Director Stoops led the flag salute. APPROVAL OF JULY 27, 1992 BOARD MEETING MINUTES Correction to the minutes: Under "Amendment to Development Agreement Between EVVVD & Highland and Boulder Partners" Vice President Douglas voted no. M/S/C (Stoops-Sturgeon) that the July 27, 1992 board meeting minutes be approved as corrected. LIENS FOR DELINQUENT WATER AND SEWER ACCOUNTS were presented to the Board for approval. M/S/C (Stoops-Sturgeon) that the liens for delinquent water and sewer accounts be approved for processing. RESOLUTION 1992.144 - RELEASE OF LIEN FOR PROPERTY LOCATED AT 5589 NEWBURY was presented to the Board for approval. M/SIC (Stoops-Sturgeon) that Resolution 1992.149 be approved. ROLL CALL: AYES: Directors Disch, Stoops, Sturgeon, Douglas, Lightfoot NOES: None ABSENT: None RESOLUTION 1992.150 - RELEASE OF LIEN FOR DELINQUENT WATER AND SEWER ACCOUNT FOR PROPERTY LOCATED AT 26767 BASELINE was presented to the Board for approval. M/SIC (Stoops-Sturgeon) that Resolution 1992.150 be approved. ROLL CALL: AYES: Directors Disch, Stoops, Sturgeon, Douglas, Lightfoot NOES: None ABSENT: None DISBURSEMENTS M/SIC (Stoops-Sturgeon) that General Fund Disbursements #148099 to #148232 in the amount of $360,421.18 and Payroll Fund Disbursements #6705 to #6750 in the amount of $47,914.06 totaling $408,335.24 be approved. 3 SELECTION OF A COMMERCIAL BROKERAGE FIRM FOR DISPOSAL OF HIGHLAND AVENUE PROPERTY Two proposals were received from commercial brokerage firms for listing of the District's Highland Avenue property and reviewed by staff and the Board. Mr. Jack Strickler from George H. Schnarre, Inc. Commercial Brokerage and Mr. Tom Owens from Intercon Development Services Corporation were present to answer questions. M/S/C (Stoops-Disch) that the proposal from Intercon Development Services Corporation be accepted; that the Board President be authorized to execute the proposal from Intercon on behalf of the District upon approval by Legal Counsel; that the second bid be held until the bid from Intercen Development Services is final. PATTON EXECUTIVE GOLF COURSE A proposal from U.S. Express Corporation for exclusive authorization and right to sub- lease the Patton Golf Course was reviewed. M/S (Stoops-Lightfoot) that staff and legal counsel prepare a six month agreement allowing U.S. Express to be sole broker to find a developer for the golf course; that the Board President be authorized to execute the agreement on behalf of the District. Directors Disch, Sturgeon and Douglas voted no. Motion did not carry. NOTICE OF HEARING FOR ILLEGAL CONNECTION TO THE DISTRICT'S WATER SYSTEM - SANCHEZ AND SONS LANDSCAPING The Board was informed that Sanchez and Sons had contacted the District and agreed to a payment plan for the $500 fine for illegal connection to the District's water system. M/S/C (Disch-Douglas) that the Board support staffs allegation of an illegal connection to the District's water system by Sanchez and Sons; that Sanchez and Sons has verbally agreed to pay the $500 fine in increments of $100.00. GENERAL MANAGERS REPORT The General Manager reported on District operations to date. Information only. EXECUTIVE SESSION M/SIC (Stoops-Douglas) that the Board move into executive session at 6:16 p.m. to discuss pending litigation as provided for in the California Open Meeting Law, Government Code Section 54956.9(a).
