Payroll Checks for period ended October 12, 2007 and included checks and direct deposits, in the amount of $153,349.29 and for the period ended October 26, 2007 and included checks and direct deposits totaling $140,590.03. APPROVAL OF BOARD MEETING MINUTES FOR OCTOBER 9, 2007 M /S /C (Wilson- LeVesque) that the October 9, 2007 Board Meeting Minutes be approved as submitted. DISBURSEMENTS M/S /C (Wilson - LeVesque) that General Fund Disbursements #212073 through #212237 which were distributed during the period of September 14, 2007 through October 3, 2007, in the amount: of $1,194,725.38 and Payroll Fund Disbursements for the period ended September 14, 2007 and included checks and direct deposits, in the amount of $154,448.04, totaling $1,349,173.42 be approved. HEADQUARTERS PROJECT REVIEW AND UPDATE There were no updates for the Headquarters project at this time. DISCUSSION AND POSSIBLE ACTION REGARDING EASTWOOD FARMS MUTUAL WATER COMPANY The General Manager gave an overview of Eastwood Farms service account; that options for Eastwood Farms would be to get on the Grant list for funding; to consolidate the system, to become: an assessment District. The Chief Financial Officer presented a brief summary of the Eastwood Farm service account; that the account was delinquent; that he had been in contact with one of the board members of Eastwood Farms. Board member Mabelle of Eastwood Farms stated that she estimated the amount of Grant money that should be requested is around $2.5 million; that something needs to be done to their system; that there is no way to collect payment of delinquent bills from customers who refuse to pay their bill. Board Member Paul of Eastwood Farms stated that a flat rate has been developed because of the absence of Metiers; that a rate of $75.00 is in place. M /S /C (Wilson -Le Vesque) that the Board authorize staff to move forward and conduct an Assessment Engineering Study on the East Wood Farms Mutual Water Company. DISCUSSION AND POSSIBLE ACTION REGARDING AUDIT REPORT FOR THE FISCAL YEAR ENDING JUNE 30, 2007 A detailed presentation of the District's Audit Report for Fiscal Year ended June 30, 2007 was given by Mr. Bob Memory of Rogers, Anderson, Malody & Scott. M /S /C (Goodin - LeVesque) that the Audit Report for Fiscal Year ended June 30, 2007 be accepted. DISCUSSION AND POSSIBLE ACTION REGARDING PROPOSAL SUBMITTED BY CDM TO PERFORM DESIGN SERVICES, PROVIDE BIDDING SERVICES AND CONSTRUCTION SERVICES FOR THE NORTH FORK CANAL REPLACEMENT PROJECT (ARNOTT PROPERTY) The General Manager stated that this is the last portion of the North Fork Project; that the District is obligated to complete a detailed design through the Amott portion of the North Fork Replacement Project. M /S /C (Wilson - LeVesque) to authorize staff to accept the proposal from CDM to provide design, bidding and construction services for the North Fork Canal Replacement Project. DISCUSSION AND POSSIBLE ACTION REGARDING UPDATE TO THE INTEGRATED MANAGEMENT PROGRAM DEMONSTRATION PROJECT AGREEMENT M/S /C (LeVesque - Wilson) that the Amendment to the Integrated Management Program Demonstration Project Agreement be approved. DISCUSSION AND POSSIBLE ACTION REGARDING THE RENEWAL OF THE GENERAL MANAGER'S EMPLOYMENT CONTRACT President Sturgeon requested that item #10 be deferred until after Closed Session. DISCUSSION AND POSSIBLE ACTION REGARDING DISPOSAL OF SURPLUS EQUIPMENT The General Manager stated that the District's water truck needed to be replaced; that it would not be cost effective for the District to refurbish the water truck to meet AQMD regulations. President Sturgeon stated that the District look into AQMD funds availability for government agencies to comply with the new regulations; that MET has auctions online. M /S /C (Wilson - LeVesque) to approve of the disposal of surplus equipment. DISCUSSION AND POSSIBLE ACTION REGARDING ACWA'S NWRA CALIFORNIA CAUCUSBALLOTS M /S /C (Wilson - LeVesque) that the District cast their ballot for the following candidates: Lawrence Libeu, Rancho California Water District; Terrance "Terry" M. King, Chino Basin Water Conservation District; Joseph L. Kuebler, Eastern MWD; Charles W. Muse, Helix Water District; Adeline M. L. Yoong, Water Replenishment District of So. CA. DISCUSSION AND POSSIBLE ACTION REGARDING CANCELING OR RESCHEDULING THE DECEMBER 25, 2007 BOARD MEETING M /S /C (LeVesque — Goodin) that the December 25, 2007 Board Meeting be canceled. GENERAL MANAGER / STAFF REPORTS 'The General Manager reported on the District's operations to date; that Well 107 nitrate blending station is at the beginning of construction; that the North Fork Project will begin next week due to a delay with the current fires. CONSULTANTS REPORTS 7o McAndrews stated that bottled water was offered to San Bernardino County Search and Rescue due to the current fires. COMMITTEE REPORTS Director Goodin stated that he and Director Wilson discussed the Board policy in length; that meeting reimbursements should be reevaluated; that there should be a standardized resolution for the Board Policy; that a deadline should be set for the Director's expense reports to be placed on the agenda; that another meeting is scheduled for next week; a board workshop /special meeting has been scheduled for November 14, 2007 at 8:30 am. The General Manager presented information regarding the Standing Committee Meeting Minutes; that the minutes should be made available to each Board Member in a draft form; that the new procedures will be beneficial for the Board. ORAL COMMENTS FROM BOARD OF DIRECTORS Director LeVesque would prefer that board packets be distributed in an electronic format; that he would like to review the disbursement checks prior to each board meeting. President Sturgeon requested to have his board packet in an electronic format; that Ms Hendricksen, Mr. Stafford and Mr. Buchwald received information commending the Districts' employee, K. Taylor, for his help with fixing a flat tire for someone. Director Goodin requested to have his board packet -in both, electronic format as well as a hard ".. . copy. House Report 110 -185, Part 2 contains the following language: "Santa Ana River mainstem, California. —The Committee has recommended an increase of $4,000,000 above the Administration's request of $17,000,000 to continue studies to ascertain the nature and extent of water quality degradation in the Santa Ana River re- sulting from the construction and operation of Seven Oaks Dam and to amend the Seven Oaks Dam water control plan in light of current conditions and requirements." It is unknown at this time whether or not the above additional funding will be approved by Conference Committee. Planning: • In Progress Review (IPR) with Division and Headquarters tentatively scheduled for end of November to update vertical team and discuss next steps and discuss language given in Energy & Water Development Appropriations Bill (if applicable). - Water Quality Analyses: CE- QUAL -W2 Modeling: • 15 model runs (dry, below average, average, above average, and wet year) completed for years 2000, 2025, and 2050. • Modeling produced release concentrations versus time for Chi a, TSS, TDS, and NTU and vertical profiles for temp, DO, Chi a, TSS, TDS, and NTU for Feb, Apr, May, Jul, and Sep. Box 3427 San Bernardino, CA 92413 RE: LAFCO BUDGET ALLOCATION RECEIVED NOV 2 2007 East Valley Water District On August 9, 2007, the Board of Directors of Barstow Heights CSD sent a letter to LAFCO concerning the Special District's allocation to their 2007/08 budget. LAFCO responded to our letter on September 17, 2007 and basically said that neither they, nor the County, can change the formula. A change in the formula can only take place with the support of a majority of the Special Districts. As noted in our letter, the 30 Special Districts on a fixed allocation pay an amount which varies from 0.0072% to 0.44% of their annual budget. The 22 remaining Special Districts pay the balance of the LAFCO Budget which, at the present time, equals 0.59% of their budgets. These amounts are not fixed and will surely increase as the LAFCO budget increases. If this formula is not changed, the Special Districts on fixed allocation will continue to pay the same amount while the remaining 22 Special Districts carry all the LAFCO budget increases. This is unfair, discriminatory, and needs to be changed. One of the proposals in our August 9, 2007 letter was to modify the original agreement to show that further LAFCO Budget increases are shared by all 52 Special Districts. Applying a small percentage increase fo all Districts "will be a fair way of handling the LAFCO increases: This seems very reasonable and easy to implement. The Barstow Heights CSD Board of Directors is interested in pressing for a change in the formula, but we cannot do it ourselves. We are looking for support. Design requirements on the part of the treatment units and the general lack of space on the site have rendered the tank at Plant 40 unnecessary. The tank is a 75,000 gallon forebay used primarily as a small holding tank to reduce the tendency to over cycle the booster pumps and give the Well water a place to settle any minor sand particles. A redesign of the plant will allow the booster pumps to operate separate of the Well eliminating the over cycling of the Boosters. Filters prior to the treatment unit will remove any sand particles. The tank has little value to the District due to the age (built in 1972), size (small), and type (a bolted steel tank has a shorter life expectancy than a welded steel tank). One of the concerns, with the .existing tank is that one of the underlying exterior coatings on the tank contains lead. Lead is hazardous and requires special handling and disposal requirements. Removal of the bolts to dismantle the tank is a concern because of the possibility of chipping the paint. Because of this, the District needs to hire a contractor to properly dispose of the tank and paint chips. Generally this consists of collecting all paint chips and sending it to a certain disposal site and then sending the steel tank to a steel mill to be recycled. The District received a quote from BHL Industries, Inc. to demolish the tank at a cost of $14,000 (see attached). This is lower than the Engineer's Estimate of $25,000. Staff was aware that of the cost to remove the tank and discussed the possibility of finding someone who may want the tank at no cost to the District. Calvin Louie, General Manager of the Cabazon Water District found out about this (through Norm Terry) and expressed interest in the tank. In late October, Calvin visited the site and stated that they will take the tank upon approval of our Board and his Board. The general terms are that Cabazon Water District would hire and pay a contractor to 1 November 7, 2007 dismantle the tank and redeliver it to his District at no cost to EVWD and without payment to EVWD. EVWD would assume liability of any paint chips disbursed during the process of dismantling of the tank and in turn the Cabazon Water District would assume liability of the lead in the tank exterior coating once it leaves the site. EVWD, therefore, would save the $14,000 to demolish the tank and would assume only a minor liability in the paint chips on site as opposed to paying a Contractor to demolish and remove the tank. Since the tank has very little value to the District and has a significant costs to the District to demolish it, I recommend that the District allow Cabazon Water District to remove the tank and to request Steve Kennedy to prepare an agreement between East Valley Water District and Cabazon Water District assigning liability of the lead coating to the appropriate parties as skated. 3 10/1 812007 15:25 9513729198 HARPER & ASSOC. Perchlorate also occurs naturally and is present in some organic fertilizer. This soluble, persistent compound has been detected in sources of drinking water for more than 11 million people. It also has been found in milk, fruits and vegetables. The 109th has Perchlorate Perchlorate is known to disrupt the intake of iodine in the thyroid. Health effects associated with Perchlorate expo- sure are expected to parallel those caused by iodine defi- ciency. Uncertainty about the health effects of Perchlorate slowed efforts to establish drinking water and environmental cleanup standards. However, because of Perchlorate's persis- tence in water and its ability to affect thy- roid function, concern has escalated with the detection of Perchlorate in water in at least 33 states. In the absence of a federal standard, states have begun to adopt their own measures. Massachusetts set a drink- ing water standard of 2 parts per billion (ppb) in 2006, and as of October 18, 2007, California has adopted a 6 ppb standard. Other states have advisory levels ranging from 3 ppb in Maryland and New Mexico to 51 ppb in Texas. The Department of Defense and its contractors have used Perchlorate for many. years. Not surprisingly, Perchlorate contamination of water has often been found near these sites. The Environmental Protection Agency (EPA) has reported that in California, where most Perchlorate releases have been identified, Perchlorate has been detected in 456 sources of drinking water (including closed wells). Congress has targeted some funding for cleanup in conference reports for various appropriations bills, including DOD and EPA appropriations. The conference report for the Department of Health and Human Services encourages support for studies on the long -term effects of Perchlorate expo- sure. The conference report for the FDA directed the Agency to continue conducting surveys of Perchlorate- contaminated water in California. The House passed two bills, but no action occurred in the Senate. Other bills call for the EPA to issue a standard for Perchlorate in drinking water. On October 18, 2007 the Department of Public Health passed the 6 parts per billion rule for Perchlorate. All Agencies have one year to comply with the new regulation. Currently East Valley Water District has eighti wells that are affected by Perchlorate and are closely being monitored. Over the last few years testing has revealed a downward trend in the amounts of Perchlorate detected in the wells, the cause for the downward trend is not known. This number continues to grow as housing tracts replace most of the remaining orange groves in the east- ernmost portion of the service area. Eighty percent of our groundwater comes from the Bunker Hill Basin; the remaining twenty percent comes from surface water that originates in the San Bernardino Mountains. Unlike EVWD other agencies can trace The delegation encouraged the committee to create a Perchlorate cleanup partnership. In conclusion Martin said, "At EVWD we have the responsibility to serve safe drinking water to our customers and to do so under arrangements that they can afford. A local /federal cleanup partnership would be of great benefit to the people we serve and we urge the committee to continue to pursue authorizations and appropriations that would make such a partnership a reality." Sterling Avenue Pipeline Phase one of the Sterling Pipeline project has been completed. It consists of a 36" water main that goes along Sterling Avenue from Dato Street down to 6th Street and along 6th Street from Del Rosa Drive to Lankershim Avenue. This project will allow the District to move waterfrom the higher - producing portions of the Bunker Hill aquifer to the rest of the water system for the anticipated future growth within the community. The new pipeline will improve water flow in the water sys- tems, allowing the District to better serve its customers with increased reliability. The pipeline also gives the District the ability to connect to the San Bernardino Valley Municipal Water District system to access supple- mental supplies of water in the future. Plant 27 Improvements Plant 27, which is located in the northwest portion of the District, was constructed with Ion exchange units. The Ion exchange units treat for both Perchlorate and nitrates and produces approxi- mately 800 gallons of water per minute. California Department of Public Health (CDPH) has issued an operating permit, and all of the requirements have been achieved; the plant is on -line and in full service. Plant 132 Improvements The District has completed con- struction of its new Well 132 -5. Well 132 -5 is deeper than the existing 132 -2 Well, which will allow it to produce water of a very high quality, and water to meet the community's needs now and in the future. Well 132 -5 is approximately 800 feet deep, and will produce approximately 2,000 gallons per minute. The Well was recently put on -line after receiving its final permit from the California Department of Health Services. E V W D Sterling Avenue Sewer Relining In August of 2007, portions of Sterling Avenue sewer line (north and south of 9th Street) were relined. Recent sewer videotaping showed some cracks and voids in the sewer main. Relining the sewer helped to eliminate the possibility of soil contamination from leaks. The sewer was relined with a cured in -place pipe (a hard plastic resin that adheres to the original pipeline). The process was trenchless and took approximately 10 hours to line from one manhole to the other manhole (approximately 300 to 400 linear feet). This process saves man - hours, is cost effective, and causes significantly less traffic interruptions than traditional trenching and replacement. New Requirements For Wastewater Discharge In May 2006, the State Water Resources Control Board (SWRCB) adopted new Statewide General Waste Discharge Requirements for Sanitary Sewer Systems. All federal and state agencies, municipalities, counties, dis- tricts and other public entities that own or operate sani- tary sewer systems greater than one mile in length that collect and /or convey untreated or partially treated wastewater to a public owned treatment facility in the State of California are required to comply with the terms of this order. The purpose of this new requirement is to decrease the number of sewage spills into other bodies of water such as the ocean. EVWD has evaluated its current sanitary sewer manage- ment plan, infrastructure and facilities to identify ele- ments that will have to be upgraded and implemented in order to comply with the new regulations. The existing sewer system serves the City of Highland, portions of the City of San Bernardino and pockets of the County of San Bernardino. The regulation also addresses the improper disposal of fats, oils and grease. Putting greasy materials down a sink can lead to sewer clogs, and clogs can lead to waste- water backing up into homes or business. Cleanup can be expensive for homeowners, and especially for businesses and restaurants, which can be subject to fines and clo- sures. Fats, oils and grease can be absorbed with paper towels, kitty litter, coffee grounds, or shredded newspaper before discarding in the trash. Restaurants are encouraged to contract with a recycling and rendering facility. EVWD will be implementing their new Sanitary Sewer Management Plan over the next six months. PlObIMine Local Agencies Work Together Preparing For Disasters On October 10 - 11 the California Governors Office of Emergency Services, California Department of Public Health, Drinking Water Field Operations Branch and the Emergency Response Network of the Inland Empire (ERNIE) held a local multi - jurisdictional tabletop exercise at the National Orange Show Events Center in San Bernardino. The Tabletop exercise was sponsored by East Valley Water District, San Bernardino Valley Municipal Water District, West Valley Water District and Yucaipa Valley Water District. In order to comply with the National Incidental Management System (NIMS), agencies must conduct yearly exercises of their Emergency Operations Plans. The local jurisdictional agencies working with mutual aid agreements conducted a Tabletop exercise to test their mutual aid agreements and communication sys- tems, working on the design of the Tabletop from day one and conducted a mock disaster exercise on day two. The exercise was designed to develop communi- cation plans; emergency operation plans, and foster working relationships between agencies before an emergency happens. The two -day program provided multiple agencies the opportunity to work together, exchanging information on resources, capabilities and opening lines of communication prior to a real emer- gency. INTRODUCTIONS Hosting agency — So & Associates President Cox introduced Wilson So. Mr. So introduced Susan So, Ryan Sronague, Kanchan Joshi, Hao Zhay, William Lina and Manas Bista First time visitors - Sandra Perea and husband Amador, Craig Schneider both from Helendale CSD and Marlyn Lesley (GSWC). PRESIDENTS COMMENTS AND ANNOUNCEMENTS President Cox announced that election for Board Members would be next month, November, at the membership meeting and there would be 4 incumbents running. The program in November will be Mr. Danilla from the San Bernardino County District Attorney's office speaking on Identity Theft. DINNER — A buffet dinner was served to 60 guests PROGRAM — Kirby Brill Speaking about the "Regional Recharge and Recovery Project ". DRAWING — A total of $149 was collected for the Scholarship fund. Gary Lovelace, Mr. Vogler and Amador Perea each won $20, Mr. Perea donated his back to the fund. One hundred nine ($109) was deposited to the scholarship account.
