M. Dayne~ John Primrose representing the William Myers Corporation, and Spencer Sparks MINUTES There being no additions or corrections to the Minute, s of the Regular Meeting of October 26, MOTION 1970, motion was m~de by Director Disch, duly seconded by Director Forrest and carried unanimously, to approve the Minutes as submitted. MOTION Upon motion by Director Littleton, duly seconded by Director Forrest and carried unanimously, Staff was authorized the extension of time to December 28, 1970, at 7:30 P. M. to call for and open bids for the extension of water trans- mission mains in La Praix, Strafford to Atlantic° PIJ%NNED UNIT DEVELOP- The President recognized Mr. William E. Myers MENT, WM. E. MYERS who stated he wished to explain his proposed CORP - TRACT 8270 project to the Board and the many unnecessary delays his firm has been subject to by others. He said it appeared that such delays would make it virtually impossible for the development to be able to be far enough along in their con- struction to comply with the deadlLne of Decem- ber 1, 1970, set by Resolution 1383 with regard to the old sewer connection fees as set by Ordinance No..62. Ne indicated that his firm proposed to develop 95 lots within Tract 8270 with the. first phase of construction to build fifty-three $19,000 to $22,000 cluster-type houses. He stated by using figures supplied to him by the District Staff on water uses per unit, the District would gross a total water sales for the en_lre development of $225,000 in thirty years. Ne asked that the Board give his development the consideration to connect to the District's sewer collection system at the former connection charge under Ordinance No. 62, rather than those that became effective on August 10,-1970 under Ordinance No. 285. He indicated the balance of 42 units would be completed approximately June 1, 1971. The General Manager explained that the District Staffs had met with Mr. Myers and his represen- tatives and discussed with them~ the sewer connection charges beth as to Ordinance 62 and Ordinance 285 as well as Resolution No. 1383o i 1i/ /70 NcYember 9, 1970 WM. Counsel, ~le possibilities.of requesting a DEPOSIT deposit from sewer customers served by the ' ' District for sewer service only~ and after  considerable discussion of the matter, a TION motion by Director Littleton, duly ~econded by Director Forrest and unanimously carried, directing L~gal Counsel to determine if it would be legal ~o make a requirement for deposit on sewer service onlyo LETTER TO SAN BDNO The General Manager presented the letters SUN-TELEGPJ~4, FREE WATER formerly mailed to the Del Rosa Federated Jr FOR LANDSCAPING FREEWAY, Women's Club, explaining the District's decision EAST OF GOLDEN AVENUE on why it could not furnish free ~ater for the crosstown freeway, in addition~ the letters mailed to the Mayor and Corec%on Councll of the City of San Bernardlno end the San Bernardino County Board Of Supervisors. After discussion of the matter~ the General Manager and Legal Co%%nsel were directed to prepare a letter to b~ mailed.to the editor of the San Bernardino Sun~-Telegram, explaining that the District is willing and able to furnish water for landscaping purposes to the proper agency at a negotiated price and to include a.copy of the letters previously mailed to the Mayor and Council and the San Bernardino C~,~n'y ~oard of Supervisors. The letter was tabled with no action° 2 11/9/70 730 November 9, 1970 NOTICE OF HEARING A Notice was presented and had been previously BD OF SUPERVISORS mailed to each Director. The memorandum was a OF COUNTY OF SB Notice of Hearing for a reversal of the County Planning Commission action in denying a remote control self-service gasoline dispensing facility on Sterling Avenue between Seventh and Ninth Street in the vicinity of one of the DiStrict's unused well sites. The memo was tabled with no action. MANAGER'~ REPORT CITY WATER DEPTo A letter was presented from the City of San ASSERTED DAMAGES AT Bernardino Municipal Water Department. A copy 1651 EUREKA ST. having preViously been mailed to the Directors, ERROR IN CITY WATER in which the City Water Department submitted MAIN SHUTDOWN a bill for sand damages to a residence at 1651 Eureka Street as a result of District's crews shutting down a City water main in error during a main installation near the City's facilities. It was the recommendation of the Staff that the asserted damage amount be paid, providing the City Water Department could ~upport the claim with a proper invoice. After discussion of the matter, a mDtion by Director MOTION Stallwood, duly seconded by Director Forrest and unanimously carried, directing Staff to pay the asserted damage when a proper invoice was presented supporting the total amount and claimo GEORGE BARNETT A letter was presented from Mr. George Vo Barnett, 24219 5TH STREET 24219 Fifth Street, complaining of the broken CLAIM RE: BROKEN pipeline on his property as a result of PIPELINE District's water facility operation in the area. Engineer Garcia explained to the Board that the District has ordered a pressure control valve to be installed at Plan~ 12A (Sixth and Pedley) to correct the problem in the area but pointed out that pressure of this nature.exists throughout~ the system and that the District's regulatory ordinance-covers the District adequately. MOTION After discussion of the matter, a ~motion by Director Stallwood duly seconded by Directo~ Disch and unanimously carried, Engineer Garcia was instructed to correspond with Mr0 Barnett indicating the intentions of the District in correcting the problem and calling his attention to the ordinance and the denial of his request for $3.00 credit on his water bi!lo DIRECTOR FORIIEST At this time, 9:05 P. M., Director Forrest LEAVES MEETING left the Board Meeting. J. C. TRUJEQUE A letter was presented from Mr. J. C. Trujeque 24939 E. VINE ST. of 24939 East Vine Street wherein he enclosed a CLAIM FOR PLUMBING pl~bing bill for repairs and installation of BILL a new section of sewer lateral and street paving in the amount of $198.09. Engineer Garcia explained that the plumber had opened a trench over the sewer lateral and had called the District representatives to inspect the problem. District employees found that damage to the lateral was a result of the original installatlon in approximately 1959 from back- filling black top on the VCP pipe thereby breaking the joint and allowing seepage and eventual root problems and recommend that~e District pay the bill as subA~itted as a result of faulty workmanship during the initial in- stallation. 3 11/9/70 1731 November 9, 1970 MO~ION After discussion of the matter, Director Littleton ~ved, duly seconded by Director Stallwood and carried by the majority of those Directors present, with Director Disch voting nay, to pay'the bill presented by Mr. J. C. Trujeque. NOTICE TO WITHHOLD Thm General Manage~ Presented a Notice to OF MISSION CLAY PIPE Withhold and Verity ~atement of Claim of AGAINST RAMFAC INC Mission ClayProdu=t~ Corporation against SEWER INSTALLATION Ramfac Inc. Contract for sewer installation & ATLANTIC on Palm and Atlantic,,Avenues in the Highland area. The iGeneral Manager indicated that the Notice to Withhold whs~in the amount of $3,437.31 and had bean .received on approximately the 13th of Au~st .19'70 but had inadvertently been misfiled and ha~ not been presented to the Board of Directors for their action at that time. Attorney Farrell was asked to speak on ~e matter and'he indicated that : .there was no immediate problem as there is not sufficient money in the retainer to pay the amount, and that he would suggest that the Board acknowledge receipt of the Notice to Withhold and file in Ramfac contract file. HOTION A motion by Diract0~'Stallwood, duly seconded by Director Disch and carried unanimously by those Directors present, that the Notice to Withhold is hereby acknowledged and is to be filed in the Ramfac file. CALIFORNIA SPECIAL Director Wall and General Manager Rickert DISTRICTS ASSN reported on the California Special Districts REPORT OF FRESNO Association conference held in Fresno on ~ONFERENCE October 30 and 31, and indicated that it was well attended from Special Districts throughout the State, and that the CSDA's aims for 1971 is not to present new Bills but to adjust to the expected attackfrom the League of Municl- palities and the Board of Supervieor's Assn. UNFINISHED BUSINESS WATER PRICING A considerable discussion was held on Water Pricing policy to be considered by the San Bernardino Valley Municipal Water District on how to pay for supplemental water that will be arriving from the State aqueduct in 1972. Consulting Engineer Joseph Rowe was called on to comment on his report on what method would best effect the District with regard to its program in the past and in the future for. acquiring water rights. After a lengthy MOTION discussion of the subject, a motion by Director Stallwood, duly seconded by Director Littleton and carried unanimously by those' Directors present, to direct the Staff to contact water agencies who have made simila~ reports to that of the Rowe report for their agency and to meet with them individually and . collectively to see if a unified policy can be established and agreed upon by all agencies within the San Bernardino Valley Municipal Water District for later presentation to the Valley District Board of Directors and a progrese report of such meetings be made to the Board of Directors at their Regular Meeting of November 23, 1970, and a final report to the Board at their Regular Board Meeting on Decelmbar 14, 1970. 1732 No~embe~ 9~ 1970 ~NOUNCE~NTS - ARBIT~TION - The General ~nager announoed that the matter SE~R CHARGES BET of the arbitration on sewer charges between DISTRICT & CITY Se East San ~rnardino Coun~ Water District OF SB and the City of San Bern~dino would be held on Nove~ber 12, 1970 at i0 A.
