Hi,
I've attached the legislative report. It is a pdf file. Directors and staff can click on the bill number to get to the
text of the measure. I think there are 14 bills. I did not include a number of "spot" bills, but I will continue to
monitor them for changes as the session progresses. There may be additional bills after mid -March as
ACWA will review many more and I have referred some to in -house counsel for another client to save your
legal affairs budget.
I included an update on AB 300, otherwise all others are new. SIB 457 is no longer relevant since the subject
matter was included in the special session delta water package last November. I will still keep an eye on it
as well. If I recall, the board also was interested in SIB 808. ACWA has a support position as does my client
California Central Valley Flood Control Association, therefore, I don't believe it is necessary for the District to
weigh in as well. Let me know if you feel differently.

Summary: The Subdivision Map Act prohibits approval of a tentative map, or a parcel map for which a
tentative map was not required, or a development agreement for a subdivision of property of more than
500 dwelling units, except as specified, including the design of the subdivision or the type of
improvement, unless the legislative body of a city or county or the designated advisory agency provides
written verification from the applicable public water system that a sufficient water supply is available or,
in addition, a specified finding is made by the local agency that sufficient water supplies are, or will be,
available prior to completion of the project. This bill would require, until January 1, 2017, the public water
system, or the local agency if there is no public water system, to review, verify for accuracy, and
approve, as specified, the subdivider's water savings projections attributable to voluntary demand
management measures, as defined. The public water system would be authorized to collect fees
necessary to provide the additional analysis of the voluntary demand management measures. This bill
would provide that a water supply assessment completed, as specified, satisfies the existing
requirement of verifying sufficient water supply, unless the public water system receives specified new
information . The public water system would be required to determine the projected water savings
attributable to the voluntary demand management measures that will be incorporated into the
subdivision. The projected water savings would be required to be calculated using specified data
compiled or maintained by the public water system or the water savings projections adopted by the
California Urban Water Conservation Council. If a project applicant proposes to use a new voluntary
water demand management measure for which neither the California Urban Water Conservation Council
nor the public water system has adopted an estimate or method to calculate the projected water
savings of the proposed voluntary demand management measure, the projected water savings would
be required to be made based on documented methodologies or calculations submitted in the record.
Five years after the project has been fully developed, the public water system would be required to
include within its next urban water management plan a report on the monitoring and compliance of
voluntary water demand management measures and to determine , if practicable based on readily
available information, whether they have resulted in the water savings necessary to achieve the agreed
upon water demand offsets. The bill would also require the public water system to document the
measured annual water use of the subdivision in comparison to the projected demand associated with
the subdivision, and to calculate the water savings attributable to the voluntary mitigation measures
financed by the Voluntary Water Demand Mitigation Fund for the subdivision. If the public water system
bases its written verification of a sufficient water supply for the subdivision, in whole or in part, on the
use of voluntary demand management measures within the subdivision, the written verification would be
required to be conditioned on the maintenance and operation of the voluntary demand management
measures, or measures that are at least as water efficient, as agreed to by the applicant and the public
water system, and the recordation as a covenant running with the land for the lots within the
subdivision. The bill would provide that by acceptance of a deed to a lot, each purchaser would
acknowledge the obligation to comply with the voluntary demand measures for the lot as described in
the covenant. These covenants would be authorized to be enforced pursuant to the existing authority of
a public water system. The bill would further require a builder, prior to the close of escrow, to give a
purchaser information that would be required to be included in a maintenance manual that informs the
purchaser of the existence of the home's unique water saving devices, including specified information.
The bill would also encourage the public water system to commit to carrying out the water conservation
measures funded by the Voluntary Water Demand Mitigation Fund within 24 months of the sale of the
last unit of the proposed subdivision. The bill would require the public water system to choose water
conservation measures that are themost cost - effective means to yield water savings . The bill would
authorize expenditures from the fund to be made within the subdivision or elsewhere within the service
area of the public water supplier, at its discretion. Not less than 40% of the proceeds from the voluntary
water demand mitigation fund would be required to be directed to water conservation programs in any
disadvantaged community, unless the public water system makes a specified finding. By adding to the
duties of the public water system, this bill would impose a state- mandated local program. This bill
contains other related provisions and other existing laws.
Laws: An act to amend, repeal, and add Section 66473.7 of the Government Code, and to amend,
repeal, and add Section 10910 of the Water Code, relating to subdivision map approvals.
Notes 1: This legislation is similar to AB 2219 (Parra) from 2008 that the District opposed in the Senate.
The bill was dropped by the author. The California Building Industry Association is the sponsor of AB 300
and continues to work with Planning and Conservation League, East Bay MUD and the author to fashion
amendments to the bill that will result in the removal of opposition. The District supports an approach
that would amend existing law to authorize a project applicant to work with a public water system on a
voluntary basis to provide additional water demand management measures for a subdivision or
contribute funds to an existing plumbing retrofit program offered by the public water system or other
conservation best management practices to be implemented by the public water system. The goal is to
offset in whole or in part the projected water supply demand associated with a development project.
This legislation, like AB 2219, would proscribe a process n , %l- the public water system would have to
calculate and affirm potential water savings based on mea! c-es mduded by an applicant (developer)
and monitor and report re;rdts attributed to demand manage -rent measures after 5 years. AB 300 now
authorizes the public wate- system to impose a fee on ar. aprl c =_,rt to cover the costs of compliance.
The estimate of potential mater savings must be based on susstantial evidence in the record developed
by the public water system if the demand management mea =. :res have not already been calculated by
the California Urban Water Conservation Council. If the pubs - ,al.er system bases a written verification
of a sufficient water supply `or the subdivision in whole ot n r,tr-t of the use of voluntary demand
management measures, tte written verification must be torn .coned on the maintenance and operation
of the measures. Yet, aside from a requirement that propert; Ceders hand down a maintenance manual
to buyers, the only enfo,ce,nent mechanism is through a rcc )riccl covenant running with the property.
The District has secured a .umber of key amendments thus far. including (1) fee authority to provide
additional analysis of vo'ur :ary demand management measur- 22) clarification that measures shall be
chosen that are the "most cost - effective means to yield Tsai sa,,ings" as compared to "the least
expensive;" (3) changing tee accounting for fees received f c -r ar applicant from the Urban Water
Management Plan to the annual budget to mirror existing le:v; `a _he accounting of developer mitigation
fees and contributions pursuant to a developer agreement: an 1 '4) deletion of a provision that provided
that the sole remedy for the failure of a public water system tc implement the water conservation
measures was for an interested party to seek a writ of marda^rua to compel the public water system to
comply.
1 believe there are two remaining issues: (1) Voluntary demand management measures are identified in
the legislation (a list is provided, but other measures may be cluded). The legislation requires the
measures to provide savings for a 20- year - period. The list of measures includes smart irrigation
controllers, for example, that likely do not have a 20 year measure life; and (2) The legislation has a 6-
year sunset for a program that requires a 20 -year commtmenr. Rather than sunset the legislation,
perhaps a report could be reouired to be prepared by the Ueoartment of Water Resources on the
performance of public water systems and voluntary agreements entered into based on the legislation.
DWR currently reviews Urban Water Management Plans, svFe-u this information will reside. Based on
progress to date, I am recommending that the District downgrade the level of opposition to the bill, but
not fully remove opposition pending the outcome of ongoing n-gctiations between the author, bill
sponsor and other opponents.

Summary: The California Constitution requires that a perscr eside for one year within the legislative
district for which he or see seeks election as a Membe, of the '.eg,slature. Various statutory provisions
impose residency requirements on other specified elected off Gals in California. This bill would require
that a person elected to a state or local public office maintain I-is or her place of residence within the
jurisdiction within which voters are qualified to vote for the office during his or her term of office. The bill
would require a person who violates this provision to immediately forfeit his or her office and would
disqualify the person from i,olding any state or local pubhc c P',ce r, the future. The bill would provide that
these provisions would apply retroactively to all persons holding crate or local public office at the time of
the effective date of the bil ;. Commencing with persons sency terms of office beginning on or after
November 2, 2010, the bill Would also make a violation of the -es!dency requirement punishable by
either a civil penalty not to exceed $1,000 or a fine not to exceed $1,000, imprisonment in a county jail

Summary: Existing law requires various state and local agencies to administer programs relating to
water supply, water conservation, water rights, water quality, flood management, and groundwater,
Under existing law, various bond acts have been approved by the voters to provide funds for water
projects, facilities, and programs. This bill would state the intent of the Legislature to enact legislation to
make necessary changes to statutes relating to water resources enacted during the 2009 -10 7th
Extraordinary Session of the Legislature.

Notes 1: This legislation is an author - sponsored spot bill that might be amended to contain "clean -up"
provisions to the legislative water package enacted last year. The District should closely monitor this

Summary: Existing law requires the state or a local public agency that proposes to undertake certain
actions within the boundaries of the Sacramento -San Joaquin Delta or the Suisun Marsh to prepare, and
submit to the Delta Stewardship Council, a specified written certification of consistency with a prescribed
Delta Plan prior to taking those actions. This bill would make a technical, nonsubstantive change to this
requirement.
Laws: An act to amend Section 85225.25 of the Water Code, relating to the Delta Stewardship Council.

Assemblymember Yamada opposed the legislative water package enacted last fall. Any person who
claims that a proposed covered action is inconsistent with the Delta Plan and, as a result of that
inconsistency, the action will have a significant adverse impact on the achievement of one or both of the
coequal goals or implementation of government- sponsored flood control programs to reduce risks to
people and property in the Delta, may file an appeal with regard to a certification of consistency
submitted to the council. "Covered Action" does not now include any project that is within the alignment
of a conveyance facility as shown in Figures 1 to 5, inclusive, of the Final Draft Initial Assessment of Dual
Delta Water Conveyance Report, April 23, 2008, and in future revisions of this document by the
Department of Water Resources. Consistency determinations by the Delta Stewardship Council will be an
important means for ensuring that covered actions are consistent with the Delta Plan, which the Council
is required to prepare and adopt. The District should closely monitor this legislation given the author's
prior positions regarding the legislative water package.

Summary: Under existing law, the Department of Water Resources operates the State Water Resources
Development System that includes dams, reservoirs, and other infrastructure. This bill would require the
department to undertake an expedited evaluation and feasibility study with regard to the
implementation of a specified Delta Corridors Plan as part of the State Water Resources Development
System. The department would be required to prepare and submit to the Legislature, on or before
January 1, 2012, a report that includes its feasibility findings. If the department determines the
implementation of the plan is feasible, the department would be required to include recommendations
with regard to specific facilities to be constructed, and to identify potential funding sources, for the
purposes of implementing the plan.
Laws: An act to add Section 148 to the Water Code, relating to the State Water Resources Development
System.
Notes 1: The Delta Corridors Plan was prepared for the South Delta Water Agency to evaluate the
salinity benefits of the establishing separate corridors for water to move into, out of, and through the
Sacramento -San Joaquin Delta compared with the existing salinity conditions in the south and central
Delta. Plan proponents argued back in 2007 that the Delta Corridors Plan would provide benefits for fish
habitat, fish migration survival through the Delta, and reduced fish entrainment at the CVP and SWP
pumping plants.
The Bay Delta Conservation Strategy Planning Process is currently investigating alternative Delta future
plans and policies. The Delta Corridors Plan was submitted to the Stakeholder Group and to the Delta
Vision Panel as an alternative that plan proponents argued would revitalize the Delta by separating the
San Joaquin River- estuary corridor from the Sacramento River -water supply corridor. The Bay Delta
Conservation Plan is guided by a steering committee of local water agencies, environmental and
conservation organizations, state and federal agencies, ar,c zI :lei interest groups. In December 2009,
the BDCP Steering Comm,t`ee was presented with five option c- improved Delta conveyance: (1) all
tunnel option; (2) isolated conveyance facility -east; (3, isalatec conveyance facility -west; (4) dual
conveyance facility; and (5) through -Delta facility. The Delta -rigors Plan was not included. This
legislation would require DYvR to study the latter plan outside rf the BDCP process. This is not a
desirable result for BDCP participants. Potential habitat restc-at on and water supply conveyance
options included in the EDCP will be assessed as part of an F-..ironmental Impact Report
(EIR) /Environmental Impact Statement (EIS). A joint EIR /EIS ii! BOCP is currently being prepared. State
and Federal lead agencies ter the EIR /EIS are the Califorr. a Csaa,tment of Water Resources, the Bureau
of Reclamation, the U.S. Fi,i, and Wildlife Service, and NOAP.'s iational Marine Fisheries Service, in
cooperation with the Califoi "ia Department of Fish and Game ':ie U.S. Environmental Protection Agency,
and the U.S. Army Corps of f- ngineers. The Draft EIR /EIS is e, -ecied to be available for public review and
comment in 2010.

Summary: The Water Measurement Law requires every wale, ju-veyor to require, as a condition of new
water service on and after January 1, 1992, the installatico c a .,ater meter to measure water service.
That law also requires urban water suppliers to install ,vaiei -i 2te-s on specified service connections,
and to charge water users based on the actual volume of da ^ores as measured by those water meters
in accordance with a certain timetable. This bill, with a certain - :xception, would require every water
purveyor that provides water service to a person residing in z. ruTiumt residential structure for which a
construction permit has beer issued on or after January I, :"C I to require the installation of meters or
submeters on each individual rental unit as a condition of ni rater service to that property. The bill
would authorize the owner or operator to charge tenants based on the actual volume of water delivered
as measured by the water meter or submeter.
Laws: An act to add Chapter 8.5 (commencing with Section 537) to Division 1 of the Water Code,
relating to water.
Notes 1: This legislation is an author - sponsored bill, This bill, with an certain exception for high -rise
buildings, would require every water purveyor that provides water service to a person residing in a
multiunit residential structure for which a construction permit has been issued on or after January 1,
2011, to require the installation of meters or submeters on each individual rental unit as a condition of
new water service to that property. This bill would take the next step in measuring water use and
thereby promote water conservation by requiring individual water meters for multi -unit residences and
allow charges to individual apartment renters for water use.
The bill is similar to AB 1173 (Keene) that was introduced in 2007. That bill was held on the Assembly
Appropriations Committee Suspense file due to estimated moderate ongoing costs, in the range of
$250,000 annually to the Division of Measurement Standards at the Department of Food and Agriculture
(CDFA) and county weights and measures agencies to review, approve and inspect thousands of new
water submeters required to be installed in individual rental units at apartment complexes built under
construction permits. Those costs may be partially offset by fees imposed by the state division and the
county agencies, according to the Assembly committee analysis. AB 1173 was sponsored by California
Apartment Association, California Rural Legal Assistance Foundation and Western Center on Law and
Poverty opposed that legislation due to provisions that would authorize individual charges for buildings
without "submeters," which presents a greater challenge and more complex issues. Allocating water use
and costs among multiple tenants raises issues of fairness, notice and control.
Beginning with the 2010 Urban Water Management Plan, the District will be required to identify an urban
water use target for 2015 and 2020 that will result in an up to 20% reduction in gallons per capita per
day based on a baseline period (generally between 1994 and 2009). Metering has proven to be an
effective conservation best management practice.

Summary: Existing law prohibits an elective officer of a city from expending or participating in any action
that would expend city funds between the date a recall election involving that elective officer has been
called and the date the certification of the election results is released, as specified. This bill would
provide that any contract entered into or appointment made by a legislative body of a local agency, as
defined, between the date that election results are certified for an election involving that legislative body
and before the date the newly elected members of the legislative body are sworn in to take office shall
not take effect until the legislative body, which includes the newly elected members, has reviewed and
approved the contract or appointment.
Laws: An act to add Section 50035 to the Government Code, relating to local government.
Notes 1: This legislation is an author - sponsored bill. The legislation likely addresses a situation in the
legislator's district, perhaps a contract or appointment entered into prior to a new majority being sworn
into the governing board. Nevertheless, this bill would create a potentially untenable situation for a local
agency governing board in terms of executing contracts in the period between election certification and
a new board member being sworn into office. The delay would occur if only one of five seats turns over;
it also would apply to emergency contracts. The bottom line is that the present governing board is duly
elected and authorized to act in all circumstances notwithstanding the pending turnover in members.

Summary: The California Public Records Act requires state and local agencies to make their records
available for public inspection and to make copies available upon request and payment of a fee unless
those records are exempt from disclosure. Investigatory or security files compiled by a public agency, as
defined, for correctional, law enforcement, or licensing purposes are exempt from disclosure under the
act. This bill would exempt from disclosure under the act the records of a public agency relating to
information security and the investigatory or security files compiled by a public agency for information
security purposes. This bill contains other related provisions and other existing laws.
Laws: An act to amend Section 6254 of, and to add Section 6254.19 to, the Government Code, relating
to public records.
Notes 1: The State Chief Information Office is the sponsor of this bill. In the last 2 years, the
Schwarzenegger Administration reports an increasing number of public records act requests as
compared to prior years. Slany of the requests involve secwe -fc-mation technology information. The bill
seeks to protect such infers -ation, so as to prevent hackers h,. rr obtaining access to it, This legislation
would provide important o=ctect or for a public water ;y5te1r regarding the potential disclosure of
records relating to informaton security.

Summary: Existing law, the Warren -Alquist State Energy Rescurces Conservation Development Act,
declares, among other things, that electrical and natural gas ,- tilities should have as a principal goal of
their resource planning and investment to minimize the cost to society of reliable energy services,
improve the environment, and encourage the diversity of erergy sources. The act also declares that
those utilities should seek to exploit all practicable and cost cff•:cuve conservation and improvements in
the efficiency of energy use and distribution that offer equivalent c- better system of reliability. This bill
would express the intent of the Legislature to enact legislate, that creates a tiered system for
achieving consumption redo -tions in energy and water in al'. I ,;blur sector agencies for cost reduction,

Summary: Existing law gercrally prohibits the state, o- a ccu ^ty, city, district, or other political
subdivision, or any public of'rer or body acting in its official -ah=.aty on behalf of any of those entities,
from being required to pay any fee for the performance of ar 41oal service. Existing law exempts from
this provision any fee or chc -ge for official services required G.:-scant to specified provisions of law
relating to water use or v:ater quality. This bill would expand We exemption to other provisions relating
to water use, including prop lions that require the payment of lees to the State Water Resources
Control Board (board) for official services relating to statements of water diversion and use. This bill
contains other related provisions and other existing laws.
Laws: An act to amend Sections 6103.1 and 6103.4 of the Government Code, to amend Sections 1052,
1055, 1055.2, 1055.3, 1120, 1228.5, 1228.7, 1525, 1535, 1538, 1550, 1551, 1825, 1845, 5103, and
5106 of, and to add Sections 1051.1, 1240.5, 1826, 1846, and 1847 to, the Water Code, relating to
water resources.
Notes 1: The January 13, 2010, amendments gutted the prior version and instead added a number of
provisions generally relating to water rights, provisions that were previously included in SB X7 5
(Steinberg and Pavley) of the Seventh Extraordinary Session in 2009. The latter bill failed passage in the
same manner as with prior versions of that bill introduced into the regular session.
The present contents of SB 565 raise significant concerns /opposition last year. Water Code Section
1051.1 would allow the State Water Resources Control Board (SWRCB) to require water users to
perform expensive and technical monitoring studies at their own expense. The results of these studies
would presumably be used by SWRCB to reduce water rights. Possible ramifications of this provision
could include situations where, for example, the SWRCB requires a water user to perform fishery studies
in consultation with the Department of Fish and Game that end up being used as a basis for a SWRCB
proceeding to increase minimum flow requirements under the public trust doctrine. In effect, the SWRCB
could require water users to perform and fund studies that ultimately reduce their water rights. Water
Code Sections 1052(c)(1)(B) and 1845(b)(1)(b) insert the phrase "highest market value of water," in
relation to the determination of amounts of civil penalties. This language is vague and doesn't indicate
how the "market value" would be determined by the SWRCB or the courts.
ACWA recently approved an "Oppose" position on SB 565. Current Position: Not yet consider.

Summary: Under existing law, the right to water or to the use of water is limited to that amount of
water that is reasonably required for the beneficial use to be served, and does not extend to the waste,
unreasonable use, unreasonable method of use, or unreasonable method of diversion of water. Existing
law requires the Department of Water Resources and the State Water Resources Control Board to take
appropriate actions to prevent the waste, unreasonable use, unreasonable method of use, or
unreasonable method of diversion of water. This bill would require the board, by January 1, 2012, to
adopt regulations to identify unreasonable uses of water during various periods of water shortage, as
specified, and would set forth related legislative findings and declarations.
Laws: An act to add Section 188.7 to the Water Code, relating to water.
Notes 1: This legislation is an author - sponsored bill. The bill would require the State Water Resources
Control Board to develop regulations to determine reasonable water use in times of water shortage.
Urban water suppliers already have authority under Section 375 of the Water Code to adopt and
enforce a water conservation program to reduce the quantity of water used by consumers for the
purpose of conserving the water supplies of the public entity. Urban water suppliers already prepare
and adopt water shortage contingency analyses and plans as part of the Urban Water Management
Planning Act. This bill would require the State Board to make such determinations. As such, it represents
an unnecessary intrusion of the state into local decision making by local elected governing bodies.

Delta. Most importantly, your legislation will undermine water supply reliability throughout
California and will threaten jobs and the economic health of three quarters of the state's
population residing south of the Delta.

Unprecedented water supply restrictions pose a direct threat to 25 million Californians and
millions of acres of farmland that grow much of the nation's fru is and vegetables. The "status
quo” in the Delta is simply unacceptable as both the Delta Vision Task Force and the Public
Policy Institute of California have concluded. Bold and comprehensive action, shaped by the
legislative package that was adopted this past November, is precsely what California needs.
The historic Delta package wisely chose to set an achievable arc balanced set of state policies
to restore this vital estuary and improve the reliability of water supplies if they are given a
chance to succeed.
AB 1594 seeks to reopen a delicately crafted compromise and interject the Legislature into the
intricacies of designing a new conveyance system in the Delta. A. new Delta canal or tunnel will
likely involve multiple intakes, a forebay and other infrastructure. The Legislature has no
expertise for designing roadways, electrical conveyance or other vital pieces of state
infrastructure. It is a dangerous precedent to interject the Legislature into the role of water
infrastructure design. The many layers of protections for the Delta contained in last year's
legislative package will help guide future conveyance decisions to achieve the co -equal goals.
The Bay Delta Conservation Plan (BDCP) is currently analyzing conveyance alternatives as part
of a comprehensive 50 -year strategy of Delta ecosystem and water system improvements. This
planning process will include a sophisticated risk analysis of conveyance alternatives. The
legislative package also included numerous new requirements for the alternatives analysis
process, such as a mandate to review a full range of conveyance alternatives.
The BDCP can only automatically qualify.under the new Delta Plan if it complies with the
highest environmental standard in California, the Natural Communities Conservation Planning
Act. Any new conveyance system must also comply with new Delta flow requirements to be
established by the State Water Resources Control Board prior to the commencement of
construction of conveyance improvements. The future conveyance improvements adopted by
BDCP will have undergone one of most exhaustive and rigorous processes for any infrastructure
project in the nation, including an analysis of local economic impacts as mandated under the
California Environmental Quality Act. Mandating a redundant review by the Legislative
Analyst's Office would represent a misuse of this vital organization In the midst of the worst
fiscal crisis in state history.
The undersigned are committed to meeting California's water management challenges in a
manner consistent with achieving the co -equal goals established by legislative policy. The

LOBBYING FIRM RETENTION CONTRACT
The following constitutes a lobbying firm retention contract between REEB
GOVERNMENT RELATIONS, LLC ( "RGR" hereinafter), or its legal
successor in interest, and EAST VALLEY WATER DISTRICT ( "EVWD"
hereinafter), or its legal successor in interest.
1. SERVICES TO BE PERFORMED —EVWD engages the services of RGR
as an independent contractor with the responsibility for providing advice and
representation on behalf of EVWD relating to California state legislative and
regulatory matters. Such services shall include:
A. Representation in the State Capitol and with the Executive Branch
in regard to EVWD's 2009 -10 California legislative program.
B. Research and analysis of state legislative and regulatory issues and
related initiatives; drafting legislation and amendments thereto
relating to such issues.
C. Legislative reporting services as may be required by EVWD.
D. Participation and attendance at meetings. upon request by
EVWD, including, but not limited to, meetings related to issues
management and formation of lobbying coalitions.
RGR will work under the direction of the General Manager and will
coordinate services to be performed with same.
2. TERMS OF PAYMENT —EVWD will pay RGR, according to terns and
conditions set forth herein, a fee of SEVENTY -TWO THOUSAND AND NO/ 100
DOLLARS ($72.000.00) for the period of July 1, 2009 through June 30. 2010.
This amount shall be paid in twelve (12) equal installments of SIX

Payment is past due the next business day follmyine the fifteenth of
the month. If PVWD has any valid reason far disputing any portion
of an invoice. f.VWD will so notify RGR v� ithir, seven (7) calendar
days of receipt of invoice, and if no such n,x!tication is given. the
invoice shall `, deemed valid. The portion RGR's invoice that is
not in dispute shall be paid in accordance %% ith 'he procedures set
forth herein.
B. EVWD shall reimburse RGR all costs incurred in connection with
the services rendered. Reimbursable costs include, but are not
limited to, tray el costs, telephone, facsimile. copies. and delivery
that are attributable to the services rendered. Travel costs are defined
as air travel. lodging, meals and incidentals. ground transportation,
and all costs associated with travel. All extraordinary travel expenses
must receive F VWD's prior approval. RGR shall provide to EVWD
substantiation of reimbursable costs incutrcd in no event shall the
aggregate amount of reimbursable costs pad .tble by EVWD during
the contract period exceed the amount off IVE THOUSAND AND
NO/ 100 DOLLARS ($5.000.00). And expense incurred in excess of
FIVE THOUSAND AND NO/ 100 DOFI_y RS ($5,000.00) shall be
the legal responsibility of RGR.
C. A finance charge of 1.5% per month on tlic unpaid amount of an
invoice will he charged on past due accounts. Payments by EVWD
will thereafter be applied first to accrued interest and then to the
principal unpaid balance. Any attorney fees. court costs, or other
costs incurred in collection of delinquent ac, aunts shall be paid by
EVWD. If pa, -ment of invoices is not currcrt. RGR may suspend
performing "urther work.

3. INDEPENDENT CONTRACTOR —It is understood that RGR will
function as an independent contractor and will hold itself out as such and will be
without authority to obligate EVWD for indebtedness, contracts, or other legal
obligations.
4. POLITICAL REFORM ACT —RGR will be solely responsible for its filing
and reporting obligations pursuant to the Political Reform Act of 1974, as it may
be amended from time to time. EVWD will be solely responsible for its filing and

5. GOVERNING LAW - This agreement shall be governed by and construed
pursuant to the laws of the State of California.
6. ENTIRE AGREEMENT - This is the entire agreement of the parties and no
other representations, promises or agreements, oral or otherwise, shall be of any
force or effect. This agreement may be supplemented, amended or revised only in
writing by agreement of the parties.
7. TERM OF CONTRACT —This engagement shall be subject to review at
any mutually agreed upon time. Either party may terminate this engagement
without cause by giving written notice at least sixty (60) days prior to the date of
termination. The effective date of this agreement is July 1. 2009, and it shall
terminate on June 30, 2010.

during the month of July, 2009.

• Was briefed by Bob Martin and Gary Sturdivan concerning the ERNIE
collaboration with USGS and Gary's planned trip to DC to participate in
briefings with USGS personnel. Was asked by Bob to accompany the group
for some of their meetings.
• Had dinner with Gary, USGS scientists, and California State emergency
management officials the night before the briefings in order to learn more
about what would be presented the next day and to become more familiar with
the materials.
• At Bob's request, emailed and called selected Congressional offices to let
them know that East Valley/USGS would be seeking an appointment in order
to provide a briefing for their disaster preparation scenarios.
• Met the group on Capitol Hill and accompanied them to meetings with staff of
Congressman Jerry Lewis and with Mr. Lewis himself as well as
Congresswoman Jane Harmon and staff of Congresswoman Mary Bono -
Mack. Also accompanied the group to the formal presentation for
Congressional staff presented in the US Capitol Visitors Center.
• Sent Bob Martin a report concerning the documents that we had given to the
group in Washington. This included the FYI House and Senate Interior,
Environment, and Related Agency Appropriations bills with a special
reference to the earmwks that were provided for various USGS projects.
Provided a post - briefing assessment for Bob Martin suggesting the potential
for the ERNIE water agencies to seek an FYI earmark for specific work that
would impact East Valley and the Inland Empire. Emphasized that Senator
Diane Feinstein is the Chair of the Senate Interior Appropriations Committee
and that House Members we had spoken to also seemed highly supportive of
the potential for the program.
Began working with Bob to discuss the upcoming East Valley trip to DC in
early September and what the agenda should be. This includes stops in key
House and Senate offices, starting with Mr. Lewis and Senator Feinstein as
well as stops at ACWA, the US Army Corps of Engineers, and also continued
support for the FEMA concept that Gary Sturdivan helped to initiate this past
week in Washington.
Briefed Bob on the potential impact of S. 787, the "waters of the US"
legislation that has been passed on a party line vote out of Senator Boxer's
Committee on Environment and Public Works. Discussed with Bob how the
removal of "navigable" out of the statutory language of the Clean Water Act
might impact the operations of East Valley Water District and the options of
the District to make a difference in the debate.
Provided an update for Bob with regard to how Texas Senator John Cornyn
had put a hold on S. 787 and how he was working with Senator Crapo of
Idaho and Senator Inhofe of Oklahoma to try and improve the bill. Our
briefing including information on how Senator Cornyn is reaching out to
stakeholders in Texas to learn more about this issue.
Updated Bob on the intent of the White House Council on Environmental
Quality to re -issue a Carter era Executive Order governing activities on
floodplains. This will extend to all current and potential activities on 500 year
floodplains which take in a good part of the nation. White House executive
orders have the force of law during the life of an individual administration.
East Valley needs to play a part in educating our Congressional delegation
with regard to this new move by the White House.
Provided reports and updates on the decision of the CEQ to take over the
process of writing "Principals and Guidelines" [P &G] away from the Corps of
Engineers and place this responsibly in the White House. This move will also
extend P &G from beyond the current Federal agencies of the Corps, the
Bureau, USGS, and NRCS and make it applicable to all Federal agencies that
engage in water projects. This is a huge issue for East Valley Water District
because of your anticipate collaboration with the Corps to address the water
quality impacts created by the Seven Oaks Dam.

• Conducted follow up telephone conversation with Gary after his return to
California and discussed the next potential steps and the potential timing for
additional East Valley outreach to the USGS and to the Congress in support of
disaster response by water agencies.
At the request of Bob Martin and Gary Sturdivan participated in an East
Valley/USGS conference call during which the trip to Washington was discussed
and future strategies alsc discussed. Also reported to Bob Martin on my
impressions during this conference call and agreed to work with Bob to support
his bringing these issues to key Federal stakeholders during his next visit to DC.
Kept Bob Martin updated with regard to progress on a number of Federal
legislative issues and also potential actions by the White House with regard to
Federal Executive Orders. Provided an in -depth briefing to Bob on the potential
impacts of S. 787 on the operation of the East Valley Water District and discussed
potential strategies for East Valley to become involved in this issue.
• At the request of Bob Martin, drafted an East Valley letter concerning S. 787 to
Senators Feinstein and Boxer. After consideration and approval by the East
Valley Board of Directors, this letter was finalized and hand delivered to Senator
Boxer at the Senate Environment and Public Works Committee. The letter was
also circulated to other Senators and also House Members and will be a point of
discussion during Bob Martin's September trip to DC.
• Worked with Bob Martin to discuss the potential agenda for his September trip to
Washington. This included potential topics for discussion as well as the specific
people we wanted to see while he is in town. It was agreed that the USGS, Seven
Oaks Dam, and S. 787 would be our prime topics of outreach.
• Began working with Bob to set up the specific appointments for his visit. This
included arranging a meeting with the staff of Senator Feinstein, a meeting at the
Association of California Water Agencies, a meeting with the staff of
Congressman Jerry Lewis, and also a meeting with the Army Corps of Engineers.

the District and the recent East Valley letter highlighting these concerns. Staff
indicated that Congressman Baca had not been a co- sponsor of similar language
in the l 10`h Congress and promised to listen carefully to the District's concerns as
the House prepares to take up the Senate version of the bill. We promised that we
would remain in close touch as this process goes forward.
• Met with David Reynolds and Abby Schneider of the ACR'A DC staff.
Discussed in details the District's involvement with USGS and laid the
groundwork for future cooperative support of ACWA fo- the USGS cooperative
effort with water agencies. Also Bob arranged to have this issue put on the
agenda for the upcoming ACWA Federal Affairs meeting in Sacramento.
• Met with Larry Prather, Director of Legislation and Planning, US Army Corps of
Engineers Headquarters. Discussed the Seven Oaks Dam situation in detail and
asked for his guidance on how best to work with the LA District of the Corps and
through the WRDA and the Appropriations cycles to provide the necessary
legislative authority and funding to complete the job c f restoring damage to the
surface water supply done by the dam.
Noted that the House Transportation and Infrastructure Corrunittee had made
available the Member request forms for WRDA -2010 and was requesting
Member project requests this fall with a target date to begin working on the bill of
February, 2010. Sent Bob a copy of the project form provided by the Committee
so that East Valley could familiarizes itself with the issues that needed to be
addressed.
• Noted that Secretary of the Interior Salazar was going to hold a special meeting at
the DOI to go over possible Federal responses to the California water crisis. Sent
Bob this meeting notice and also noted that one of the topics was too be
discussion for how the USGS could interface with this entire process. We also
conveyed this information to Gary Sturdivan who in turn passed it on to his USGS
contacts in California.
• Continued to keep East Valley updated on the progress of the Council on
Environmental Quality and their efforts to amend a Carter .Administration era
Executive Order on Flood Plain Management. Noted that this new effort was to
increase Federal oversight to include the 500 year flooe plain. This would take in
activities ranging from water and wastewater operations to almost any business
activity.
• Noted the completion of the FYI Energy and Water Appropriations Conference
Report. Reviewed this document and noted that the Seven Oaks Dam Water
Conservation Study had received $672,000 in funding. Alerted Bob Martin to this
fact.
• Was briefed by Bob after the group meeting with Dr. Josephine Axt, Planning
Director for the LA District of the Corps of Engineers. After hearing the report,
discussed with Bob the potential next steps that needed to be taken to close the
loop with regard to dealing with the problems created by the dam. At his request,
sent Bob scans of the Seven Oaks Dam Appropriations and also WRDA -07
language dating back to 2007 for distribution to other agencies.

• Reviewed the FYI Energy and Water Appropriations Conference Report and
noted that the Seven Oaks Dam Water Conservation Study had been funded in
the Corps of Engineers account. Briefed Bob Martin on this development so
he could be aware of during his discussions with the LA District of the Corps
of Engineers.
At the request of Bob, provided a draft letter of appreciation from the East
Valley Board to Jerry Lewis as well as to Congressmen Calvert and also Baca
for their support of the Seven Oak Dam Water Quality funding in the FY
Energy and Water Appropriations bill. Emailed this draft to Bob for use
before the East Valley Board.
At Bob's request, briefed him on the status of the CEQ Flood Plain
Management issue including the time -frame for when the new Executive
Order might be released and some of the key elements affecting the 100 and
the 500 year flood plain. Included information on what other interest groups
were doing in terms of the Executive Order and also where we were getting
some of our information.
Also at Bob's request provided a bullet point repor. for Bob's use with the
East Valley Legislati-,e Committee providing an update and briefing for them
in understanding the Executive Order issue. FonvEided these bullet points via
email to Bob.
At Bob's request, prepared a draft letter for the consideration of the East
Valley Board for use in reaching out to Senators Feinstein and Boxer and also
to Congressmen Lewis and Baca with regard to the Clean Water Restoration
Act that is pending in the House of Representatives and has already been
passed out of Senator Boxer's Environment and Pubic Works Committee in
the Senate. Built upon points used by other agencies in .he and West,
including California. in crafting the East Valley letter.
Provided an update for Bob on a rider that is included in the FY10 Interior and
Environment Appropriations bill concerning an exemption for Great Lakes
freighters from air regulations. East Valley Water District has been a leader in
past riders concerning radon.
Updated Bob on a New York Times editorial and a series of articles in the
Times that claim that most public agencies ignore the Clean Water Act and
that USEPA and State Regulatory Agencies rarely if ever actually assess
penalties for violations. This position by the NY Times was so at valiance
with how East Valley does business that we wanted Bob to know that this line
of argument was being made.
• Was briefed in detail by Bob with regard to the outreach he and East Valley
were having with the LA District of the Corps of Engineers concerning the
Seven Oaks Dam issue including the twice monthly conference calls and the
regular face to face meetings on the issue.
• Updated Bob on what the Conservation District had learned during its trip to
Washington DC and its meetings with Justin Landcn with regard to the Seven
Oaks Dam water quality fix.
• Also updated Bob on the response of Leah Russin. Environmental Counsel for

Worked with Bob to develop a WRDA request for Congressman Lewis to

behalf of the Seven Oaks Dam water issue.
• Researched past WRDA language including the WRDA -07 language
authorizing the water quality and water conservation studies associated
with the Seven Oaks Dam. Put this language and also the statutory
language associated with the Dam into a report which was emailed to Bob.
Spoke at length with Bob as we reviewed the various options for WRDA
language including specifics regarding the kinds of remediation we wished
to see and also dollar figures. Worked with Bob to develop "placeholder
language" that allows Congressman Lewis to submit a Seven Oaks
WRDA request while at the same time allowing the opportunity to supply
more details once the water quality and water conservation studies are
completed.
Spoke at length with Justin Landon in Mr. Lewis' office with regard to our
WRDA approach and what we planned to submit. Listened to Justin's
suggestions for how this language might be crafted. We also made sure
that he understood that East Valley and other local stakeholders would be
requested more exact language regarding remediating the water quality
issues of the Dam once we were in possession of the completed water
quality study.
• At the request of Mr. Lewis, worked with Bob Martin to create a
constituent request letter for WRDA -2010 that will accompany our project
request. Drafted a letter for Bob's review and to.- circulation and
comment from the East Valley Board of Directors. Included institutional
history of the issue in our draft as well as East Valley's concern over the
future of its surface water supply. Emailed to Bob.
• Once our WRDA request and the accompanying constituent request letter
was completed. contacted Justin Landon in Mr. Lewis' office and made
sure that he had all the necessary documents in support of the request and
that he would be submitted it to the Transportation and Infrastructure
Committee on behalf of Mr. Lewis.
• Began discussions with Bob concerning the FY I I .Appropriations cycle
and how East Valley might wish to craft its appropriations requests to the
various committees. East Valley will be in Washington in February and it
is important that we begin consideration of our requests which will include
both appropriations and also authorization requests such as WRDA.
• Discussed in detail with Bob the potential for the artificial wetlands which
is being proposed by the San Bernardino Valley Water Conservation
District. Among the items discussed were how the wetlands might fit into
the overall solution to the Seven Oaks Dam water quality issue and where
the necessary daily supply of wastewater could be secured for the
operation of the wetlands. Bob also discussed potential barriers from
regional and state regulators for mixing reclaimed wastewater and
groundwater.
• Updated Bob on the latest information concerning the issuing of a flood
plain executive order by the White House Council on Environmental
Quality. Provided the latest information on where this issue stands and
also discussed how East Valley might be impacted according to the
various scenarios that we understand is being considered.
• Updated Bob concerning how issues such as health insurance reform and
global warming may impact the pace of Congressional consideration of
issues that are of primary concern to East Vallev such as Energy and
Water Appropriations in the future, WRDA reauthorizations, and EPA
regulatory issues such as those dealing with radon and perchlorate.

context of these much larger issues.

• Briefed and updated Bob when the Council on Environmental Quality released its
"Principals and Guidelines" draft to the public and requested comments. P &G
will re -write the rule -book for how Federal agencies such as the Corps of
Engineers, the Bureau of Reclamation, and the USEPA conduct projects.
Kept Bob updated and briefed on the various efforts within the water resources
community with regard to the Executive Order that will soon be issued by the
Council on Environmental Quality with regard to floodplain management. This
EO will impact any and all activities, including the operation of water utilities, on
the 100 and the 500 year floodplain and is being put together without any input
from public agencies.
• Worked with the staff of Congressman Jerry Lewis to make sure that they
understood the request for WRDA -2010 involving wordingthat instructs the
Corps to carry out in full any conclusions and recommendations issued as a result
of the studies funded through the support of Mr. Lewis through the
Appropriations process.
Worked with Mr. Lewis' staff to ensure that these concepts and East Valley's
suggested language were submitted to the WRDA Committee in time for the
Committee's December 3`d deadline for WRDA -2010 projects. We will also be
working with the two Senators in the New Year to ensure that this same East
Valley request is conveyed to them as well in support of VMA -2010.
• Received update from Bob with regard to the latest meeting/briefing that East
Valley had received from LA Corps of Engineers personnel. Specific emphasis
was put on the direction of the water quality study and the water conservation
study and how these twc i ssues could be harmonized and blended into a single
policy.
Used the briefing that Bob had attended to begin strategizing with Bob with
regard to the East Valley federal agenda for 2010 with a special emphasis on
outreach and strategy with the LA District and Headquarters staff of the Corps of
Engineers and with the United States Congress.
• Briefed and update Bob on the anticipated schedule of consideration for WRDA-
2010 and how East Valley can ensure that a Seven Oaks Dam provision that will
address the water quality issue is made a part of the bill. Also speculated with
Bob on whether the Congress will have time to actually complete work on a final
bill.
• Sent Bob information and updated him on the latest information on perchlorate
and the latest efforts by both EPA and by Senator Boxer to increase regulations.
Sent Bob information on the latest statements by Senator Boxer and also by EPA
Administrator Lisa Jackson concerning the danger of perchlorate to the public.
• Senate Bob the latest New York Times article which alleged that up to 60 million
people are sickened each year by unsafe drinking water and suggesting that
perchlorate and radon were both factors in these threats to the public health.
• Began discussions with Bob with regard to how East Valley can best spend its
time when it is back in DC for the ACWA conference. Initial discussions were to
concentrate on the Corps Headquarters meetings and the Hill Member offices and

Kept Bob Martin updated with regard to consideration of the FY09 Omnibus
Appropriations bill in general and the provisions of the Seven Oaks Dam Water
Study in particular.
When the FY09 Omnibus Appropriations bill was passed, reviewed the details
and determined that the $1.5 million inserted by Mr. Lewis into the House version
of the bill had been retained in the conference. Reported this to Bob and also sent
him a scanned copy of the page of the bill in question highlighting the $1.5
million provision.
• Totaled the funding for the Seven Oaks Dam Water Study for FY07, FY08, and
FY09 and determined that it was almost $7.2 million. Related this to Bob and re-
visited the East Valley strategy to seek left -over study finding for use in upgrades
for the East Valley surface water treatment plant.
Noted that Colonel Magness was planning a trip back to Washington to brief
Members of the California delegation on various California water projects that the
Corps was involved in. Suggested to bob that this would be a good time to have
Mr. Lewis question Colonel Magness with regard to when the Seven Oaks Study
would be completed and when the Corps might have funds to actually begin
solving the Seven Oaks Dam water quality issue. Agreed with Bob to design a
strategy that would help to clarify this issue by briefing Mr. Lewis to ask the
correct and pertinent question to the Colonel.

Worked to draft a briefing paper for Justin Landon of Mr. Le-Ws' staff. This
included the East Valley funding request for upgrades to the surface water
treatment plant and also a briefing with regard to how much money had been
appropriated to the Seven Oaks Dam Water Study in total.
Reviewed past Appropriations bills and also WRDA -07 so that we could
accurately quote the authorization language for the study as well as the three years
of appropriations received. Provided a short narrative with regard to why this was
important and timely for East Valley Water District. Included Bob's suggestion
that the report also include that other agencies including Muni and the Water
Conservation District were also interested in this issue.
• Finalized the paper and sent it to Justin Landon. Also contacted Justin to provide
follow -ups and to determine if he had any questions or needed additional
information. We anticipate a complete answer from the LA District of the Corps
early in April and we will pass this on to Bob as soon as it is received.
• Provided Bob a state by state breakdown of projects which various agencies,
including those in California, had submitted as "shovel ready" for Stimulus
funding. The list included a subset for California and many local areas
communities. Also sent along an explanatory report to Bob with this information.
Noted a new program from the Department of Energy that could help to support
the "energy -water nexus." This would be grant funding that could be used to
improve water efficiencies within units of local government, including water
districts. Telephoned Bob Martin and provided basic information on this
program along with websites for Bob and his staff to review.
Kept Bob updated with regard to my perspective on what is going on with regard
to the issue of the consolidation of the San Bernardino Valley Water Conservation
District.

agenda for FYI during this meeting.

Drafted a proposed email from Bob Martin to the staff of Jerry Leyvis asking that
FY09 Seven Oaks Dam Water Study funding in the Energy and Water
Appropriations Construction Account of the House bill be retained in the final
version of the FY09 Omnibus Appropriations bill. An email making that request
was sent to Bob Martin.
Discussed in detail with Bob after his visit with Dr. Axt, Chief of Planning of the
Corps of Engineers LA District, exactly what he had learned and also how East
Valley could use this knowledge to create a long -term strategy to move the Seven
Oaks Dam from one focused on "study" to one which actually addresses the
problems associated with the dam.

• Noted the existence of a new DOE program that promotes energy efficiency at the
local government level through grants. Briefed Bob Martin on this program and
explored with Bob whether East Valley might be able to make use of such a
program both immediately and in the near future.
Provided Bob with a listing of all California water agencies that were currently
eligible for the DOE energy efficiency grants. Noted that this did not include
special districts such as water districts although it does include cities, counties,
and Indian tribes. Discussed with Bob strategies for how this new program can be
expanded to include water districts, which are among the largest user of energy of
any part of local government.
Noted that Pete Silva of MET had been nominated to be the new Assistant
Administrator for Water at USEPA. Reported to Bob that we had had dinner with
Mr. Silva in Washington. Discussed how having a Southern California water
person might prove useful when and if EPA re- issues proposed regulations for
issues such as radon and perchlorate.
Provided Bob with a "DC Updates" report which included an attachment of
Senator Boxer's most recent statement declaring her commitment to force EPA to
promulgate a national standard for perchlorate. Given East Valley's leadership
role with regard to the perchlorate issue, Bob and I discussed how the District
should become involved in what will be a growing debate and controversy with
regard to Senator Boxers announced intentions.
Related to Bob that Tom Ray had been invited to the ACWA May conference in
Sacramento in his capacity as Chair of the TWCA Federal Affairs Committee.
Alerted Bob to the fact that Tom would be appearing at the Tuesday meeting of
the ACWA Federal Affairs Committee. Will arrange for Tom and East Valley
representatives to get together when all are in Sacramento next month.
r Noted the announcement of Lester Snow that $240 million in now available from
the State Department of Water Resources for various water projects. Sent Bob an
email and attached the multi -page project list for high priority candidates to
receive this funding. Discussed this program with Bob in a telephone call as well.
Worked with Bob regarding future East Valley participation in WESTCAS. Put
Bob in touch with WESTCAS membership coordinator and also discussed with
Bob some of the issues that we expected the Coalition to be taking up, including
the annual conference in June in San Diego and a potential Washington DC trip in
September.
Noted that the Corps of Engineers had issued its decisions with regard to $2
billion in construction funding provided by the Stimulus program. Sent Bob the
41 page list of all projects with a special mention of those that represented the
$200 million of the $2 billion available for "environmental infrastructure"
projects.
Noted that one of the environmental infrastructure projects was for $1 million to
"construct environmental mitigation measures downstream of Seven Oaks Dam."
Called this to Bob's attention and developed a strategy to determine what agency
was going to receive this funding. The strategy included working with the office
of Congressman Lewis and also contacting the LA District of the Corps of
Engineers.
Also determined after conversations with Congressman Lewis' staff that the
Corps of Engineers was telling them that the Seven Oaks Water Quality Study
could not be completed and recommendations made until the Seven Oaks Dam
Water Conservation Study was also completed. Developed a strategy with East
Valley whereby East Valley will support a transfer of funds from the Water
Quality study to the Water conservation Study. This strategy will allow the Corps
to begin working immediately to complete the Water Conservation study as
opposed to waiting for FYI funding which probably wouldn't become available
until early 2010.
Conveyed this support of a minimal transfer of un -used funds from the Water
Quality Study to the Water Conservation study to Congressman Lewis.

• Monitored the FYI proposed budget from the Obama Administration for the
Army Corps of Engineers. Paid particular interest to the funds requested for the
Seven Oaks Dam and the Santa Ana Mainstem. Reported these figures to Bob.
Noted in particular that the Corps had requested $1 million "downstream"
environmental remediation associated with the Seven Oaks Dam. At Bob's
request, contacted the office of Congressman Lewis and requested if they had
made this request. When we determined they had not, then asked if they knew
what the money was intended for. When this answer was "no" began working
with Mr. Lewis' office on an outreach to the Corps to determine their plans for
these funds.
• Agreed on a joint approach in which Congressman Lewis' staff would call the LA
District with this question and that also a parallel call would be made by Bob.
The responses will then be exchanged and a coordinated approach and response
launched during June.
• Monitored the confirmation hearing of Pete Silva to be the next Assistant
Administrator, USEPA, for Water. This is of particular interest to East Valley
because Mr. Silva will be the lead person with regard to crucial EPA regulatory
issues involving East Valley including radon and perchlorate rem:lation

Attended the Silva confirmation hearing and reported to Bob on how Mr. Silva
had responded to a question from Senator Boxer regarding to his willingness to
commit to starting on a national regulation for perchlorate within 90 days of his
being confirmed. A confirmation vote for Mr. Silva is expected in the Senate in
June with confirmation a near certainty.
Monitored the status of the nomination of Jo -Ellen Darcey to be the next Assistant
Secretary of the Army for Civil Works which is the top position at the Army
Corps of Engineers. Ms. Darcey also looks to also be a near certain confirmation
by the full Senate. She will be the top official that East Valley will need to deal
with as it working over the coming months and years to bring the Seven Oaks
Dam issue to a successful conclusion.
We kept Bob updated and informed of the kinds of questions posed by Senator
Boxer and her Environment and Public Works Committee which is the chief
Senate Committee of jurisdiction with regard to Ms. Darcy's nomination. We
also provided Bob with background on Ms. Darcey including her past service as a
Senate staffer for the EPW Committee and currently the Finance Committee
working for Senator Baucus.
Kept Bob updated with regard to progress on the EPA proposed FYI budget
including the huge increases being proposed by the Obama Administration for
both the Clean Water State Revolving Loan Fund and the Drinking Water
Revolving Loan Fund. East Valley has formerly not chosen to participate in this
program but we did want the District to be aware of this growing source of
Federal dollars.
Worked to keep Bob updated on important legislation pending in the Senate
which is the reauthorization of both the Clean and the Safe Drinking Water SRF
programs. Noted in particular the new provisions that reserve a substantial
portion of these newly authorized funds for economically disadvantaged
communities and in particular a new provision that allows an applicant to base its
application on only a part of its service area instead of the whole.
• Updated Bob on the fact that a House version of this reauthorization legislation
had already passed the full House by a vote of better than three to one so the
reauthorization of the Safe Drinking Water and the Clean Water SRF programs is
very much a real possibility in this Congress.
Reported to Bob on the likely schedule for the rest of the Congressional year with
regard to when the Congress would be in session and when we expected the
Appropriations cycle to begin. Although it is only early June, the time available
for Congress to complete action on many key issues is fast receding. Also
speculated on how issues such as National Health Care may drive other issues
into the background. Sent this report to Bob and began working with him on an
East Valley time -table for appropriate responses.

• Met with General Manager Martin during the WESTCAV?I@e'etrng "in San Diego
and did a face to face review of the legislative situation in Washington including
the FYI Appropriations cycle and its anticipated calendar for the remainder of
this year.
Also discussed with the General Manager how the Seven Oaks Water Quality
issue could be coordinated with the Seven Oaks Water Conservation Study.
Discussed in some detail how East Valley might reach out to the LA District of
the Corps of Engineers to keep them better informed of how these two studies,
while complementary, are not the same thing. Also discussed our strategy for
dealing with this issue at the DC level including Corps Headquarters and also
Congressman Lewis and our two Senators.
Secured a copy of the FYI House Energy and Water Appropriations
Subcommittee draft bill and reviewed for projects and guidance language that
would be of interest to East Valley Water District. Noted that $1,000,000 had

provided at the request of Congressman Lewis for envirorental
remediation activities in the Santa Ana River. Also noted that $800,000 at been
provided at the request of Representatives Lewis, Baca, and Calvert for the Seven
Oaks Dam Water Conservation Study.
Prepared a report for East Valley which included scanned copies of key pages
from the House FYI Energy and Water Appropriations Subcommittee draft that
highlighted these two important areas of funding. Emailed to General Manager
Martin at East Vallev along with an accompanying report.
Sent East Valley a report on the project calendar that both the House and the
Senate are anticipating to follow in terms of marking up and completing the
various FYI Appropriations bills. Noted with particular interest the House
Energy and Water projected markup schedule which began in late June with the
House Subcommittee markup with the first phase of House - Senate consideration
anticipated to end by late September and the hoped for passage of each of the
FYI Appropriations bills in regular order.
• Alerted General Manager Martin to the recent letter sent out by the Bureau of
Reclamation to all agencies who are receiving Title 16 Stimulus funding to the
effect that each of these agencies must certify that no Stimulus dollars are being
used to support delivery of reclaimed water to either golf courses or to casinos.
Reflected on the implications of a Federal agency in effect deciding which
customers could be served by local water agencies.
Closely followed the Senate Committee consideration of S. 787, the "Waters of
the US" legislation. Noted in particular what we considered might be the most
pressing impacts on East Valley of this legislation, unless amended. Also alerted
General Manager Martin of how other agencies and organizations, including
WESTCAS and ACWA, were mobilizing to try and produce a better and more
acceptable bill. East Valley could be a very effective participant in carrying the
message of local water agencies to the Congress regarding amendments that the
water community hopes to attach to this legislation.
• Discussed with WESTCAS personnel and with David Reynolds how East Valley
could be most effective in carrying a "Waters of the US" amendment language to
the Hill. Notified both WESTCAS and ACWA of our hope and anticipation that
East Valley would become active with regard to this issue.
Alerted General Manager Martin to the fact that Dr. Christine Altendorf had been
named to the Federal Senior Executive Service. This move probably paves the
way for Dr. Altendorf to return to Corps Headquarters m Washington. It will be
recalled that East Valley has worked extensively with Dr. Altendorf over the past
few years with regard to the Seven Oaks Dam Water Quality issue. We can now
look forward to having her back at Corps HQ as the Seven Oaks issue moves
towards a final resolution.

• Was briefed by Bob Martin and Gary Sturdivan concerning the ERNIE
collaboration with USGS and Gary's planned trip to DC to participate in
briefings with USGS personnel. Was asked by Bob to accompany the group
for some of their meetings.
• Had dinner with Gary, USGS scientists, and California State emergency
management officials the night before the briefings in order to learn more
about what would be presented the next day and to become more familiar with
the materials.
• At Bob's request, emailed and called selected Congressional offices to let
them know that East Valley/USGS would be seeking an appointment in order
to provide a briefing for their disaster preparation scenarios.
• Met the group on Capitol Hill and accompanied them to meetings with staff of
Congressman Jerry Lewis and with Mr. Lewis himself as well as
Congresswoman Jane Harmon and staff of Congresswoman Mary Bono -
Mack. Also accompanied the group to the formal presentation for
Congressional staff presented in the US Capitol Visitors Center.

group in Washington. This included the FY10 House and Senate Interior,
Environment, and Related Agency Appropriations bills with a special

Provided a post - briefing assessment for Bob Martin suggesting the potential
for the ERNIE water agencies to seek an FYI 1 earmark for specific work that
would impact East Valley and the Inland Empire. Emphasized that Senator
Diane Feinstein is the Chair of the Senate Interior .Appropriations Committee
and that House Members we had spoken to also seemed highly supportive of
the potential for the program.
Began working with Bob to discuss the upcoming East Valley trip to DC in
early September and what the agenda should be. This includes stops in key
House and Senate offices, starting with Mr. Lewis and Senator Feinstein as
well as stops at ACWA, the US Army Corps of Engineers, and also continued
support for the FEMA concept that Gary Sturdivan helped to initiate this past
week in Washington.
Briefed Bob on the potential impact of S. 787, the "waters of the US"
legislation that has been passed on a party line vote out of Senator Boxer's
Committee on Environment and Public Works. Discussed with Bob how the
removal of `navigable" out of the statutory language of the Clean Water Act
might impact the operations of East Valley Water District and the options of
the District to make a difference in the debate.
• Provided an update for Bob with regard to how Texas Senator John Comyn
had put a hold on S. 787 and how he was working with Senator Crapo of
Idaho and Senator Inhofe of Oklahoma to try and improve the bill. Our
briefing including information on how Senator Comyn is reaching out to
stakeholders in Texas to learn more about this issue.
Updated Bob on the intent of the White House Council on Environmental
Quality to re -issue a Carter era Executive Order governing activities on
floodplains. This will extend to all current and potential activities on 500 year
floodplains which take in a good part of the nation. White House executive
orders have the force of law during the life of an individual administration.
East Valley needs to play a part in educating our Congressional delegation
with regard to this new move by the White House.
Provided reports and updates on the decision of the CEQ to take over the
process of writing "Principals and Guidelines" [P &G] away from the Corps of
Engineers and place this responsibly in the White House. This move will also
extend P &G from beyond the current Federal agencies of the Corps, the
Bureau, USGS, and NRCS and make it applicable to all Federal agencies that
engage in water projects. This is a huge issue for East Valley Water District
because of your anticipate collaboration with the Corps to address the water
quality impacts created by the Seven Oaks Dam.

California and discussed the next potential steps and the potential timing for
additional East Valley outreach to the USGS and to the Congress in support of
disaster response by water agencies.
At the request of Bob Martin and Gary Sturdivan participated in an East
Valley/USGS conference call during which the trip tc "'ashington was discussed
and future strategies also discussed. Also reported to Bob Martin on my
impressions during this conference call and agreed to work with Bob to support
his bringing these issues to key Federal stakeholders during his next visit to DC.
Kept Bob Martin updated with regard to progress on a number of Federal
legislative issues and also potential actions by the White: House with regard to
Federal Executive Orders. Provided an in -depth briefing to Bob on the potential
impacts of S. 787 on the operation of the East Valley Rater District and discussed
potential strategies for East Valley to become involved in this issue.
At the request of Bob Martin, drafted an East Valley letter concerning S. 787 to
Senators Feinstein and Boxer. After consideration and approval by the East
Valley Board of Directors, this letter was finalized and hand delivered to Senator
Boxer at the Senate Environment and Public Works Committee. The letter was
also circulated to other Senators and also House Members and will be a point of
discussion during Bob Martin's September trip to DC.
• Worked with Bob Martin to discuss the potential agenda for his September trip to
Washington. This included potential topics for discussion as well as the specific
people we wanted to see while he is in town. It was agreed that the USGS, Seven
Oaks Dam, and S. 787 would be our prime topics of outreach.
• Began working with Bob to set up the specific appointments for his visit. This
included arranging a meeting with the staff of Senator Feinstein, a meeting at the
Association of California Water Agencies, a meeting with the staff of
Congressman Jerry Lewis, and also a meeting with the Army Corps of Engineers.
• Supported and provided background information for Bob Martin for his securing
an appointment on behalf of East Valley and other area water agencies with Dr.

• Arranged for meetings in preparation for Bob Martin's trip to DC. This included
briefing Hill and Corps of Engineers staff with regard to the issues Bob wanted to
discuss as well as actually making the appointments.
Printed out materials for Bob in preparation for his trip to DC. This included additional
East Valley letters concerning the impact of S. 787, Congresswoman Grace Napolitano's
recent letter urging more Title 16 funding, and other materials.
Accompanied Bob on trip to the Hill during which we briefed Justin Landon of
Congressman Jerry Lewis' staff concerning the Seven Oaks Dam water issue.
Discussed in detail strategies for making sure that the Water Quality and the
Water Conservation studies worked together and also how future funding and the
necessary WRDA language could be made to work together.
Briefed the staff of Congressman Joe Baca with regard to the impact of S. 787 on
the District and the recent East Valley letter highlighting these concerns. Staff
indicated that Congressman Baca had not been a co- sponsor of similar language
in the 1 I Os' Congress and promised to listen carefully to the District's concerns as
the House prepares to take up the Senate version of the bill. We promised that we
would remain in close touch as this process goes forward.

Met with David Reynolds and Abby Schneider of the ACWA DC staff.
Discussed in details the District's involvement with tJSGS and laid the
groundwork for future cooperative support of ACWA for the USGS cooperative
effort with water agencies. Also Bob arranged to have this issue put on the
agenda for the upcoming ACWA Federal Affairs meeting in Sacramento.
Met with Larry Prather, Director of Legislation and Planning, US Army Corps of
Engineers Headquarters. Discussed the Seven Oaks Dam situation in detail and
asked for his guidance on how best to work with the LA District of the Corps and
through the WRDA and the Appropriations cycles to provide the necessary
legislative authority and funding to complete the job of restoring damage to the
surface water supply done by the dam.
Noted that the House Transportation and Infrastructure Committee had made
available the Member request forms for WRDA -2010 and was requesting
Member project requests this fall with a target date to begin working on the bill of
February, 2010. Sent Bob a copy of the project form provided by the Committee
so that East Valley could familiarizes itself with the issues that needed to be
addressed.
Noted that Secretary of the Interior Salazar was going to hold a special meeting at
the DOI to go over possible Federal responses to the California water crisis. Sent
Bob this meeting notice and also noted that one of the topics was too be
discussion for how the USGS could interface with this entire process. We also
conveyed this information to Gary Sturdivan who in turn passed it on to his USGS
contacts in California.
Continued to keep East Valley updated on the progress of the Council on
Environmental Quality and their efforts to amend a Carter Administration era
Executive Order on Flood Plain Management. Noted that this new effort was to
increase Federal oversight to include the 500 year flood plain. This would take in
activities ranging from water and wastewater operations to almost any business
activity.
Noted the completion of the FYI Energy and Water Appropriations Conference
Report. Reviewed this document and noted that the Seven Oaks Dam Water
Conservation Study had received $672,000 in funding. Alerted Bob Martin to this
fact.
Was briefed by Bob after the group meeting with Dr. Josephine Axt, Planning
Director for the LA District of the Corps of Engineers. After hearing the report,
discussed with Bob the potential next steps that needed to be taken to close the
loop with regard to dealing with the problems created by the dam. At his request,
sent Bob scans of the Seven Oaks Dam Appropriations and also WRDA -07
language dating back to 2007 for distribution to other agencies.

• Provided the District with a series of reports concerning the status of the 4
Water Resources Development Act for 2010; the Executive Order for Flood
Plain Management that is under consideration by the Council on
Environmental Quality; and other key topics. These reports were sent to
General Manager Martin.
Reviewed the FY10 Energy and Water Appropriations Conference Report and
noted that the Seven Oaks Dam Water Conservation Study had been funded in
the Corps of Engineers account. Briefed Bob Martin on this development so
he could be aware of during his discussions with the LA District of the Corps
of Engineers.
• At the request of Bob, provided a draft letter of appreciation from the East
Valley Board to Jerry Lewis as well as to Congressmen Calvert and also Baca
for their support of the Seven Oak Dam Water Quality funding in the FY
Energy and Water Appropriations bill. Emailed this draft to Bob for use
before the East Valley Board.
At Bob's request, briefed him on the status of the CEQ Flood Plain
Management issue including the time -frame for when the new Executive
Order might be released and some of the key elements affecting the 100 and
the 500 year flood plain. Included information on what other interest groups
were doing in terms of the Executive Order and also where we were getting
some of our information.

• Also at Bob's request provided a bullet point report for Bob's use with the
East Valley Legislative Committee providing an update and briefing for them
in understanding the Executive Order issue. Forwarded these bullet points via
email to Bob.
At Bob's request, prepared a draft letter for the consideration of the East
Valley Board for use in reaching out to Senators Feinstein and Boxer and also
to Congressmen Lewis and Baca with regard to the Ctean Water Restoration
Act that is pending in the House of Representatives and has already been
passed out of Senator Boxer's Environment and Public Works Committee in
the Senate. Built upon points used by other agencies in the and West,
including California, in crafting the East Valley letter.
• Provided an update for Bob on a rider that is included in the FYI Interior and
Environment Appropriations bill concerning an exemption for Great Lakes
freighters from air regulations. East Valley Water District has been a leader in
past riders concerning radon.
Updated Bob on a New York Times editorial and a series of articles in the
Times that claim that most public agencies ignore the Clean Water Act and
that USEPA and State Regulatory Agencies rarely if ever actually assess
penalties for violations. This position by the NY Times was so at valiance
with how East Valley does business that we wanted Bob to know that this line
of argument was being made.
• Was briefed in detail by Bob with regard to the outreach he and East Valley
were having with the LA District of the Corps of Engineers concerning the
Seven Oaks Dam issue including the twice monthly conference calls and the
regular face to face meetings on the issue.
Updated Bob on what the Conservation District had learned during its trip to
Washington DC and its meetings with Justin Landon with regard to the Seven
Oaks Dam water quality fix.
• Also updated Bob on the response of Leah Russin, Environmental Counsel for
Senator Feinstein, with regard to the Seven Oaks Dam issue and in particular
the final LA District Corps office report recommending solutions for the Dam.

• Worked with Bob to develop a WRDA request for Congressman Lewis to
submit to the House Transportation and Infrastructure Committee on
behalf of the Seven Oaks Dam water issue.
• Researched past WRDA language including the WRDA -07 language
authorizing the water quality and water conservation studies associated
with the Seven Oaks Dam. Put this language and also the statutory
language associated with the Dam into a report which was emailed to Bob.
Spoke at length with Bob as we reviewed the various options for WRDA
language including specifics regarding the kinds of remediation we wished
to see and also dollar figures. Worked with Bob to develop "placeholder
language" that allows Congressman Lewis to submit a Seven Oaks
WRDA request while at the same time allowing the opportunity to supply
more details once the water quality and water conservation studies are
completed.
• Spoke at length with Justin Landon in Mr. Lewis' office with regard to our
WRDA approach and what we planned to submit. Listened to Justin's
suggestions for how this language might be crafted. We also made sure
that he understood that East Valley and other local stakeholders would be
requested more exact language regarding remediating the water quality

At the request of' Mr. Lewis, worked with Bob ]Martin to create a
constituent request letter for WRDA -2010 that mill accompany our project
request. Drafted a letter for Bob's review and for circulation and
comment from the East Valley Board of Directors. Included institutional
history of the issue in our draft as well as East Valley's concern over the
future of its surface water supply. Emailed to Bob.
Once our WRDA request and the accompanying constituent request letter
was completed, contacted Justin Landon in Mr. Lewis' office and made
sure that he had all the necessary documents in support of the request and
that he would be submitted it to the Transporiataon and Infrastructure
Committee on behalf of Mr. Lewis.
Began discussions with Bob concerning the FYI 1 Appropriations cycle
and how East Valley might wish to craft its appropriations requests to the
various committees. East Valley will be in Washington in February and it
is important that we begin consideration of our requests which will include
both appropriations and also authorization requests such as WRDA.
Discussed in detail with Bob the potential for the artificial wetlands which
is being proposed by the San Bernardino Valley Water Conservation
District. Among the items discussed were how the wetlands might fit into
the overall solution to the Seven Oaks Dam water quality issue and where
the necessary daily supply of wastewater could be secured for the
operation of the wetlands. Bob also discussed potential barriers from
regional and state regulators for mixing reclaimed wastewater and
groundwater.
Updated Bob on the latest information concerning the issuing of a flood
plain executive order by the White House Council on Environmental
Quality. Provided the latest information on where this issue stands and
also discussed how East Valley might be impacted according to the
various scenarios that we understand is being considered.
Updated Bob concerning how issues such as health insurance reform and
global warming may impact the pace of Congressional consideration of
issues that are of primary concern to East Valle}, such as Energy and
Water Appropriations in the future, WRDA reauthorizations, and EPA
regulatory issues such as those dealing with radon and perchlorate.
Provided our latest information for how these issues 'Ail] play out in the
context of these much larger issues.

• Briefed and updated Bob when the Council on Environmental Quality released its
"Principals and Guidelines" draft to the public and requested comments. P &G
will re -write the rule -book for how Federal agencies such as the Corps of
Engineers, the Bureau of Reclamation, and the USEPA conduct projects.
Kept Bob updated and briefed on the various efforts within the water resources
community with regard to the Executive Order that will soon be issued by the
Council on Environmental Quality with regard to floodplain management. This
EO will impact any and all activities, including the operation of water utilities, on
the 100 and the 500 year floodplain and is being put together without any input
from public agencies.
Worked with the staff of Congressman Jerry Lewis to make sure that they
understood the request for WRDA -2010 involving wording that instructs the
Corps to carry out in full any conclusions and recommendations issued as a result
of the studies funded through the support of Mr. Lewis through the
Appropriations process.
Worked with Mr. Lewis' staff to ensure that these concepts and East Valley's
suggested language were submitted to the WRDA Committee in time for the
Committee's December 3rd deadline for WRDA -2010 projects. We will also be
working with the two Senators in the New Year to ensure that this same East
Valley request is conveyed to them as well in support of WRDA -2010.

• Received update from Bob with regard to the latest meeting briefing that East
Valley had received from LA Corps of Engineers personnel. Specific emphasis
was put on the direction of the water quality study and the water conservation
study and how these two issues could be harmonized and blended into a single
policy.
Used the briefing that Bob had attended to begin strategizing with Bob with
regard to the East Valley federal agenda for 2010 with a special emphasis on
outreach and strategy with the LA District and Headquarters staff of the Corps of
Engineers and with the ;Jnited States Congress.
Briefed and update Bob on the anticipated schedule of consideration for WRDA-
2010 and how East Valley can ensure that a Seven Oaks Dam provision that will
address the water quality issue is made a part of the bil I. Also speculated with
Bob on whether the Congress will have time to actually complete work on a final
bill.
• Sent Bob information and updated him on the latest information on perchlorate
and the latest efforts by both EPA and by Senator Boxer to increase regulations.
Sent Bob information on the latest statements by Senator Boxer and also by EPA
Administrator Lisa Jackson concerning the danger of perchlorate to the public.
• Senate Bob the latest New York Times article which alleged that up to 60 million
people are sickened each year by unsafe drinking water and suggesting that
perchlorate and radon were both factors in these threats to the public health.
• Began discussions with Bob with regard to how East Valley can best spend its
time when it is back in DC for the ACWA conference. Initial discussions were to
concentrate on the Corps Headquarters meetings and the Hill Member offices and
Committee offices early in the week before the conference starts.
• Briefed Bob on when the Congress will be returning to DC and into session for
the second session of the 111 m Congress which will be on January 19'.
Speculated with Bob what might, and might not, get completed during this
election year and what impact the possible Republican resurgence might have on
Members like Jerry Lewis and Ken Calvert.
