ARBITRATORS, CITY OF Th~ arbitrators met on October 9~ 1970 and SAN BDNO AND DISTRICT set November 12, 1970 at 10 A. Mo at the Sun JT POWERS AGREEMENT Bernardino Valley Municipal Water District as SEWER, 1957 the next Hearing, for the purpose of recei~'ing and considering the Joint Powers Agreement, Sewer, 1957, bet~en the City of San Bernardino and the East San Bernardino County Water District. A copy of the Notice and the Minutes of the m~eting were mailed to each Board Member with the agenda. The Genera]. Manager stated he had corresponded with Attorney Denslow Green re- questing a meeting to discuss the agreement with the Sewer Negotiating Committee. No further action was necessary or taken~ LETTERS TO BOARD FROM The General Manager had mailed letters from DISTRICT CUSTOMERS District customers, Rothfolks, Ullrey and T~uNKING DIST FOR Massie to the Board Members in which they INFORMATION RE: CSA thanked the Board for information relating to 75 PARK & RECREATION County Service Area 75, Park and Recreation, LAFC HEARING OF OCT° hearing at the Local Agency Formation Commission 14 on October !4. Also sent to the Directors, was the Sun newspaper clipping relating to denial of the formation of the recreation area by the LAFC. The General Manager stated he had received numerous calls and letters of appreciation from the District customers regarding the District notification of the Hearing, and that there were no negative responses~ This was for information only with no action taken° CALIF0 WATER RES0~RCES The General Maneger presented some booklets ASSNo - ACTION PROGRAM outlining achievements by the California Water FOR THE 70's Resources Association, entitled, "Action Program for the 70's". He stated the Association was putting on a push for memberships° No action was necessary or taken. 1 10/26/70 1724 October 26, 1970 IDA 1970 FALL CONVENTION The General Manager had received correspondence AT BILTMORE HOTEL IN relating to the Irrigation Districts Associationts LA - DEC. 2-4 1970 Fall Convention to be held at the Biltmore Hotel in Los Angeles December 2 through the 4th, and mailed copies of the material to each Director. Attendance to this convention had Board approval at the August 10, Regular Meeting. NO further action was necessary or taken. MOTION Motion was made by Director Forrest, duly seconded by Director Stallwood and carried unanimously, to mail a form letter of apprec- iation to customers who responded with their gratitude letters concerning the District notifying them of the LAFC Hearing. The General Manager read a Notice received from NOT~CE OF MTG OF CALIF. the San Bernardino County Planning Dept. re- R~..~IONAL WATER Q~ALITY prosenting the East Valley Planning Agency, ~ONTROL BD, OCT. 30, date~ October 23, stating a m~eting will be 1970, IN FOUNTAIN held on October 30 at 1=30 P. M. at Fountain VALLEY, CALIF. Valley, relating to County Sanitation Districts of Orange County discussing the outfall line to the ocean. MOTION Upon motion by Director Forrest, duly seconded by Director Disch and carried unanimously, any Board Me~ber or Staff was authorized to attend this meeting if they desired. RECOMMENDED SALARY Chairman Disch of the Personnel Committee INCREASES noted that Mary ~houlders, Janitress, had been with the District since 19~5. LuJan - Utility Crewman II (6 Mo) 26A $2.'71/Hr to 26B $2.84/Hr Effective 10/29/70 ~GINALD TILLMAN Reginald Tillman - Customer Service (1 Yr) 29C $3.45/Hr to 29D $3.64/Hr Effective 11/1/70 MARY SHOULDERS Ma~y Shoulders - Janitress (1 2lC $2.34/Hr to 2iD $2.45/Hr Effective 11/1/70 MOTION Motion was made by Director Disch, duly seconded by Director Stallwoo~ and carried unanimously, to approve the above listed salary increases, effective on dates as shown° WATER PRICING At this time, the General Manager brought up STUDY the Water Pricing'Study for further discussion. He stated that'other water agencies within the valley had made Water Pricing studies as has th~ District, and that the Cities of San Bernardino, Rialto, Redlands ~%d Colton, and the West San Bernardino Co%mty Wa~er District felt there 2 10/26/70 should be a unified thought on Water Pricing rather than wait untilthe San Bernardino Valley ~nicipal Water District makes a determination° MOTION Upon motion by Director Forrest, duly seconded by Director Disch and carried unanimously, Staff, . Consulting Engineers, District Water Committee and Attorney Farts11 were authorized to go into depth of Joseph Rowe's Water Pricing Study and bring back a report to the November 9 Board Meeting, before getting together with other Districts to formulate a policy on water pricing. NFXN!SHEDBUSXNESS - DISCUSSION OF FREE wATeR A copy of The Sun's'news article entitled, FOR LANDSCAPING FREEWAY "Commissioners Displeased with Water District' GOLDEN TOHIGHLAND & had been mailed to each Director along with ARDEN AVENUES articles on other agencies having the same ' problem of being asked to supply freeways with a water supply for landscaping. Legal Co~nsel and Staff had prepared a letter for Mayor A1 C. Ballard and Common Council and to ~ the CountY ~.,.-=d Of-Supervisors stating the District's position ~n the subJe=t of free water. A Copy of the letters had been mailed to each Baord Member and to the State Division Of Highways. MOTION 'Motion was made by Director'Forrest, dul~ seconded by Director Stallwood and carried unanimously to submit a copy of the most recent letter mailed to the City and County ~'egarding the District'S position on free water to the · Del Rosa Jr. Womens Club and San Bernardino Sun paper, with a covering letter to be prepared by the General Manager and Legal Counsel. AUDITOR'S STATEMENT OF AuditOr Hendri~kshad passed out a copy of the REVENUE & EXPENSE FOR Financial Report for the month of August at MONT~ OF AUGUST 1970 the Board Meeting of October 13, and at this WATER FUND AND SEWER ~eeting, given each Director a copy of the DIVISION Financial Report for the month of September. He was called upon to discuss questions asked by Board Members. No action was taken. RESOLUTION 1387 Resolution No. 1387 was presented requesting DEDICATION OF SEWERS acceptance of Dedication of Sewers in Tract 4815 TRACT 4815 - SIERRA for Sierra Downs No. 3, Inc. The General Manager DOWNS %3, INC. recc~m~ended approval of acceptance for public use as the sewer collection lines and appurten- ances had been installed to District specifica- tions and certified by the Engineer. MOTION Upon motion b~ Director Littleton, duly seconded by Director Stallwood and carried unanimously~ Resolution No. 1387 was adopted. DISCUSSION ON. DELIN- The Auditor-Treasurer had made & study on QUENT SEWER ACCOUNTS delinquent sewer accounts that he :presented to the District's Finance Coxmnlttee. He stated there were 278 bills in arrears with 28 accounts more than several months past due. He said that sewer accounts were billed one month in advance but that the sewer only, accounts were the most critical. He pointed out that the California law does not automatically ~ake delinquent utility bills a part of escrow, therefore, many new owners purchase homes with sewer bills existing and many never bother to make a name change of the property. 3 10/26/70 726 October 26, 1970 DELINQUENT SEWER The Finance Committee suggested the District ACCOUNTS CONTINUED - consider a Penalty Deposit on sewer accounts of those who have abused the use of credit. Auditor Hendricks requested approval to out off sewer accounts that are critically over due. The question came up from the Board Meeting of October 13 in which Mrs. John Teague of 7551 Cunninghamwas present to ask release of the former owner's sewer bill on the property she had just purchased. Discussion wa~ had whereby the General Manager was authorizes to =all a Fine, ce a~d Sewer Committee meeting determine a firm policy on the Cut-off of delin-~ quent sewer accounts for presentation to th~ Board for their consideration at a later Board meeting. MOTION Motion was made by Director Stallwood, duly seconded by Director Littleton and carried unanimously, that Staff be authorized to mail a registered notice of cut-off cf the 28 cus- tomers that are 120 days delinquent in their sewer bill, and at the end of deadline, to sever sewer connections without further notice. RESOLUTION 1388 NOTICE Resolution No. i388 was presented for acceptance OF COMPLETION, EL-CO of a Certificate of Completion filed by District CONTRACTORS FOR BASE- Engineer Garcia of. the Contract of El-Co Con- LINE WATER MAIN RE- tractors and autho~izing President and Secretary LOCATION BET GUTHRIE to file Notice of Completion for Ease Line Water & 1260 FT EASTERLY Main Relocation Project w-783, betWeen Guthrie JOB W-783 and 1260 feet easterly, completed on October 15, 1970o The General Manager recommended approval of acceptagce. MOTION Upon motion by Director Disch duly seconded . by Director Forrest and carried.unanimously, Resolution No. 1388 was adopted. COMMUNITY LAB PROJECT Auditor Hendricks was called upon to state any SAN GORGONIO HIGH further information he had concerning the SCHOOL Comm~unity Lab Project of the students of the San Gorgonio High School. He stated that the school does not carry insurance on the students for working on these various projects and that the State Workmens Compensation insurance did not cover anyone not paid for working and further, District's insurance carrier stated they would not be covered under Distract insurance policy. Unless the school came up with insurance, the District could not allow students to work. Auditor Hendricks said he would still attempt to follow-up on the project. R~ SWEITZER, 1628 HIGH- Auditor Hendricks stated that Robert Sweitzer LAND AVE, REQUEST FOR of 1628 Highland Avenue took over the operation RELIEF OF SEWER BILL of the old Del Rosa Laundromat. In August he AT HIS LAUNDROMAT had applied for water service to test his machines and was billed $20.75 for sewer when he was not open for business and requested relief of that month's sewer bill. Auditor Hendricks recommended Sweitzer be relieved of one month's sewer bill of $20.75. MOTION Upon motion by Director Stallwood, duly seconded by Director Forrest and carried unanimously, to accept the recommendation of the Auditor to relieve Sweitzer of the one-month sewer bill of $20.75. 10/26/70 RAMFAC INC. CHARGES The General Manager submitted the Ramfac InOo AGAINST RETAINER charges against their retainer for further SEWER COLLECTION SYS discussion. Auditor Bendricks showed a balance PALM & ATLANTIC of $1,195.41 after the project at Palm and Atlantic had been completed by tho District through Kruger Paving. Legal Counsel stated that the Districtwould be within its legal rights to request $50 a day liquidation damages if they desired. MOTION Upon ~otion by Director Stallwood duly seconded by Director Disch and carried unanimously, Staff was authorized to retain $500 of the balance of $1~195.41 retainer for District fees of administrative and professional costs covering a 10-day period. FINANCIAL REPORTS - AUDITOR-TREASURER ~ - The Financial Report for the month of September 1970 was gix~n to each Director at the meeting. Auditor Hendricks su~arized the statement. APPROVAL OF ~RI~ANTS The following warrants were placed on the table for the Directors to read: Water Division. %6667 - %6774 (General) $238~748.33 %3973 - %4078 (Pa~=o11) $ 23,429o01 $262,177,34 MOTION Upon mOtion by Direci~r Forrest, duly seconded by Director Stallwood and carried unanimously, the warrants were approved as submitted. ORGANIZATIONAL CHART At this time, Director Fcrrest asked the General & OPERATIONAL MA~VJAL Manager if he would send each Board Member a DUTIES OF DISTRICT copy of the District Org~izational Chart and EHPLOYEES the Operational Manual which consists of duties of employeas he had previously prepared. The G~neral Manager stated a copy would be sent to each Director.
