M. FUENTES Since Mr. Fuentes was present, Chairman Forrest 2800 FAIRFAX DRIVE asked if he would like to speak to the Boar~. Mr~ FUentes stated he was buying the house at 2800 Fairfax D~ive and wanted to object to paying .the previous owner's water bill in the amount of $20.93. Auditor l~endricks pointed · out that he had asked realtors to include a clearance of utilities ~n escr~¢, but it is not compulsory and in this case, it apparently was ~ · not inc_uded. He stated that he had written two let%ers to the previous owners with no answer. MOTION Upon motion by'Director Littleton, duly seconded by Director Disch, this matter to be tabled until the next Board meeting of November 24, 1969. MINUTES There being no additions or corrections to the minutes of the-regular meeting of October .27, 1969 and to the minutes of the regular adjourned MOTION meeting of October 30, 1969, motion was made by Director Disch, duly seconded by Director Stallwood and.carried unanimously to approve' the minutes as submitted. BID OPENING - 12" District Enginser ~arcia stated that his estimate WATER MAIN & APPURT- of $5,~00 was based on the District Crews in- ~ANT FACILITIES stalling this Phas~ ii of the installation of TO PLAN~ NO. 56 12-inch water main and appurtenant facilities to Pla~t No.' 56, to point south of Hemlock Drive° .Job W-756. IIe seated that since the plans and specifications were pr6pared on t~isJob, General C0upland, owner of ~he proporty over which a portion o£ the transmissio~ main is to be installed within an easement held by.the District, has had some grading dond ~ha~ has changed the terrain con- siderabiyo Mr. Garoia said that .since conditions no~ existing on the physical terrain of the area, he recommended that new bids' be called. MOTION Upon motion by 'Director Stallwoo~ duly seconded by Dire=tot Littleton a~d carried unanimo~sly, the motion was to reject any and &ll bids sub- mitred and call for new bids due to change in ~he physical conditions of the area that formerly existed~ that were beyond ~he D~strict's contmol. 1596 November 10, 1969 NEW EID OP~NING FOR 12" WATER MAIN AT PLAN~ 56 MOTION Upon motion by Director Disch, duly seconded by Director Littleton and carried unanimously, au~horization to change the bid date of November 10, 1969 to December S, 1969 at 7:30 P. M. at District Office, on the 12. inch water main at Plant 56, was grante~. CORRESPONDENCE.- I~3C NOTICE OF HEAR- Secretary Rickert called attention'to a hearing ING, COUNTY SERVICE on formation of the County Service Area No. 70, AREA ~70, ANIMAL for information only. No action necessary. PEST & ~EED CONTROL LTR FROM REDCO A copy of a letter from the Regional Econom'ic SEMINAR ON MUNICI~ ~velopment CorporatiOn (REDCO) was mailed' to P~LFINANCE, NOV. each Director with the agenda.. This was concerning 20~ 1969 a Seminar to be held Thursday, November 20, 1969~ at the San Bernardino County Board of Supervisors Chambers. Fee including lunch is $5.00 per person. Directors Stallwood and Wall stated they would like to attend this meeting. Chairman Forrest pointed out that Staff should attend. MOTION Upon motion by Director Littleton, duly seconded by Director Disch and carried unanlmously, staff and any Board Member are authorized to attend. PATTON STATE General Manager Rickert gave a report on the HOSPITAL STAND-BY Staff meeting with Patton State ~ospital WATER Representatives on November 6~ 1969, regarding the Standby water service requested by Patton. Mr. Rickert read a rough dr~ft memo of the discussion and explained all items that were covered° Engineer Garcia presented three alternate plans for del!very of District water tO Patton State HOspital. Auditor-Treasurer ~Ien~rickes state~ the Dist~i=t could sell water to the State at $28~00 an acre foot a~d told how he arrived at th~s figure. Engineer Rowe stated this servicc to Pat~on is a very imp°rta~ step for the District and felt e_hat Mr. Smith, Representative of Patton, will make a favorable report to Sacramento. ~e stated %-hat District has facilities to take car~ of Patton if the offieial request comes through. Director Wall complimented the Staff on such . a complete report and stated it was very well preaented. No f~rther action to be taken on the part of the District un~il the state contacts us. LETteR FROM coUNTy Secretary Rickert read a letterdated November OF SAN BDN0 ON 1969~ from the County of San Bernardino Agric~I- R~MOVAL OF TREES rural Commission regarding'removal of treeS. IN CITY CREEK This Parcel ~85-231-37 to be futnre. site in City Creek. The total acreage is 4°08. ac~e. Mr. Rickert statedthat if the trees are not dead, we may be able to have the D~strict' Gardner water them from' time to tim~ M~T!CN· UPon motion by Director Wall, duly soconded by Director Disch and carried unanimously, Staff is direc~ad to'write a leeter to the Commission stating that we will attempt to ~ater the trees and keep them .green, if they are not desd. 159 November lO, 1969 /~UDITOR-TREASURER'S A copy of the Cash Disbursements for FINANCIAL REPORT 1969 was given to each Direotom at the time Of the meetin~;. No action necessary. REPORT OF MEETING A copy of Thomas StePson's Reports had been AT CITY WATER DEPT mailed to each DiTector with the agenda. ON WATER QUALITY Secretary Rtckert state~ that Mr. Stetson said CONTROL - SANTA the upstream water agencies were not very well ~/;A RIV]~R ;represented at the Costa Mesa Bearing and suggested we have a_meeting in this area to gain a stronger thnited front. Another meeting on Water Quality Control is to he held on November 19, 1969, at the San Bernardino l'~ater Commissioner's Board Room at 10 A.M.. Hr. P~L~kert stated he would be out of town attending a~other meeting and it would, seem advisable to have Engineer Garcia attend this meeting. MOTION Upon n~tion by Director Disch, duly seconded by Director I~ttleton and-carried unanimously, .Engineer David Garcia is authorized to attend this meeting in the absence of General Manager SEWER REPORT FOR Engineer Halwes presented his study of the Petrie PERRIS HILL Hill area in connedtion with sewer line to the ROBERT ~h~NCOCK'S Hancock lot. lie stated the eost would be $11,000 STUDY to run this line in~ as there is quite a bit of shale and rock in this area~ The~e are 13 lots that could be serviced by se~er. Secretary Rickert had a map of sewer COnnections outlined on' the board, lie stated [ir. Hancock had paid $150.00 for this ~tudy. Considerable discussion ensued. MOTION Upon motion by Director Die.h, duly seconded by Director Wall and carried unanimously, this situation is to be turned over to the Sewer committee to report back at the Board Meeting of November ~4, 1969. RESOLUTION NO. 1290 - Attorney Robert Far~11 presented P~solution TRUTH IN LENDING - 1290 that he and Au~$tor-Treasurer Hendricks had ESC~D ESTABLISHING prepared. The re~olution covers the INTEREST RATE TO BE Establlshing Interest Rate to be CheLrged by CHARGED BY DISTRICT District ~or Deferred Payments on l~ater Main FOR DEFEHRED PAY- Extensions. This resolution was prepared in MENTS ON WATER in keeping with the Truth In Lending Law on MAIN EX='ENSIONS bookkeeping and office expenses for ma~n extension charges. MOTION Upon m~tion by Direotor-Disch, duly ~econded by Director l~all and carried unanimously, : Resolution No. 1290 was adopted. RESOLUTION NO. 1288 - Attorney Farrell presented Resolution No. 12~8 ADOPTING REGULATIONS he had prepared covering Adopting Regulations ~0UXRED BY SECTION ReqUired by Section 3605 of the Government Code 3~0~ OF GOV CODE OF of the State of Califo~-nia D~fir~Lng the Term STATE D~FINING T~RM "Public Officer" ss it Applies to F~aployees "PUBLIC OFFICER" of Said District. [CONFLICTS OF INTERESTJ Attorney Farreli stated that the law require~ an officer that falls under the- new Government ~ode to file a statement regarding his financial interest and holdings. MOTION Upon motion by Director Disch, duly seconded by Director Stallwood and carri~dunanimous!y, Resolution No. 1268 was adopted. MOTION Upon motion by Director Stallwood, duly seconded by Director Littleton and carried unanimously, a resolution is to be prepared against this law, Conflict of Interest, and be sent to levels as high as the governor ifnecessary. Resolution to be presented at the Board Meeting of November 24, 1969. ANI~OUNCE~NTS - GENERAL ELECTION Secretary Rickert brought up the election of OF DIRECTORS November 4, 1969, and stated the results will be DISCII, FORREST presented at the November 24, 1969, meeting AND WALL together with certificates for Verification of. results. Swearing in of the Directors Disch, Forrest and Wall will be noon on November 28, 1969. For a matter of record, the defeated candidate was R= Iaaeson who had previously worked for the District. CITY OF SAN BDNO It was brought to the attention of the Board, ON SEWER RATES that a letter to Mayor Ballard and Common Council' INCREAS~ of October 38~ 1969, has had no answer. President Forrest said we should take definite steps to meet with the Council.concerning the increased sewer rates the District has to pay . to the City of San Be~nardinoo lie suggested Manager Rickert call Mayor Ballard as soon as possible. BROCBURE TO Director Disch stated ~hat he would like the DISTP~CT District to entertain ~he thought of aistributing CUSI~ERS to the customers, a leaflet concerning the actual cost of an election to the voters'and put such leaflet in the mail w%th their billing. Director Disch made a motion that by the First of March 197~, ~e get a ~imple pag~ on.cost of election and what happens to District customer's sewer money. ~%airman Forrese duly seconded the motion ~i~ th, addition of not limitin~ the leaflet to just these two items, but to have them included in the brochure. Motion ~as carried by majority.
