HomeMy WebLinkAboutRes -1576 - Grant of Easement Southern California Edison CompanyRESOLUTION NO. 1576 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE EAST SAN BERNARDINO COUNTY WATER DISTRICT AUTHORIZING EXECUTION OF GRANT OF EASEMENT TO THE SOUTHERN CALIFORNIA EDISON COMPANY. TO PLANT NO. 108 BE IT HEREBY RESOLVED AND ORDERED that the hereto attached Grant of Easement by the East San Bernardino County Water District, Grantor, be granted to the SOUTHERN CALIFORNIA EDISON COMPANY, A Corporation, its successers and assigns, dated August 29, 1972, for the right to construct, use, maintain, alter, add to, repair, replace, inspect and remove, over District's .easement described therein, be and the same is hereby granted to the said Southern California Edison Company. NOW THEREFORE BE IT RESOLVED, That the President and Acting Secretary are hereby authorized to execute said Grant of Easement to the Southern California Edison Company, and such legal description of Easement is attached hereto and made a part of. ASSF:'RTED WATER DAMAGE CLAIM, BROWNING 27154 COLE STREET, HIGHLAND SV 6746 August 29, 1972 The Acting Secretary presented a letter dated August 16, 1972 from District's Insurance carrier, Chubb/Pacific Insurance whereby they investigated the claim of Douglas Browning of 27154 Cole Street, Highland in the amount of $260.00, and suggested the District reject the asserted water damage claim, i.n accordance with provisions of the Government Code. MOT]:ON Upon motion by Director Littleton, duly seconded by Director Forrest and carried unanimously, Staff was authorized to send "Form of Notice of Acting of Claim" to Douglas Browning notifying that District denied the Claim in accordance with provisions of the Government Code. RESOLUTION 1577 Resolution No. 1577 was presented requesting RELEASE OF LIEN Release of Lien for Delinquent Sewer Charges WM. PRICE/FHA for William Price/Federal Housing Administration 26938 CYPRESS ST. on property at 26938 Cypress :street, Highland. HIGHLAND The Acting Secretary stated Staff recommended adoption of this resolution releasing the lien. MOTION Upon motion by Director Disch, duly seconded by Director Littleton and carried unanimously, Resolution No. 1577 was adopted. RESOLUTION 1575 Resolution No. 1575 was presented requesting ACCEPTING DEED & Acceptance of Deed and Convey~xnce of Water CONVEYANCE WATER Rights from Arthur Carlsberg, 1275 Date Street, RIGHTS, CARLSBERG, San Bernardino, California. 'Phe Acting Secretary LANSING WELL stated this was the water rights from the Lansing Well and recommended acceptance of resolution. MOT:LON Upon motion by Director Littleton, duly seconded by Director Wall and carried unanimously, Resolution No. 1575 was adopted. RESOLUTION 1576 Resolution No. 1576 was presented requesting AUTH EXECUTION OF authorization to the Southern California GRANT OF EASEMENT Edison Company from Base Line to Plant No. 108. TO CALIFORNIA EDISON The Acting Secretary stated the Edison Company CO. (BASELINE TO required the easement in order that they may PLANT 108) install a power pole line needed by the District ~~~•~~"~"'~`~°~° for the operation of a booster pumping station and automatic controls. Attorney Farrell said this was a typical easement form of the Edison Company and suggested revision of some of the wording. MOTION Upon motion by Director Wall, duly seconded by ~~G~ Director Forrest and carried unanimously, Resolution No. 1576 was adopted, subject to revision of easement wording by Legal Counsel. AUDITOR-TREASURER FINANCIAL REPGRT A copy of the June 1972 Financial Report for the Water and Sewer Divisions of the District was given to each Board Member.. The Comparison Schedules were generally discussed and it was the general feeling of the Board to further discuss the report at the September 11 Board Meeting when the Auditor would return from vacation. The Grantee, and its contractors, agents and employees, shall have the right to trim or top such trees and to cut such roots as tnay endanger or interfere with said systems and shall have free access to said systems and every part thereof, at all times, for the purpose of exercising the rights herein granted; provided, however, that in making any excavation on said property of the Grantor(s), the Grantee shall make the same in such a manner as wlll cause the least injury to the surface of the ground around such excavation, and shall replace the earth so removed by it and restore the surface of the ground to as hear the sanre condition as it was prior to such excavation as is practicable.
