenances so as ro enable public use of the streets as soon as possible without undue delay associated
with any applicable formal or informal bidding process; and
WHEREAS, the District's past experiences wi[h Roque[ Paving, Inc., is such Iha[ it has been available
to perfurm street paving and spot repair services for the District in a timely manner despite short notice and
with hieh-quality workmanship that has been accepted by both the District and other local governmental
agencies possessing regulatory oversight.
NOW, THF.REFORE, BE [T RESOLVED by the Board of Directors of [he East Valley Water District
hereby Finds and determines that Roquet Paving, Inc., be designated as a sole source contractor for the paving
of streets in connection with Distric[ projects for which the District's General Manager concludes that
entertaining formal and informal bids prior to the performance of such work would cause undue delay,
hardshit~, and inconvenience to the publia The Board reserves the right to withdraw this designation in i[s
entire~y. or to suspend this designation on a project-hy-project basis, in the exercise of its sole discretion.
BE IT FURTHER RESOLVED tha[, with respect to District projects for which Ihe sole source
designar.ion applies in the limited manner described above, the DisVict's Board of Directors herchy authorizes
the Disirict's General Manager to enter into contracts with Roquet Paving, Inc., as necessary to ensure timely
street paving so as to prevent undue delay, hardship, and public inconvenience, a[ a price not to exceed
$250,OG0, withou[ Ihe necessiry of engaging in [he formal or informal bidding process contained in thc
