WHEREAS, prior hereto a complaint in condemnation has been
filed by Big Bear Municipal Water District against Bear Valley Mutual
Water Company, being action No. 129025 in the Superior Court of the State
of California in and for the County of San Bernardino, wherein Big Bear
Municipal Water District seeks to condemn Big Bear Lake, which is the
property of Bear Valley Mutual Water Company, sand used by said water
company for storage of water, and
WHEREAS, said storage is necessary to fulfill the water demands
of the stockholders of Bear Valley Mutual Water C"ompany, and to meet the
contractual commitments relative to a water supply between Bear Valley
Mutual Water Company and North Fork Water Company, and
WHEREAS, the East San Bernardino County Water District is a
shareholder in Bear Valley Mutual Water Company, and North Fork Water
Company, and as such shareholder is entitled to, and does receive, a water
supply, and
WHEREAS, storage of water in Big Bear Lake by Bear Valley
Mutual Water Company is necessary in order to pr. ovide said District with
water supply, and
WHEREAS, said water so received by the East San Bernardino
County Water District from Bear Valley Mutual Water Company, and Nortli
Fork Water Company, is necessary to supply the inhabitants of said Distr~i.ct
with a municipal and domestic water supply, and said water has been
appropriated by said Districtto a public use for such purpose, and
WHEREAS, said condemnation, if successful, would deprive the
East San Bernardino County Water District of said water supply, all to the
detriment of said District and its inhabitants, and
WHEREAS, it is to the best interest of said East San Bernardino
County Water District that it intervene in said action to terminate said
condemnation proceedings and preserve said supply of water.
NOW, THEREFORE, BE IT RESOLVED that Denslow Green,

1 special water counsel, and Robert J. Farrell, District counsel, Harold G,
2 Rickert, Secretary and General Manager and Joseph Rowe, District Enginee ,
3 are authorized, directed and empowered to file appropriate legal proceeding
4 to intervene in said action for the purposes hereinbefore set forth,
5 BE IT FURTHER RESOLVED that Denslow Green is hereby authpr z
6 and empowered to represent North Fork Water Company in said litigation as
7 an intervenor therein.

9 The foregoing Resolution was duly adopted at a regular meeting
of the Board of Directors of the East San Bernardino County Water District
10 on the ~_day of July, 1972, upon the following vote:
