EAST SAN BERNARDINO COUNTY WATER DISTRICT ACCEPTING AGREEMENT ACKNOWLEDGING RECEIPT OF WATER STOCK OF CORWIN WELL COMPANY IN SATISFACTION OF EAST SAN BERNARDINO COUNTY WATER DISTRIC;T WATER FORMULA AND AUTHORIZING PRESIDENT AND SECRETARY TO EXEC;UTE SAID AGREEMENT BE I7' HEREBY RESOLVED by the Board of Directors of the East San Bernardino County Water District as follows: WHERIiAS, an Agreement has been prepared by and between, MARJORIE MITCHINER, DORIS KUNZMAN and LOIS BEHRENS, and the East San Bernar- dino County Water District wherein and whereby both parties agree to the terms, conditions and all pertinent matters set forth in said Agreement and same is hereby accepted for and on behalf of said District; and WHERI3AS, it appears to be in the best interest of the East San Bernardino County Water District to execute said Agreement; NOW THEREFORE BE IT RESOLVED, that the President and Secretary be and they are, hereby authorized, directed and empowered to execute on behalf of the East San Bernardino County Water District, the Agreement above referred to in the form and manner as presented to the Board of Directors of said District November 13, 1972. IT I:> FURTHER RESOLVED that the Secretary of said District be and he is, hereby authorized and directed to attach a certified copy of such resolution of Acceptance to said Agreement and to transmit same to the San Bernardino County Recorder for record- ation and file in the records of the District. The foregoing resolution was duly adopted at a Regular Meeting of the Board of Directors of the East San Bernardino County Water Dist:ri<:t upon motion made, duly seconded and carried unanimously on November 13, 1972. Co: S:.u t du:1 i:~:nn„aim, f:uunly ~/nt~r llislric! i°. 11, Rux 3927 Sau liernurdino, Cniiforuiu 92419 AGREEMENT ACKNOWLEDGING RECEIPT OF WATER STOCK OF CORWIN WELL COMPANY IN SATISFACTION OF EAST SAN BERNARDINO COUNTY WATER DISTRICT WATER FORMULA 'THIS AGREEMENT, made and entered into this 13 day of November 1972, by and between EAST SAN BERNARDINO COUNTY WATER DISTRICT, a County Water District and public corporation; hereinafter designated as FIRST PARTY and MARJORIE MITCHINER, DORIS KUNZMAN and LOIS BEHRENS, hereinafter collectively designated as SECOND :PARTY; WITNESSETH: WHP;RF;AS, FIRST PARTY has established a water formula as a condition to rendering water service to real property within the boundaries of FIRST PARTY, or real property sought to be annexed to the boundaries of said FIRST PARTY; and, WHERI~AS, such formula of FIRST PARTY may be satisfied by the dedic - ;anon of water stock in an operating and established water company which has an established surface or pump right upon the real property to be served domestic or industrial water by the FIRST PARTY; and, WHERIiAS, CORWIN WELL COMPANY, a California corporation, has established such a right upon all of the real property hereinafter described by delivering water thereto for the purpose of irrigation of a citrus grove upon said :property; and, WHERI?AS, SECOND PARTY, the owners of record of the real property :hereinafter described have requested and elected to deliver to the FIRST PARTY one (1) share of stock of Corwin Well Company to be applied by the FIRST PARTY in satisfaction of the water formula of FIRST PARTY upon all of the real property hereinafter described; and, WHERI~AS, the FIRST PARTY, in consideration of the transfer and convey- ance by SECOND PARTY, to the FIRST PARTY of the said one (1) share of stock ~of the Corwin Well Company, will consider the water formula of FIRST PARTY fully satisfied upon all of the real property hereinafter described for any and all future developYnent of said real property. -1 ~o.G i s-e a. SECOND PARTY do hereby transfer and convey to the FIRST PARTY Stock Certificate No. A-18, representing one (1) share of stock of Corwin Well Company, frESe and clear of any and all encumbrances or pledges thereon, in full satisfaction of the water formula of FIRST PARTY as applied to all of the real pro- perty hereinafter described; 2. FIRST PARTY acknowledges receipt from SE<;OND PARTY of said Certificate No. A-18, representing one (1) share of stock of Cprwin Well Company, in full satisfaction of the water formula of FIRST PARTY covering'all of the real property hereinafter described for any and all future development of said real property; 3. T'he real property referred to in this agreement is situated in the County of San Bernardino, State of California, described as follows: South one-half (S 1/2) of the West one-half (W 1/2) of the West one-half (W 1/2) of the Southwest one- quarter (SW 1/4) of the Northeast one-quarter (NE 1/4) of Section 33; Township 1 North, Range 3 West, San Bernardino Base and Meridian. 4, This agreement shall be binding upon, and inure•to the benefit of, the heirs, successors and assigns of either or both of the parties hereto.
