A RESOLUTION OF THE BOARD OF DIRECTORS OF
THE EAST VALLEY WATER DISTRICT
ESTABLISHING RATES AND CHARGES FOR WATER SERVICE
AND RESCINDING RESOLUTION 2007.26
WHEREAS, East Valley Water District ( "District ") is a county water district
organized and operating pursuant to California Water Code Section 30000 et seq.; and
WHEREAS, pursuant to applicable law, including but not limited to Water Code
Sections 31024 and 31027, the District's Board of Directors adopted Ordinance No. 358
on April 9, 2001, establishing the rules and regulations for water service by the District;
and
WHEREAS, pursuant to applicable law, including but not limited to Water Code
Sections 31007 and 31025, the District's Board of Directors is authorized to adopt by
resolution such rates for the provision of water service by the District to implement the
rules and regulations set forth in Ordinance No. 358 and to yield an amount sufficient to
pay the operating expenses of the District, provide for repairs and depreciation of works
owned or operated by the District, pay the interest on any bonded debt, and, so far as
possible, provide a fund for the payment of the principal of the bonded debt as it
becomes due; and
WHEREAS, in furtherance of its objectives, the District has conducted a study on
the public facilities operated by the District and the anticipated need for additional
facilities in the future; and,
WHEREAS, this study, entitled East Valley Water District Impact Fee Study, AB
1600 Compliance was prepared by the engineering firm of URS Corporation dated May
1989; updated in 1995; and most recently updated in 2000 by Engineering Resources of
Southern California, Inc.; and is available for public review and inspection; and
WHEREAS, this study indicates that existing public facilities operated by the
District will need to be modified and additional facilities will be needed for the District to
provide adequate water service to the people within the District; and
WHEREAS, this study further indicates that rates and fees need to be
established by the District to raise sufficient revenue to finance the public facilities
necessary to provide adequate water service; and
WHEREAS, the revenue raised by these rates and fees will be used to modify or
construct additional public facilities to provide adequate water services, and do not
exceed the total cost of these facilities; and

WHEREAS, this action is necessary for obtaining funds for the construction of
capital public facilities necessary to maintain water service within the boundaries of the
District and is therefore exempt from the requirements of the California Environmental
Quality Act as provided by Public Resources Code Section 21080(b)(8).
WHEREAS, the amount of the rates and charges hereby adopted do not exceed
the reasonable anticipated costs for the corresponding services provided by the District,
and therefore the fees imposed hereby to not qualify as "special taxes" under
Government Code Section 50076, and the actions taken herein are exempt from the
additional notice and public meeting requirements of the Brown Act pursuant to
Government Code Section 54954.6(a)(1)(A) and (B).
WHEREAS, the District has satisfied all of the substantive and procedural
prerequisites of Article MID of the California Constitution in establishing the rates and
charges set forth herein, including but not limited to, the identification of the parcels
upon which the rates and charges will be imposed; the calculation of the rates and
charges; the mailing of written notice to the record owners of each parcel upon which
the rates and charges will be imposed describing the amount thereof, the basis upon
which the rates and charges were calculated, the reason for the rates and charges, and
the date, time, and location of the public hearing to be held thereon; and the conducting
of a public hearing on the rates and charges not less than 45 days after mailing the
notice during which all protests against the fee were considered.
NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the East
Valley Water District does hereby resolve and determine that the written protests
against the rates and charges set forth herein that were received by the District prior to
the close of the public hearing hereon represented less than a majority of the parcels
subject to the rates and charges set forth below and, thus, the District's Board of
Directors further finds that the public interest and necessity requires the adoption of the
following rates and charges for water service by the District in accordance with
Ordinance No. 358, as well as affirmation and ratification of all prior rates and charges
previously adopted by the District's Board of Directors:
SECTION 1. SYSTEM CHARGE
The system charge is the monthly availability charge applicable to all metered
water services and are hereby established as follows:

SECTION 2. CONSUMPTION CHARGE
The consumption charge established pursuant to Section 14.02 of the District's
Ordinance No. 358 is fixed at the uniform rate of $1.35 per hundred cubic feet.
SECTION 3. DELINQUENCY CHARGES
The delinquency charge is the charge which is added to each delinquent account
at the time any amount becomes delinquent, provided that no delinquent charge shall
be made on any account which at that time has no delinquencies of record. The
delinquency charge is hereby established as one and one -half percent (1 -1/2 %) per
month of the total amount delinquent.
SECTION 4. FIRE SERVICE STANDBY CHARGE
The fire service standby charge is the monthly charge per inch diameter of the
District fire service meter. Water used through this service is limited to emergency fire
requirements only.
Fire Service Standby Charge = $5.60 per month per inch diameter.
SECTION 5. WATER SERVICE CONNECTION CHARGES
The water service connection charge is the charge for the type and size of water
service connection desired. Such regular charge shall be paid in advance by the
applicant. Where there is no regular charge, the District reserves the right to require the
applicant to deposit an amount equal to the estimated cost of such service connection.

SECTION 6. FIRE SERVICE CONNECTION CHARGES
The fire service charge is the charge for the type and size of fire service
connection desired. Such regular charge shall be paid in advance by the applicant.
Where there ,is no regular charge, the District reserves the right to require the applicant
to deposit an amount equal to the estimated cost of such service connection.

SECTION 7. FRONT FOOTAGE CHARGE
The front footage charge is a one -time reimbursement to the District for
previously constructed water mains adjacent to all sides of an unimproved property to
be serviced. This charge is hereby established at a rate of $30.00 per lineal foot.
SECTION 8. WATER MAIN EXTENSION CHARGE
The water main extension charge is for the construction of a water main
extending to the far side of the property to be served. This charge shall be based on
the prevailing rates of time and material per District approved plans. The customer shall
be responsible to provide the plans and for all applicable Engineering Services charges
described in Section 12.
SECTION 9. FIRE HYDRANT INSTALLATION CHARGE
The charge for installation of fire hydrants is hereby established at the rate of:
1. $3,807.00 for each short side installation (the case where the water
main and the hydrant are on the same side of the street's centerline)
2. $6,359.00 for each long side installation (the case where the water
main and the hydrant are on the opposite sides of the street's centerline)
SECTION 10. SPECIAL FACILITY CHARGE
A special facility charge shall be required for development of limited service
whenever special facilities, including pressure regulators are required. The charge to be
made to a developer or owner of land that is considered by the District to be within a
limited service area shall be based upon the developer's or landowner's proportionate
share of the cost for the installation of such Special Facility. Such proportionate share to

be borne by the developer or landowner shall be based on the percentage of such
development to the entire limited service area to be served by the Special Facilities; and
the same number of acres or area under normal conditions and the cost of facilities to
serve the acreage of area under special conditions at a higher cost.
SECTION 11. INSPECTION CHARGES
Where a customer service connection or facility requires inspection by District
personnel, the customer shall be charged for such inspection at the rate of $600.00 per
day.
SECTION 12. WATER SYSTEM DESIGN CHARGE
A water system design charge shall be required for all main extensions, service
connections and /or special facilities requiring the preparation of engineering plans and
drawings. The water system design charge is hereby established as that fee charged by
an engineering firm of the District's choosing, plus an additional 10% thereof for the
District's administrative costs. In the event the costs exceed the fees charged, the
additional cost will be billed to the customer.
SECTION 13. ENGINEERING SERVICES CHARGES
The Engineering Services charge is a fee for the District's time and effort spent
on assisting customers who have a requirement to construct water main extensions, or
other water facilities, that must meet District needs and conform to District standards.
This fee includes time and effort the District spends on plan checking, plan and
easement development, and all other related work.
Prior to submission of any documents requiring work by the District, a non-
refundable minimum charge in the amount of 7.5% of the engineer's estimated cost for
the project shall be submitted to the District. The work will be accomplished on a time
and effort basis. Should the District require more funds than the original charge, the
additional costs will be billed and must be paid prior to allowing water service to the
project.
SECTION 14. VALVE DEPOSIT
A refundable deposit of $100 per valve will be charged for each water system
valve on the water construction plans. This fee will be returned when the valve cans
and caps are constructed to final grade by the developer's contractor and verified by the
District.
As an alternative to the valve deposit, a guarantee bond may be provided in the
same amount as the deposit. The guarantee bond shall contain covenants that are
satisfactory to the District. Such bond shall remain in force until all valve cans and caps
are constructed to final grade by the developer's contractor and verified by the District.

SECTION 15. DISCONNECT /RECONNECT CHARGE
The disconnect/reconnect charge is the charge which covers the reasonable
District disconnect/reconnect costs for disconnection and reconnection of service
connections which are in violation of District ordinances, resolutions and rules. The
disconnect/reconnect charge is hereby established at the rate of $45.00 per occurrence
during normal work hours. An additional $25.00 will be charged for after normal work
hours reconnects. Should the disconnect/reconnect occur at the water main, the
charge is hereby established at the rate of $750.00 per occurrence.
SECTION 16. METER TEST CHARGE
The meter test charge is the charge which covers the District costs for removing,
bench testing and reinstalling the water meter to be tested as provided for in the
ordinances of the District. The meter test charge is hereby established at the rate of
$50.00 per test.
SECTION 17. SECURITY DEPOSIT
The security deposit insures payment of minimum District charges and may be
refunded under certain circumstances. The amount of the security deposit charge shall
be calculated at three times the average monthly bill as estimated by the district, and is
hereby established as follows:
Owner /Resident/Tenant $100.00 /edu (equivalent dwelling unit)
SECTION 18. UNAUTHORIZED USE OF WATER CHARGE
The unauthorized use of water charge shall be charged to any person,
organization or agency for each unauthorized use of District water or for tampering in
any manner with any meter belonging to the District where this tampering shall affect
the accuracy of such meter. The unauthorized use of water charge is hereby
established at the rate of $500.00 for a first occurrence and $1,000.00 for each
subsequent occurrence.
SECTION 19. TEMPORARY SERVICE
A temporary service is available through the use of a fire hydrant. The customer
deposit for a temporary service is hereby set at $1,800.00. All other applicable service
charges shall apply.
SECTION 20. CONSTRUCTION WATER CHARGE
The construction water charge is the flat rate charge for use of water during the
construction phase of a new building. It is only available for services 1" in diameter or
smaller. The charge is hereby established at the rate of $44.00 per month per service
requested.

SECTION 21. SERVICE INITIATION CHARGE
The service initiation charge is the charge which covers the reasonable District
costs for initiating water service. The service initiation charge is hereby established at
$25.00 per service address.
SECTION 22. FIRE FLOW TEST CHARGE
A fire flow test charge is hereby established at $100.00 per test.
SECTION 23. RETURNED CHECK CHARGE
A returned check charge is a charge which covers the reasonable administrative
cost: and banking charges for processing a returned check.
The returned check charge is hereby established at $20.00 per returned check.
Any person disputing these fees may file a protest with the General Manager of
the District as provided for in District Ordinance No. 358 or as provided for by law. The
decision of the Board of Directors regarding any protest shall be final.
This Resolution shall take effect immediately upon adoption,
except the fees for residential development under this Resolution
shall take effect 60 days from the date of adoption.

WHEREAS, pursuant to applicable law, including but not limited to Water Code Sections
31007 and 31105, the District's Board of Directors is authorized to adopt by ordinance such rates for
the provision of sewer service by the District to implement the rules and regulations set forth in
Ordinance No. 359 and to yield an amount sufficient to pay the operating expenses of the District,
provide for repairs and depreciation of works owned or operated by the District, pay the interest on

a. Users other than Residential: Rates for users other than "residential" shall be computed
on the basis of actual consumption as reflected by water meter readings for the billing period. Such
water consumption may be reduced for the purpose of establishing sewer service charges subject to
"seasonal" or "consumptive" use as recognized and approved by the Governing Board.
b. Unmetered Commercial Dischargers: Unmetered commercial dischargers shall be billed
as follows:
Residential units in apartments, condominiums and mobile home parks shall be billed for each
dwelling unit at the rate established for single - family dwelling units. Other commercial dischargers
shall be billed at a rate determined by the General Manager, based on experience from similar
metered dischargers.
SECTION 2. SEWER SERVICE CONNECTION CHARGES
The sewer service connection charge is the charge for the type and size of service connection
desired. Such regular charge shall be paid in advance by the applicant. Where there is no such
regular charge, the District reserves the right to require the applicant to deposit an amount equal to
the estimated cost of such service connection. The following charges are hereby established and
shall be collected at the time of application for sewer connection:
Permit Charge: $ 25.00 /connection
Inspection Charge: $ 75.00 /connection
Connection Charges: $645.00 /edu or portion thereof
Trunk Sewer Charge: $158.00 /edu or portion thereof
SECTION 3. SPECIAL FACILITY CHARGE
A Special Facility Charge shall be required for development of limited service areas
whenever special facilities are required. The charge to be made to a Developer or Owner of land that
is considered by the District to be within a limited service area shall be based upon the Developer's
or Landowner's proportionate share of cost for the installation of such special facility. Such
proportionate share to be bome by the Developer or Landowner shall be based on the percentage of
such development to the entire limited service area to be served by the special facilities; and the
difference between the cost of facilities to serve the same number of acres or area under normal
conditions and the cost of facilities to serve the acreage or area under special conditions at a higher
cost.

A refundable deposit of $250 per manhole will be charged for each sewer manhole structure:
shown on the sewer construction plans. This deposit will be returned when all manholes are
constructed to final grade by the developer's contractor and verified by the District.
As an alternative to the manhole deposit, a guarantee bond may be provided in the same;
amount as the deposit. The guarantee bond shall contain covenants that are satisfactory to the
District. Such bond shall remain in force until all manholes are constructed to final grade by the
developer's contractor and verified by the District.

The Sewage treatment capacity charge shall be the fee collected by the City of San
Bernardino to cover the Water Reclamation Plant's expansion costs as the plant's capacity is used by
new connections.
SECTION 13. LANDSCAPE ADJUSTMENT
The landscape adjustment shall be the adjustment to the sewage treatment and collection
charge based upon the proportional amount of the customer's property irrigated
through a domestic water meter.
This Ordinance shall take effect immediately upon adoption.

very large increase since you just had an increase about one year ago. This is one of the
things that cause inflation. Everyone just keeps raising prices instead of holding the line.
Many people are seeing hard times seeing the country is in the condition it is. Many have
lost their jobs, and it is a burden on all of us of higher prices, especially on ones with
fixed incomes.
Your rates are already higher than other water districts. You are 20% higher than the city
of Redlands.

Upon reading your recent letter regarding rate increases please keep in mind that the immediate future
does not bode well for the economy. In other words, incomes most likely will not be increasing and
times could be difficult for some. Therefore, any improvements to the water delivery system should only
be made with great deliberation and only when necessary.
This brings me to the construction of a new District Headquarters. I recommend that this project be
tabled until a future date. I know it sounds great to have a brand new facility to work in but is this
absolutely necessary? It think not at this time.

water /sewage for both addresses. I do not accept the proposed increases that are proposed
for the following reasons.
1. Your letter /notice dated September 12, 2008 states that your reason for needing a
new facility because your current facility was deemed unhealthy in 2004 the way I
understand it. I believe that if the facility was unhealthy at the time you entered the
building, why did you lease it in the first place.
2. Is it not the responsibility of the land/building owner to insure that all health and
safety requirements are met and kept up to date through proper maintenance?
3. Highland has grown considerably over the past 4 years. East Highland now has new
home extending almost to the Green Spot Bridge. With the number of new homes
and business there should be more than enough monies going into the water district
coffers without raising the cost.
4. As a Highland resident sense 1974, I have seen very little as far as improvements in
"old" Highland but East Highland seems to get more improvements all the time.
There was a notice sent out several years ago stating that the "city" would give the
property owner (providing he /she lived on that property for 5 years) $5000 for
property improvement in "East Highland" not in the older parts of Highland (where
home improvements are needed.
In closing, I protest any and all increases in my water /sewage costs.

As a homeowner for the past six years, I have considered your rates very high compared
to other area rates. I previously lived in another area of north San Bernardino for 20
years and never did pay the large fees I pay now, plus had three bathrooms and used my
dishwasher regularly.
I think any increase in rates would make watering my yard a hardship. I already conserve
water in every way I can. I have placed bottles of water in my toilet tanks, do not take a
shower every day, do not use my dishwasher and only wash dishes once a day, I'm doing
everything I can inside to curb my water use. Plus I limit watering my yard to the bare
minimum.
I think this raise should be reconsidered.

This letter is in response to the proposed increase in rates for the East Valley Water District. Our names are
Thomas and Jane Starner. We are the owners of the property at

We oppose the increase in rates for several reasons:
1. We already had an increase in the last year or so.
2. The rates are already unbelievably high. Our monthly water bill is the highest of all our utility bills, and
we don't waste water.
3. The economy cannot sustain another increase. Most people are stretched to the limit in their budgets due
to job losses, extremely high rent or mortgages, and inflation that outpaces raises in income. It takes a lot of
nerve to propose a 12.5% increase in this economy, not to mention saddling our children with paying off a
$47,000,000 bond.
As all of us need to do at this time, we must assess our finances and find ways to trim the budget in order to
meet our needs and pay the bills. I suggest that instead of building a new headquarters at this time when the
economy is so depressed, the district look for another place to lease and put off this expensive project until
the economy recovers.
In addition, use the federal funding available to work on the primary surface water intake pipeline.
Sometimes we can't do everything we want all at once. If you don't have the money, do what you can with
what you have.
As for updating technology and installing pipelines, prioritize and do what needs to be done immediately.
The fees for sewer treatment and maintenance and water system are already so high. Frankly, we just can't
pay any more. Find other sources for funding. The consumers are already burdened to the limit.

I am a refired person on a fairly low fixed income. This rate increase
will make if difficult for me and will make it harder +o keep my yard looking
nice. There are not many yards on my street +hat look nice and my desire
is that I be able +o maintain my yard's current beauty.
Ofher expenses have increased greatly ibis year, as you know: gas,
electricity, food costs, and medical costs. I have a chronic illness +hat
requires many doctors' visits and medication. Increasing +he water rate will
make it harder for me +o fake care of my medical needs, not fo mention
being able fo buy adequate, nourishing food. I am feeling very pressed by
+he raises in the cost of everything.
Please do no+ raise the rates for seniors ( +hose over 60 years of age),

Please accept this written correspondence as a strong opposition to the proposed rate
increase for the service of water to a Home Owners Association that I manage.
Currently, we have five (5) accounts that service the 96 units as follows:
Since we took over Management of this Association in October, 2007, the total bill for
all five above referenced accounts has gone from $3,694.22 to $6,928.64 most recently.
This Association is in a blighted area of Highland and operates on a very restricted
budget. They provide water for not only the entire common area, but for all of the
Residents within the community. A rate increase of 12.5% on 96 units and common
area would definitely have detrimental effects on the community, up to and including
possible failure to provide water service.
We have searched endless options to assist this community, such as city and county grant
programs, etc. Unfortunately the Association was not able to qualify for any assistance
through these options. Please take this community into consideration when considering
the rate increase. Again, this could put our community in worse condition that it already
is. I would be happy to provide you with a copy of our budget for your review if
necessary to show you where we stand with regards to finances.

To Whom It May Concern:
I am writing to emphatically protest any rate increase proposed for Water /Sewer rates.
We are `owners' of 28 apartment units in the city of San Bernardino, 12 of which use
East Valley Water District supplies. We pay for the water for all our tenants, plus
landscaping. Unlike a private home owner, we have no control over the amount of
water used by our tenants.
I cannot tell discribe how financially impacted we are at the present time with rising costs
for mortgages, management, utilities, maintenance, advertising, licensing fees, taxes,
insurance and more. We are having difficulty keeping our units rented due to the
economic downturn as our tenants are experiencing job lay -offs and hours cut. As it is,
our properties aren't worth their mortgages, we are in the negative at this time, and now
you want to raise our costs even more?
Please consider my protest. I know I am not the only voice with this concern.

Dear Secretary,
This letter is being written to protest the proposed rate increase of our water and sewer.
A rate increase of 12.5% is large and difficult at any time, but in this current economy, it
is outrageous! We are both teachers and our salaries have had no increase since 2006.
We are actively doing what many other Americans are doing — cutting our expenses and
finding ways to live within our financial means. It's not easy, but it can be done.
We own 8 rental properties in your jurisdiction and are required to pay the water bill
when our tenants default (which we have had to do twice in the last month). Mercifully,
the gas and electric companies have no such policies. The tenants are solely responsible
to pay their own bills. Apparently, apartment owners are not forced to pay the delinquent
bills of their tenants - including the water bill.
The addresses of our rental properties are as follows:
Companies all across America are finding ways to cut their expenses and be more
productive with their current resources. We ourselves have had to cut rents the past 2
months, and eat the costs. We believe that the water district can do the same and that the
proposed rate increases are not the only way to address the current problem. Please
utilize the creativity of your employees and decide not to charge your customers the
additional 12.5 %. It is our belief that a decision to proceed with your current proposal
would be extremely hard for the people you serve. Such a decision would indicate that
the water company is indifferent to the current economic difficulties and is rigidly
unwilling to look for a creative alternative plan.
We challenge you to devise a better plan that will accomplish reasonable goals and not
create more hardship for the people who live in this area.

Today's economy is in the tank and heading into a deep recession.
Housing foreclosures are still on the increase. Thousands of
jobs are being lost even every day. Retirement programs for
those retired or about to retire are daily losing their value.
Gas is still too .high. Food and other necessities are also on
the increase. The Federal Government is giving 700 billion
dollars of the tax payers money to Wall Street, banks and other
institutions that got us into this mess. And you want a 12.5%
increase in both water and sewer rates - oops, that is really a
25% increase -- you devils you! - for a new District Headquarters
plus an increase in your salaries and benefits ( "routine
administrative costs") etc.

to bail out us tax payers and consumers? A

like, when people are down and out, you want to kick them again
and again!

Board Secretary:
The notice of proposed increased your customers received stated that if a majority of property owners file a
protest in opposition to the rate increases, the increases will not be imposed.
While these signatures are a small sampling of customers in one neighborhood, 100% of the homeowners
contacted signed this protest. I believe that represents a clear majority of customers opposed to the
increases. I trust you will consider this seriously.

This letter is in response to the proposed increase in rates for the East Valley Water District.
We oppose the rate increase for these reasons:
1. We already had an increase in the last year.
2. It is unreasonable to propose a 12.5% increase in this economy, as well as burdening us with a
$47,000,000 bond.
The fees for sewer treatment and maintenance and water system are already so high. We cannot and are
unwilling to pay any more. Find other sources for funding. The consumers are already burdened to the limit.
